Subject Display of QR Code by registeled real estate agents in promotions /


advertisement matedal relating to real egtate piojects registered with
MahaRERA.

Whereas, Govemment of India has enacted the Real Estate (Regulation and
Development) Act, 2016 (the Act) and a[ sections of the Act have come into force with effect
ftom 01.05.2017.

And whereas, the Govemment of Maharashba vide Noti-fication No. 23 dated


08.03.2017, has established the Maharashtra Real Estate Regulatory Authodty, hereinafter
referred to as "MahaRERA" or as "the Autho ty".

And whereas, the Authority has notified the Maharashtra Real Estate Regulatory
Authority (General) Regulations, 2017 (Regxlations) to carry out the pulposes of the Act.

And whereas, the Authority under Section 37 of the Act, and Regulation 38 of the
Regulations is vestecl with the powels to issue directions to promoters, real estate agents and
allottees from time to time as it mav consider necessary.

And whereas, Chairperson, MahaRERA, is vested with the powers of general


superintendence and directions in the conduct of the affairs oI MahaRERA under Section 25
of the Act.

And whereas, S€ction 10 (a) oJ the Act, mandates a registered real estate agent not to
facilitate the sale or purchase oI ;my plot, apartment or building, as the case may be, in a real
estate project or part oI it, being sold by promoter in any planning area, which is not registered
\a,ith the Authoritv.

Aid $,hereas, Rule 1'l of the Rules, mandates every registered real estate agent to
quote the registration number in all the do.uments relating to advertisement, marketing,
selling or pu(hase issued by the real estate agent along with the number of registration
certiJicate of the real estate project.

Alrd whereas, MahaRERA has intoduced Quick Response Code (QR Code) for each
registered real estate project to assist home buyers / allottees to get real estate project
inlormation.

And whereas, by MahaRERA Order No. 46 /?023 dated,29.05.2023 all concemed were
inJormed about the inhoduction of QR Code for each and every registered real estate project
and by the said MahaRERA Order directions were issued mandating promoters on and alter
01.08.2023 to prominendy display the QR Code on each and every registered real estate project
promotions / advertisements in the mamet, at the pla.e and the mediums as more specifically
enumerated in the said Order.

And whereas, MahaRERA, by Order No.46A/2023 dated, .07.2023 has prescribed


the penalty that would be imposed upon promoters for non-display of the QR Code on real
estate project promotions / advertisements-

And whereas, MahaRERA, having introduced QR Code for each and every registered
real estate project, the diiections issued by the Authodty in MaiaRERA Order Nos. 46/2023
and 46A/2023 d,ate'J 29.05.202i a ) 25.07.2023 respectively shall mutatis mutandis apply to
all rcgistered real estate agents and in view thereof with effect from the date of coming into
force of this Order, the following directions shall be followed by every registered real estate
agents.

a) Real estate agents shall prominently display QR Code on each and every real estate
project promotion /
advetisement published in the mediums as more specifically
listed in NIahaRERA Order No. 461 2023 dated 29.05.2023.

b) The QR Code published shall be legibte, readable, and detectable with software
application alld shall be published besides NIahaRERA project registration
number.

c) Failure to comply y/ith (a) and (b) above shall be construed as violation of the
directions issued by the Authoity.md penalt), which ma), extend upto Rs.
50,000/- subject hlrwever to a minimum penalty which shall not be less than Rs.
10,000/- under Section 65 of the Act shall bc imposed upon rcal cstate agcnts Ior
each such violations.

d) Upon imposition of the penalty if the real cstate agent fails / neglects to rectily and
remedy the violation / contravention within 10 days shall be construed as a
continuous violation oI the directions issued by the Authodty and appropriatc
action as deemed fit shall be tal<en against such real estate agents under the
relevant provisions of the Act.

This Order shall comc into force with immcdiatc cffect.
