SYLLABUS CONTENT ASSESSED:

● discuss the nature of legal capacity, including:


– the age when various rights and responsibilities are granted by the law
– areas of the law that affect young persons in Australia

● explain the ways in which individuals may come in contact with the criminal law, including:
– the elements which must be proven for someone to be convicted of a crime
– the levels of responsibility that apply to young people as the accused, a witness or a
victim – when a young person is considered to be an adult in different criminal situations –
appropriate punishments for a range of crimes

● explain the ways in which individuals may come in contact with the civil law, including:
– the impact of civil law on young people
– how the same incident may give rise to both criminal and civil action
– the capacity of a young person to enter into different types of contracts
– situations where businesses can be found to be negligent in a legal sense
– remedies for negligence

● investigate a current issue relating to the law in action

DESCRIPTION OF ASSESSMENT
Task Overview:
You will complete a case file and in class response by investigating a recent civil
and criminal case in Australia and a recent issue relating to the law in action.

Case File - Part 1

A. Civil Law (520 words) (12 marks)


Choose ONE recent civil case from Australia (last ten years).

1. Identify the parties in the case. (200 words) 2 marks

2. Outline the key facts in the case (150 words) 3 marks

3. Outline the judgment made in the case (150 words) 3 marks

(i.e. who won the case, whether damages were awarded, whether any
other relief was granted). (150 words)
4. Explain the reasons for the judgment in the case. (200 words) 4 marks
B. Criminal Law (520 words) (12 marks)
Choose ONE recent criminal case from Australia or overseas.

1. Identify the parties in the case. (200 words) 2 marks

2. Outline the key facts in the case. (150 words) 3 marks

3. Outline the judgement made in the cae (i.e. whether the defendant 3 marks
was convicted or acquitted, what sentence the defendant received,
whether there was an appeal) 150 words
4. Explain the reasons for the judgment in the case (in the case of a jury 4 marks
trial, make outline the evidence that would have influenced the jury’s
decision). (200 words)

Part 2 In class response (8 Marks)


Your task is to complete ONE short answer response from an unseen question about
young people and the law. To prepare, you will research a contemporary issue
involving young people and the law which includes finding a relevant case, law,
media article and a quote from an expert to support your research.
You may bring your research notes which can include information such as details of
the case, law, media article and quote from an expert up to 200 words. This is to be
hand-written and submitted to your teacher at the conclusion of your in class
response.
