That EDGAR NYANHANDA appeared before me, Registrar of


Deeds, he being duly authorised thereto by a Special Power of
Attorney granted to him by JOHN NKOMO, TENDAI MHISHI,
LLYOD MHISHI, ESNATH CHIGUMIRA and DONNA
MACHEKENYA acting under and by virtue of a Resolution of the
Partners of MHISHI NKOMO LEGAL PRACTICE at a meeting held
at Bulawayo on the 24th of October 2024 - the partnership consisting
of

and legally exchanged the following property and that he, in his
capacity as Attorney aforesaid, does hereby transfer to

AS WILL MORE FULLY APPEAR upon reference to Deed of Grant


Registered No. 678/03 with diagram annexed passed in favour of
MHISHI NKOMO LEGAL PRACTICE on the 2nd day of January 2003.

SUBJECT to all such applicable terms and conditions as are


in the said Deed mentioned or referred to
including the following special following
conditions:

1. The said piece of land shall be used solely for


residential purposes and no trade, business,
profession or any other undertaking for profit gain,
or income shall be permitted thereon. Only one
dwelling house shall be permitted on the said
piece of land any such dwelling house shall be of a
minimum value of $4 400.00 excluding the value
of the outbuildings. This condition is imposed in
favour of the City of Bulawayo.

2. Any existing or future walls erected along the


boundary between the said Stand and Stand
10790 adjoining shall in all respects be common
or party walls. This condition is imposed under a
general scheme for the erection of houses with
semi-detached outbuildings on Stands 10413 to
10940 Bulawayo Township and is for the
reciprocal benefit of the owners of all such.

3. No outbuildings or any other building separate


from and not attached to or constructed integrally
with any dwelling house erected on the said piece
of land shall be let or used for nay purpose other
than the housing of bona fide domestic servants
employed by the occupier of the said dwelling
house to work on the said piece of land or in the
said dwelling house. This condition is imposed in
favour of the City of Bulawayo.

4. The City of Bulawayo by its officers, servants or


contractors shall at all times have the right and
power, free of charge, to erect and/or lay and
work pipelines, electrical lines, sewers, drains,
poles and standards upon, over or under the said
piece of land with the further right and power to
enter upon the said piece of land at all times, free
of charge for the purpose of repairing,
maintaining, replacing, altering or inspecting such
pipelines, electric lines, sewers, drains poles and
standards.

5. The strip of land marked x.y.C.D.x on the said


diagram S.G. No. 678/03 annexed to Deed of
Transfer No. 678/03 represents a servitude 3.15
metres wide reserved for City Council services and
the Transferee is restricted from using or
occupying or building upon the said strip of land
and the City of Bulawayo by its servants,
workman, contractors or employees is entitled at
all times to enter thereon and use the same for
City Council services in such manner as it thinks
fit, and to erect. lay construct, maintain, repair
alter, increase and any buildings, poles, lines,
pipes, cables or other services upon the said strip
of land.

ACKNOWLEDGING that the professional valuation of the property


is $146 538.47 and no further consideration is to be paid to either
party.
