PROPERTY LAW EXAMINATION

SAMPLE INSTRUCTIONS

A. Exam. This is an eight-hour, open-book, take-home exam consisting of __ numbered pages,


including this instruction page. You may take it in the exam room or anywhere off-campus that
you choose, but before you leave the exam room, check to make sure that you have a complete
exam. Please consult the Dean of Students immediately if you become ill during the exam.

B. Pick-up and Return. Please be in Room ___ by 8:50 a.m. to begin the exam at exactly 9:00
a.m. (you may remain there if you choose). Please return your completed answer to the same
room before the time limit, 8 hours after it formally begins. At that time, you must also return all
pages of the exam (including this one!) with your answer. You may not maintain a copy. You
must also upload a digital copy of your answer, in MS Word, to the designated exam website.

C. Rules & Honor Statement. This exam must be the product of your own work, and yours
alone. You may not discuss the exam or collaborate with others. The exam is “open-book,” but
I discourage the use of commercial or Internet resources—mostly because they are usually more
distracting than helpful to those who turn to them. You will have full access to your computer
and the Internet, but you may not use generative AI tools (per the course AI policy), and we will
use all appropriate means to detect and deter illicit uses. Signing below with your exam number
(not name!) signifies your promise to abide by these rules, as enforceable under the Honor Code.

D. Identification. Write your BAGS No. here __________________ and be sure that it appears
in the header on each page of your response. Do not write your name on any part of the exam.

E. Format. Your answer must be typed, double-spaced, page-numbered, with one-inch margins
on all sides, using the 12-pt. Times New Roman font that you see here. Please print your answer
on single-sided pages and staple them before you arrive to return it. Your answer may not exceed
9 double-spaced pages. Longer responses will be down-graded in proportion to the overage.

F. Questions. If you believe a question is unclear, explain how you are interpreting the question
and then answer it accordingly. If you believe it is necessary to make an assumption before
answering a question, clearly state that assumption and proceed accordingly. (However, be
careful not to “assume away” the entire question: if a salient unknown might direct your analysis
in one of two directions, consider both possibilities.) If you believe a question does not have one
clear answer, review the possibilities and identify any missing information that might enable a
decision-maker to choose between them. Do your best to reach a defensible conclusion.

G. Responses. Read through the entire exam before you begin, and save time for editing. Write
clearly; concise, well-organized answers will receive more credit than rambling ones. Support
your argument with references to assigned readings (partial name citations will suffice if clear;
textbook page numbers will not receive credit). Assume the common law rules we have studied,
and do not refer to rules or cases beyond those covered in the course. Focus on issues we have
studied in class. Show me that you not only recognize an implicated legal rule but can apply it to
the facts. Be sure to address all issues fairly raised by each problem, even if you believe one is
dispositive. Note that questions are (approximately) weighted as listed for scoring purposes.
