INSTRUCTION TO TENDERERS

1. GENERAL

1.1 These instructions to tenderers, in so far as they may affect the execution of the
Contract, shall be deemed to form part of the Contract.

2. DOCUMENTATION FEE

2.1 The tender document shall be issued only on payment of the documentation fees
as stated in the invitation to tender. This payment shall be made in the form of/by
debit/credit card or online transfer to UKM REAL ESTATE SDN. BHD.
CIMB UKM Real Estate Sdn. Bhd. (86-0046265-2). Document fee are not
returnable.

3. SITE VISIT

3.1 The Contractor are advised to VISIT the site while preparing the tender to ascertain
for himself the extent of the work involved and the nature of the working conditions
and make himself thoroughly acquainted with any site restrictions.

3.2 No extra payment, extension of time, right to damages or any other concession
consequent upon misinterpretation or lack of knowledge will be considered.

4. FORM OF TENDER

4.1 The tenderers are required to complete the works within fixed period ( )
days of calendar year.

4.2 The successful tenderer is advised to make advance orders of construction

materials as soon as the tender awarded to avoid delay in material supplied.

5. PRICING OF SUMMARY OF TENDER AND BILLS OF QUANTITIES

5.1 The Bill of Quantities shall be priced in INK and the sums of the amounts of all
items in the Bill of Quantities priced by the tenderers shall truly represent the
amount shown in his tender.

5.2 The costs set down by the tenderers against each item in the Bill of Quantities
unless expressly provided to the contrary, shall be held to include for providing and
delivering all materials, unloading, cutting and waste on materials, storage,
packing, carriage and cartage, hoisting, all labour for setting, fitting and fixing in

 position, use of plant, making supervision, establishment charges profit and all
other labour and everything else necessary for the due and proper completion of
each items.

5.3 Where the tenderers leave any item blank in Preliminaries or insert only a dash
against any items in the Bill of Quantities, the value thereof shall be deemed to be
included in the prices or rates of the other items therein.

5.4 No alteration, amendments or qualifications shall be made to the Tender

Documents without the written consent or instruction of the consulting Contract
Administrator unless expressly provided the contrary. If any such alterations,
amendments or qualifications are found, the tender will be disqualified.

6. INTERPRETATION OF TENDER DOCUMENTS

6.1 If any tenderers are in doubt as to the true meaning of any part of the Tender
Document, he should at once notify to the Contract Administrator in writing and
request clarification before submitting his tender. Such clarification will be valid
only if made by Contract Administrator by means of formal addendum as describe
in Item 7.

7. ADDENDUM

7.1 Prior to the date for submission of tender, the Contract Administrator may issue
addendum to clarify or modify the Tender Documents in part or in total. Every
addendum issued will be distributed to each tenderers and shall become part of
the Tender Documents. Receipt of each addendum must be acknowledged on the
form issued with the addendum. Failure to acknowledge any addendum will render
the tender being rejected.

8. ORAL INTERPRETATION

8.1 Oral interpretation of any of the Tender Documents requested and received by any
tenderers shall not be considered to modify any of the provisions of the Tender
Documents. Any clarification or modification to any of the Tender Documents shall
be made in writing by the Contract Administrator in the form of addendum as
specified in Item 7.

9. STANDARDS

9.1 All workmanship, materials and components throughout the works shall comply
with the Malaysian Standard of Code of Practice, or other standards of code as
stipulated in the Specifications.

10. TENDER

10.1 The tenderer is required to complete the following which constitute his tender:

a. The Form of Tender including appendices thereto.

b. The Summary of Tender and Bill of Quantities with every items legibly
priced in INK and with the amounts added up to form a Tender Sum.

10.2 The tender documents shall comprise of the following document, namely:
a. Instruction to Tenderers
b. Form of Tender
c. Quotation and Bill of Quantities
d. Drawings

10.3 Where documents to be signed by the tenderers extend for more than one page,
each page of the individual forms shall be initialled by tenderers.

11. SUBMISSION OF TENDER

11.1 The Tender Documents shall be duly completed, enclosed, sealed in envelope
bearing no identification of the tenderers at the outside. The sealed envelope
shall be marked on the top left hand corner with the caption:

and delivered by hand or sent prepaid registered post to reach the tender box of

 Not later than 12:00PM ON 25 MARCH 2024 (MONDAY). Any tender delivered after
the stipulated date and for whatever cause or reason arising shall be disqualified.
Notwithstanding the above, UKM Real Estate Sdn. Bhd. shall in no way be held liable for
any loss or later tender submitted. Proof of position shall not be accepted as evidence for
submission of the Tender.

12. COST OF TENDERING

13.1 UKM Real Estate Sdn. Bhd. is not responsible for or to pay any cost or expense
or loss which may be incurred by the tenderers in the preparation or submission of
his Tender

13. BRIBERY

13.1 The offer of a bribe or other inducement to any person with the view of influencing
the placing of the Contract will result in the instant rejection of the Tender.

14. ACCEPTANCE OF REJECTION OF TENDER

14.1 UKM Real Estate Sdn. Bhd. Reserves the right to reject any or all tenders. Without
limiting the Generally to the foregoing statement, any tender which is incomplete,
obscure or irregular shall be rejected.

14.2 UKM Real Estate Sdn. Bhd. Is not bound to accept the lowest or any tender, nor
to assign any reason for the rejection of any tender.

14.3 The Contractor whose tender is accepted will be required to agree and accept, in
the form of Letter of Award (LOA)

15. STATUTORY REGULATIONS

15.1 This tender shall be subjected to and deemed to be prepared in contingence of the
various regulations and all revisions thereof.

15.2 All consideration which the tenderers provides under this contract shall inclusive
Sales and Services Tax charges where required.

16. MISCELLANEOUS

16.1 Every notice to be given to tenderers may be posted to the tenderer’s address
given in the tender and such posting shall deem good service od such notice.

16.2 The word “approved tenderer” shall mean that the tenderers shall be approved by
the authorized Officer receiving the tenders and shall have complied with these
Conditions of Tendering in every aspect.

16.3 The word “tenderer” in these Condition shall be deemed in include two or more
persons. The word “his” may also mean “her” or there, and the word “he” may also
mean “she” or “they”.

16.4 Non-compliance with the above Conditions in any respect shall render the tender
being rejected.

1. Under and subject to Conditions of Tendering annexed hereto, the undersigned does
hereby offer to execute and perform the Works and provisions and supply all labour and
materials, interest of credits, etc. and everything of every kind of respectively named,
shown, described and alluded to in, or to be inferred from the Form of Contract, Conditions
of Contract, Specifications, Bill of Quantities and Drawings, to be executed and supplied
on the part of the Contractor for the Works above described in conformity with said
Specifications, Bill of Quantities and Drawings and under and subject to the said
Conditions of Contract for the lump sums herein below.

2. The undersigned agrees to be bound by and submit to the said Conditions of Contract,
Specification, Drawings and priced Summary of Tender agrees that the said priced Bill of
Quantities after rectification of any errors therein in the undersigned’s prices and
calculations, shall form a basis for the valuation of interim certificates and any variation of
extra works which may from time to time be ordered by the Contract Administrator.

date of possession of site or within such extended time as by the Conditions of Contract

work which the undersigned in the ordinary course of business directly carries out and for
which Prime Cost or Provisional Sums have been included in this Tender.

5. Whereas it is understood that you reserve to yourself the right to accept or to refuse this
tender whether it be lower or higher than any other, or of the same amount, the
undersigned agrees that this tender shall remain valid and shall not be withdrawn within
the tender validity period from the final date for submission of tenders.

6. And further, the undersigned agrees, in the event of your acceptance of this tender, to
execute the formal Contract Agreement and to deposit the Performance Bond and the
Contractor’s All Risk Policy and produce the receipt paid, for inspection, within ten (10)
days from posting or delivery if by hand, of notification of acceptance.

7. The undersigned confirms, after personal scrutiny, that the documents and drawings used
by the undersigned in compiling this tender are true copies of the documents and drawings
included in the Tender Table Documents.

8. The undersigned agrees that until a formal agreement is prepared and executed this
tender together with your written acceptance shall constitute a legal and binding contract
between us.
