Subject: Complaint against Advocate Mrigesh Kumar Shastri son of Late A.N.

Shastri, Resident of Flat No. 532, Hadimba Block, Trishla Plus Homes,

Peer Muchalla, Zirakpur, Tehsil Dera Bassi, District Mohali, (Punjab)

Practicing Advocate, at District Court Chandigarh at Chandigarh; for

professional misconduct by misusing his professional skills.

R/Sir,

1. That it is most respectfully submitted that complainant Neeraj Giri is

Resident of Flat No. 569, Trishla Plus Homes, Peermushlla, Zirakpur, Mohali

(Punjab). Whereas, Mr. Mrigesh Kumar Shastri is also resident of the same

vicinity, who is an Advocate by profession, but Mr. Mrigesh Kumar Shastri usually

kept indulging in misusing his professional skill, by filing false and fake

complaints and litigation against the inhabitants of the society.

2. That it is necessary to submit here that Sh. Mrigesh Kumar Shashtri used to

pressurize the residents of society to act in society as per his voice otherwise he

will implicate & file a case for which they have to appear in different Courts of

Tricity & they will be harassed. Every time he used to say that he is an advocate

and if anyone raise his/her voice against the illegal/wrong doings than be ready

to face the Court proceedings as being an Advocate he need not to pay anything

whereas other residents would have to bear expenses of litigation & he/she will

be harassed in Court proceedings. Further, Sh. Mrigesh Kumar Shashtri is

misusing his profession by filling false & frivolous cases against residents & he
 has created fear in minds of residents & everyone is feeling harassed by his

conduct.

3. That by misusing his position as an Advocate & noble legal profession, he has

filed almost 15 different cases in different Courts of Tricity against the residents

of the Trishla Homes including complainant without any basis. The list of cases

filed in different Hon’ble Courts against residents including complainant are as

below:-

i) CS 630 of 2021 titled as Mrigesh Kumar Shashtri Vs Mahesh Sharma

ii) CS 631 of 2021 titled as Mrigesh Kumar Shashtri Vs Kawaljeet Singh

iii) Cs 628 of 2021 titled as Mrigesh Kumar Shashtri Vs Gaurav Sharma

iv) Cs 629 of 2021 titled as Mrigesh Kumar Shashtri Vs Rajesh Kumar Khatri

v) CS 621 of 2021 titled as Mrigesh Kumar Shashtri Vs Manoj Sharma

vi) CS 620 of 2021 titled as Mrigesh Kumar Shashtri Vs Manjit Singh Bedi

Besides these cases, Sh. Mrigesh Kumar Shashtri has also moved false & frivolous

complaints in which complainant and other persons were called and same were found

false. Further, after day or two one or other resident of society is getting legal notices

sent by Sh. Mrigesh Kumar Shashtri on one account or the other.

4. That earlier Mr. Mrigesh Kumar Shastri, was elected as President on 21/03/2021

of Trishla Residents Welfare Association, Trishla plus Homes, Society Office

Peer Muchalla, Post Office Dhakoli, District S.A.S. Nagar (Punjab) and there was

allegations against him regarding embezzlement of society funds. The

 complainant raised voice about the illegalities & embezzlement of funds by Sh.

Mrigesh Kumar Shashtri than complainant was threatened by him & even stated

that he has given contract to kill the complainant and at that time complaint was

also filed in Dhakoli Police Station. Copy of complaint is annexed as C-1.

5. That thereafter, elected body of Trishla Homes was unable to work properly for

the welfare of the association, as expected from them. Then, the matter was

amicably settled between the members of Committee that they all including Mr.

Mrigesh Kumar Shatri, Mr. Neeraj Giri i.e. complainant and Mr. Naveen Bansal

will resign. Thus, on 30/05/2021, Mr. Mrigesh Kumar Shashtri, Mr. Neeraj Giri i.e

complainant and Mr. Naveen Bansal had put their respective resignations

voluntarily. Hence, Mr. Mrigesh Kumar Shastri remained no more President of

the Trishla Residents Welfare Association.

6. That thereafter, Mr. Mrigesh Kumar Shastri, has fraudulently and dishonestly

procure a seal of Association and started using the same as President of the

Association in different manner, and by doing so Mr. Mrigesh Kumar Shastri

caused loss to the Association and the matter has already been got recorded to

the Police of Police Station Dhakoli, Zirakpur, Punjab by the Association. Copy of

complaint is annexed as C-2. The said Mrigesh Kumar Shashtri also by

impersonating himself as President of Society sent letters to banks where the

society was having accounts with intention to stop the day to day activities of

society and in this regard also complaint was also lodged to Police Station

Dhakoli, Zirakpur.

7. That now in order to get revenge from the members of Association, Mr. Mrigesh

Kumar Shastri, being Advocate, started filing false litigations against the

members of Association & other residents of society who are not supporting him

in different Courts of Tricity. Thus, as Mrigesh Kumar Shastri is misusing his

position of Advocate by doing malpractice & professional misconduct while being

an Advocate. As detailed above, Mrigesh Kumar Shastri even after adopting

 such a very noble profession of Advocacy is directly involved in illegal activities,

which amounts to professional misconduct on his part. The conduct of Advocate

Mrigesh Kumar Shastri is just dishonouring the noble profession of advocacy and

thus, by doing so, Advocate Mrigesh Kumar Shastri rendered himself to take

strict Action against him.

8. That the said Mrigesh Kumar Shashtri used to abuse the residents and also

causing harassment to Trishla Plus Homes staff and disturbance in routine work

of society office while in Advocate Uniform. Besides this, he also threatened the

office staff and residents that he being an Advocate, thus, nobody can stop him

and everyone has to dance at his tune and if anyone dare to raise his/her voice

against him than he will make his life hell.

9. That there have been numerous instances of abject misbehaviour by the

Advocate Mrigesh Kumar Shashtri with residents of society especially senior

citizens and complaint was also filed against Advocate Mrigesh Kumar Shastri by

senior citizens also. Further, complaint was also filed by residents of society

before Police at Zirakpur, Mohali against Mrigesh Kumar Shasthri regarding

misbehaviour, threatening and assaulting and it was signed by respectable of the

society but no action was taken on the same. Copy of complaint is annexed

herewith as Annexure C-3.

10. That thereafter, on dated 26.03.2022 Mrigesh Shastri gave merciless beatings to

complainant and in this regard FIR No.32 dated 26.03.2022, P.S was also got

registered against him. Despite that he is still threatening the complainant and

other residents. Thereafter, said Mrigesh Shahstri abused society staff with

castiest remarks and also threatened for dire consequences and complaint was

also lodged. Copy of FIR is Annexed herewith as Annexure C-4.

11. That under garb of his profession he is threatening to implicate residents of

society in false complaints as well as instituting cases thereby misusing his

profession which is against the legal profession ethics and causing disrespect to
 the legal profession. The said Mrigesh Shastri is continuously harassing the

residents of society and threatening to involve them in false cases.

It is therefore, you are respectfully prayed that, please look into the matter

and take proper action against Advocate Mrigesh Kumar Shastri.

Affidavit of Neeraj Giri S/O Sh. Gaya Parshad Giri, Resident of Flat No. 569, Trishla

Plus Homes, Peermushlla, Zirakpur, Mohali (Punjab)

I, the above named deponent do hereby solemnly affirm and declare as

under:-

1. That the deponent is Resident of aforementioned address and Mr.

Mrigesh Kumar Shastri is also resident of the same vicinity, who is an

Advocate by profession, but Mr. Mrigesh Kumar Shastri usually kept

indulging in misusing his professional skill, by filing false and fake

complaints and litigation against the inhabitants of the society.

Kumar Shastri is misusing his position of Advocate by doing

10. That thereafter, on dated
