4. PRE-DISBURSEMENT CONDITIONS :
1.Entire loan amount to be transferred to Bajaj Finserv Ltd.
2.Branch to ensure that agreement to sale and purchase is valid and in force, free from all defects
and Registration of property must be done in line with sale agreement value.
3.Borrower to tender post-dated Cheques drawn at monthly intervals/ECS Mandate from the
customer (the Bank where business/salary account is being maintained) to be taken from the
Borrower along with an undertaking that ECS mandate will not be revoked till the currency of the
loan.
4.Branch to ensure that documentation done on the prescribed format with obtaining additional
letter from the borrower as per HO L & R Dept. letter dated 31-12-2021. Empanelled legal counsel
to certify enforceability of security documents (1st Vetting).
5.Branch to get verified the genuineness of approved map/plan from the approved valuer.
6.Branch to ensure Building Construction Plan/Permission should be approved by competent
Local Authorities/Town Planning and Development authorities, ensure its genuineness.

5. DISBURSEMENT:
i) The bank shall make disbursement of the loan amount along with margin money directly by way
of NEFT/RTGS/PO/DD to the seller/builder/Govt agency after execution of prescribed security
documents.

ii) Loan proceeds should not be diverted for any purpose other than that for which it has been
sanctioned. In case the same is not utilised for the purpose it has been sanctioned, the bank
reserves the right to recall the entire loan amount along with interest, recovery charges etc.

6. INSURANCE:
The house is to be comprehensively insured against fire, earthquake, riot etc. with Bank Clause.
Bank�s charge should be marked in the insurance policy and a copy of the same to be
submitted to the Bank on regular basis. In case Insurance Policy is not submitted on demand,
Bank may get the property insure and cost of the same shall be borne by you. Further, you shall
indemnify the Bank for any claim/loss that Bank may suffer due to your failure of keeping the
house insured at all times till full and final adjustment of the loan account.

7. OTHER CHARGES:
All expenses like credit score / credit information check, Actual Legal opinion and Valuation
Charges for property mortgaged/to be mortgaged, Non-encumbrance certificate, insurance
premium, stamp duty, registration charges, taxes, certified copies of title deeds, copies of
mutation, CERSAI Registration and other incidental expenses incurred in connection with the loan
are to be borne by you. Periodic reassessment, if any, of the value of the property funded through
this loan for the purpose of regulatory compliances shall be done at your cost.

8. INSPECTION:
The Bank reserves its rights to inspect the mortgaged property at regular intervals.

9. PENAL CHARGES:
Penal Charge (as tabulated below) will be recovered in case of default subject to maximum of 3%.
Bank may stipulate terms for levying penal charge @ 1%p.a. at monthly rest per default for the
period of default, subject to a cumulative maximum of 3% p.a. at monthly rest, over and above
normal interest rate for the default events.

(QIS)/ MSOD Statements, wherever applicable, within
thestipulated time period without any valid reason
acceptable to the competent authority of the Bank
vi). Non-submission of Balance Sheet & P/L accounts 1%
(audited wherever applicable) within 6 months from the
date ofBalance Sheet without any valid reason
acceptable to the competent authority of the Bank
vii). Non-compliance to any financial covenant, if 1%
specifically mentioned in terms of sanction that such
non-compliancewould attract penal charges

viii). Non-submission of renewal papers beyond the 1%
tenability period
ix). Any other specific reason stipulated in the Terms of 1%
Sanction
Further, for purposes of this clause:
i) Default events, Penal charges payable by the Borrower and the periodicity of rests shall be
subject to changes/variations made by the RBI/Bank from time to time.
ii) The penal charges shall be levied on the default amount (excluding penal chargeslevied
previously) in the account as on the date of default in case of non-payment of repayment
obligations/overdrawing in accounts.
iii) The penal charges to be levied on the balance outstanding (excluding penal charges levied
previously) as on the date of default in all other cases except for Financial default.
iv) Penal charges to be levied only for the default period on pro rata basis.
v) Levying of penal charges shall be without prejudice to any other right available to the Bank.
vi) There shall be no compounding on penal charges.
vii) No penal charges to be levied for loans up to Rs.25,000/-(Rs. Twenty five thousand only).

10. Post Disbursement conditions :


1.Branch to ensure compliance of PSB Home Loan Master Circular No. 100/2022-23 dated
06.05.2022 issued by HO Retail Lending Department.
2.Branch to ensure that MODT to the full extent of loan is to be done with the concern office of Sub
Registrar in Our Bank favour along with obtain NEC for the broken period, if any.
3.Branch to ensure that the Original Sale Deeds been obtained from Bajaj Finserv Ltd and kept on
record , Then Memorandum of Equitable Mortgage of Title Deeds to be executed by borrower in
favour of Bank. Encumbrance certificate after MODT to be obtained and kept on record.
4.The property kept as security should be immediately registered with CERSAI within stipulated
time frame.
5.Supplementary legal to be obtained after execution of sale deed in favour of borrower.
6.The house/ flat shall be insured comprehensively covering fire, flood, riots etc. in the joint name
of the bank and the borrowers. Cost of same shall be borne by the borrower.
7.Branch to ensure that certificate of genuineness be obtained from the panel advocate after the
property registration.
8.Branch to comply on Vetting, inspection, scrutiny of original title deed and comparison of Original
title deed with certified copy, joint index inspection with Bank Panel advocate in terms of HO Law
& Recovery Cir.No.848/2021-22 dated 19-08-2021.
9.Branch to ascertain that the proof mentioned in asset and liability is to be obtained and kept on
record.
10.Branch to obtain computerized patta and the same to be kept on record.
Branch to ensure compliance of various relevant guidelines issued by the Bank from time to time,
more specifically given as under:-
1.PSB Apna Ghar Master Circular issued by Retail Lending Department.
2.Property to be properly mortgaged in favour of the bank.
3.CERSAI Registration of property to be done within stipulated time according to instructions
issued vide Law and Recovery Department Circular No.206 dated 21.04.2011 and Credit
Monitoring Department Circulatory Letter No.26 dated 01.09.2011.
4.Branch to ensure that intimation of mortgage and bank finance of Housing Loan immediately to
the concerned Govt Deptt/Authorities (in case of flats allotted by DDA/HUDA etc) and its
receipt/acknowledgement must be kept on record.

11. OTHER TERMS & CONDITIONS:

Other Terms & Conditions
1.Legal compliance certificate or certificate of indispensable requirements and other terms &
conditions of the sanction to be kept on record as per circ. Letter no.15/2003 dated 24.03.2003.
2.Branch to ensure end use of funds as per norms/banks guidelines.
3.While conveying the sanction to the borrower, the branch to comply with the extended guidelines
on \'Fair practices Code\' issued by HO from time to time. Terms and conditions to be got accepted
from borrower (s) in terms of guidelines conveyed on fair practice code for lenders.
4.TDS norms to be complied in respect of sale consideration of the property.
5.Property Tax should be paid by the borrower from time to time & copies of proof be furnished to
the bank regularly.
6.Loan to be reviewed every 12 months.
7.The sanction is valid for a period of three months from the date of sanction.
8.The bank has a right to withdraw or modify all/any of the terms and conditions or stipulate fresh
conditions.
9.Certified copy of sale deed be obtained & got compared with originals. Certificate of
genuineness of title deed be obtained from legal counsel.
10.Comply with guidelines of HO Law Cir 183 dt 12.05.06 & HO Law Cir 196 dated 03.10.09 and
HO Law cir 212 dated 28.12.2011 for all the properties offered as primary / collateral security.
11.Branch to ensure that comprehensive insurance for the property mortgaged (superstructure) to
be invariably kept on record.
12.Penal Interest of 1% to be charged over and above applicable rate of interest in case of default
in repayment/non-compliance of stipulated covenants.
13.As per HO RL Cir No. 109/2023-24 Dt. 8th May 2023, customer is eligible for Pre-approved
PSB CREDIT PROTECT. Branch to explore the possibility for providing benefit to the customer.

UNDERTAKINGS
The following undertakings to be obtained from the borrower:
1.Suitable undertaking should be obtained from the borrower/guarantor that no suit has been filed
by any bank/financial institution against them or any of the firm/companies in which they are
partners directors/guarantors & No account has been declared as NPA. It is to be further ensured
that none of the above persons are in any of the caution/defaulter list.
2.Not to create any further charge, lien or encumbrance over the assets and the properties to be
charged to the bank in favor of any other bank/financial institute/ company, firm or person.
3.That the Bank or its authorized officials or other representatives will have the rights to carry out
periodical inspections of the property.
4.Any change in rate of interest and service charges etc. in future will be noticed from the Bank\'s
Notice Board and /or through press release to some national dailies and Bank is not required to
give separate information in this regard.
5.Not to divert funds for any other purpose, other than the purpose for which the loan/limit is
granted.
6. That the directors/ borrower/ partner(s)/ Guarantor(s) are not related to any of the direct
(Applicable for Term Loan only)

In the wake of Rising Interest rates, the borrower should be given the choice to opt for:
1. Enhancement in EMI or elongation of tenor or for a combination of both options.
2. To prepay, either in part or in full, at any point during the tenor of the loan.
Switching Of EMI From Floating Rate To Fixed Rate Of Interest

1. The borrowers shall be entitled to 2 switches during the tenor of loan from floating to fixed rate
or vice versa.
2. Only standard accounts will be eligible for switchover.
3. Applicable interest rate for Fixed Rate shall consist of following components: Fixed Rate = 0.75
% over and above the effective EBLR rate at the time of reset of interest rates

4. Charges applicable to switch from Floating to Fixed rate or vice versa shall be Rs. 2,500/- for
Term Loan outstanding up to Rs. 25 lakhs and Rs. 5,000/- for Term Loan outstanding above Rs.
25 lakhs at the time of switchover.

Release of Movable / Immovable Property Documents :-

i) The Branch shall release all the original movable / immovable property documents and remove
charges registered with any registry within a period of 30 days after full repayment/ settlement of
the loan account.
ii) The borrower shall be given the option of collecting the original movable / immovable property
documents either from the branch where the loan account was serviced or any other office of the
Bank where the documents are available as per Customer preference.

A copy of this sanction letter duly signed by you and guarantor(s) should be returned to the bank
as acceptance of the terms and conditions given above.
