PREAMBLE
WE, THE STUDENTS OF THE FACULTY OF PHARMACY, Obafemi Awolowo College of Health
Sciences, Olabisi Onabanjo University in order to form a more perfect union establish justice, ensure
domestic tranquility, provide for religious tolerance, maintain a healthy community, promote
intellectual and sporting activities, socio-cultural excellence and secure the blessings of liberty to
ourselves and our posterity. Also, to be able to play a worthy part in national and international
community of other external student organization whose aims and objectives are acceptable to this
Association.
Who do hereby,
„Unanimously enact, adopt and give to ourselves this constitution.”
SECTION 1
GENERALPROVISION
SUB-SECTION 1
SUPREMACYOF CONSTITUTION
(i) This constitution is supreme and its provision shall be binding on all bonafide students of the
Faculty of Pharmacy, Obafemi Awolowo College of Health Sciences (OACHS), Olabisi
Onabanjo University.
(ii) If any other law(s) other than the National Constitution of PANS is inconsistent with any
provision of this constitution, this constitution shall prevail and that other law(s) shall in the
extent of the inconsistency be void on matters affecting Pharmaceutical Association of
Nigerian Students (PANS), Olabisi Onabanjo University and her members.
SUB-SECTION 2
NAME, MOTTO AND LOGO
(i) This organization shall be known and addressed as Pharmaceutical Association of Nigeria
Students, Obafemi Awolowo College of Health Sciences (OACHS), Olabisi Onabanjo
University Chapter, therein referred to as “The Association‟
(ii) The name Pharmaceutical Association of Nigerian Students, OLABISI ONABANJO
UNIVERSITY Chapter shall where the context admits be represented by this shortened form
PANS, OOUCHAPTER.
(iii) The motto of the organization shall be “Dedication and Honesty.”
SUB-SECTION 3
AIMS AND OBJECTIVES:
These shall be
1. Compulsory Membership
All students of the Faculty of Pharmacy OACHS, Olabisi Onabanjo University, Ago-Iwoye
shall be compulsory members of the association.
2. Honorary Membership
i) With the exception of undergraduates, a non-Pharmacy student of proven integrity
who has contributed either morally and/or financially to the survival of the
Association shall be recommended by the Executive Council and approved by 2/3
majority of the Pharmacy Students House Of Senate (PSHS). Such members shall be
the honorary Members of the Association, OOU CHAPTER and would be herein
shortened as H.M. PANS, OOU CHAPTER.
ii) Each honorary member shall be notified in writing prior to a formal award.
iii) Honourary membership can be withdrawn if such a member has been wanting in any
of his /her role and such withdrawal shall be subject to ratification by 2/3 majority of
the PSHS.
SUB-SECTION 5
PATRONS/MATRONS
There shall be Patrons/matrons appointed by the executive council of the Association subject to
approval by 2/3 majority of the PSHS.
1. Composition;
i) One Grand Patron who shall be a pharmacist of proven Integrity and shall be assisted by ii)
The dean of the faculty of pharmacy iii) Other patron(s) and matron(s).
2. TENURE OF OFFICE
1(a). The Grand Patron shall be in office for a period of at least two (2) academic sessions, which
may be renewable by simple 2/3 majority of the PSHS.
(b) At the expiration of the tenure of the Grand patron, he or she may be conferred with the Life
Patron of the Association if he or she has been adjudged to have performed incredibly well by
the incumbent Executive Council subjected to ratification by simple 2/3 majority of the PSHS.
(ii) The dean shall be by virtue of his/her office remains patron/matron as long as he stays in
office.
(iii) The Patron(s) Matron (s) shall be in office for a period of at two (2) academic sessions which
may be renewable by 2/3 majority of the PSHS.
SUB-SECTION 6
ADVISERS
i. There shall be four advisers from the academic staff of the faculty for the Association as may be
recommended by the Executive Council and approved by 2/3 majority of the PSHS.
ii. Shall serve in the advisor capacity for a period of two (2) academic sessions which will be stated in the
appointment letter, a tenure which is renewable by Executives and ratified by 2/3 majority of the PSHS.
SUB-SECTION 7
OBLIGATION OF MEMBERS
SECTION 2
MEETINGS
SUB-SECTION-1: ESTABLISHMENT
There shall be five different meetings namely:
i. General meeting (Congress)
ii. Executive meeting
iii. The Pharmacy Students House of Senate (PSHS).
iv. The Board(s) / committee(s) meeting including the PANS week committee meeting.
v. The Emergency Meeting.
vi. The standing order provisions shall be enforced at such meetings and fines realized from it shall
be paid into the Association’s account through the constitutional provisions as regards fines.
SUB-SECTION 2:
SUB-SECTION 3
EMERGENCY MEETINGS (EMMERGENCY CONGRESS)
i. The essence of this meeting/congress is to discuss matters that are too urgent to be delayed for
the next meeting.
ii. Minutes of the emergency meeting/congress will be read to the Association at the next general
meeting/congress.
iii. Notice and agenda of such meetings/congress shall be sent of displayed on all information
dissemination platforms of the association at least 24 hours before the day of the meeting.
iv. The Executive council shall summon an emergency meeting/congress whenever the needs arises.
v. The PSHS shall summon an emergency meeting/congress either in favor or against the will of the
Executive in any event of apathy, complacency or otherwise on the part of the Executive,
provided it is ratified by 2/3 majority of the entire member of the PSHS.
vi. In the case of (v) above, the presiding officer shall be the Senate President of the PSHS while
other executive functions as usual.
SUB-SECTION 4
THE EXECUTIVE MEETING
i. The meeting of the Executive Council shall be called when the need arises by President through
the General Secretary.
ii. At least 48 hours notice shall be given except in cases of emergency meetings.
iii. 2/3 majority members shall constitute a quorum
iv. The President shall have a casting vote only when there is a tie in the decision of the executive.
v. Decisions(s) shall be reached by simple majority vote in the Executive council.
vi. The President shall preside over the meetings.
vii. It shall be compulsory for all executive members to attend promptly.
viii. Any elected officer absent from the executive meeting without prior written notification to the
General Secretary shall pay a fine of N500 on or before the next executive meeting.
ix. If he / she fail to pay the stated fine, he/she shall be referred to the disciplinary committee
x. Elected officer absent from meetings for three times without prior written notification to the
president through the General Secretary shall face the Disciplinary committee
xi. The fine from the executive arm is paid to the Financial Secretary.
SUB-SECTION 5
THE PHARMACY STUDENT HOUSE OF SENATE (PSHS) SITTINGS
i. Shall meet at least twice in a semester when the arises
ii. The Senate president acting through the clerk shall summon such sittings.
iii. At least 48 hours notice shall be given before such sittings, except in emergency sittings where a
notice of at least 24 hours is required.
iv. Notice should be displayed on all information dissemination platform of the association as well
as served to each Senator.
v. 2/3 majority members inclusive of the Senate president, the deputy, or either, shall constitute a
quorum.
vi. The Senate president shall have a casting vote only when there is a tie in the decision for the
PSHS.
vii. Decision(s) shall be reached by simple majority vote in the PSHS.
viii. The Senate President shall preside over the sittings.
ix. In case of the absence of the Senate President, the Deputy Senate President shall preside and shall
appoint a senator in the current sitting to deputize
x. It shall be compulsory for all Senators to attend promptly to all sittings.
xi. Any Senator absent from the PSHS sittings without prior writing to either the Senate President
through the Clerk shall pay a fine of 500 naira to the assistant clerk which shall be retained by the
PSHS.
xii. Any Senator who leaves the meeting without approval from the Senate President through the
Chief whip during sittings shall pay a fine of 500 naira at most 2 weeks after the sitting (to the
assistant clerk) which shall be retained by the PSHS
xiii. A member of the PSHS shall be deemed to forfeit his seat in the house if he absents himself from
three consecutive meetings of the house without justifiable excuse or written permission from the
Senate President.
SUB-SECTION 6
BOARD/COMMITTEE MEETING
Shall be called by the Chairman through the secretary of the committee and notice shall be
given at least 48 hours before the meeting except in case of emergency meetings called when
the need arise by the chairman.
SECTION 3
STANDING ORDER
SUB-SECTION 1: LANGUAGE
i. There shall be one official language of the Association and shall be English
SUB-SECTION 2: CODE OF CONDUCT
ARTICLE 1: MODE OF ADDRESS
i. After the recognition by the President or whoever is acting in that capacity, every speaker shall
stand when speaking or addressing the congress/senate except the presiding officer who may sit
down for same.
ii. The speaker shall begin his/her address by saying “Mr. President, the House followed by his/her
name and the arm of the faculty he/she belongs”.
iii. In a case where a speaker is further addressing the house, he/she can continue by saying “standing on the
existing protocol” or “standing on the existing order” or “all protocols duly observed”
iv. If the president or the presiding officer has occasion to rise to assert his authority, any member of the
congress standing shall immediately resume his seat and the House shall remain.
ARTICLE 2: MOTION
i. All motion(s) including counter motion(s) shall be spoken or presented in writing and passed
to the presiding officer through the chief whip, who will read it out immediately before the
house.
ii. All motion(s) without a counter motion (objection) must be seconded by show of hand.
iii. All motion(s) shall not be allowed to lie after it had been seconded by a PANSITE recognized
by the presiding officer.
iv. When there is a counter motion, decisions on such issues shall be by simple majority through
the act of voting. A motion and its counter motion where applicable shall be treated
conclusively before any other motion shall be received from the floor of the house.
v. The mover of the motion or counter motion shall educate the house briefly and precisely on
the reasons behind the motion or counter motion or make amendments before the act of voting
so as to eliminate voting in ignorance.
vi. In addition to discussions on the motion or amendment, the presiding officer shall allow the
following points in the order as they appear to matter.
(a) Constitutional Matter
(b) Point of order
(c) Point of observation
(d) Point of information
(e) Point of correction
Apart from such issues as the constitutional matter and the points of order which carries
automatic recognition on pronouncement, any member must be duly recognized by the
presiding officer of the meeting before addressing the house.
Constitutional matters and point or order shall be made when a member’s speech is
inconsistent with a portion of the constitution respectively.
A member on his/her feet can only be interrupted by constitutional matter or point of order.
He/she remain on his/ her feet while this is being done and may resume thereafter if necessary.
vii. Voting at such meetings shall be done without prejudice to SECTION 4, SUB-SECTION 1.
ARTICLE 3: QUORUM
i. At least 40 members of the association shall constitute quorum for a general congress or an
emergency congress.
ii. In a general meeting where the quorum is not formed thirty minutes after the official time, the
presiding officer shall reserve the right to pronounce the commencement of the meeting if
convinced that the number present is reasonable, which must include all executives and members
of the PSHS, or otherwise postpone the meeting.
iii. In other meetings, the quorum shall be 2/3 majority composition.
(a) Tucked in shirt on trousers with a tie, and shoe (no dancing and/or sport shoes)
(b) Traditional attire with or without a cap.
ii) Wearing of the following dress/items: Tee shirts, face caps, dancing or sport shoes, sports jersey,
baseball or basketball shirts are hereby prohibited. Any breach of the above shall be an offence and shall be
treated as such.
2. FEMALE
i It shall be compulsory for all registered female members of the association to be formally dressed at
ALL times in the faculty
i. The executive council shall ensure that all members of staff and students within the faculty are informed
of the dressing code and enforce the dressing code stated above.
ii. The PANS chief whip shall be responsible for ensuring that members of the association are properly
dressed before being allowed to speak at the congress.
ARTICLE 6: OTHERS
i. No foul language(s) shall be used on any members of the association nor heard on the floor of the house
and where such foul languages (for example abusive, insulting e.t.c) are being inadvertently used, it
shall be withdrawn immediately with underserved apology to the affected persons.
ii. Smoking or being under the influence of alcohol /drugs at meetings or any function of the association is
gross indiscipline shall be treated as such.
iii. Every member must attend, sign the attendance register, and exercise the right to vote/abstain from
voting at all the recognized General meetings and functions of the association.
iv. A member shall be considered as late for a meeting if he/she arrives at a meeting venue one (1) hour
after the meeting has started without any genuine reason and shall pay a fine of five hundred Naira
(N500.00) before being allowed to speak at the meeting.
v. A member of the executive, PSHS, Committee members or Class reps shall notify the General Secretary
in writing, stating reasons why he/she will be unavoidably absent at the said meeting, and such a letter
shall reach the general secretary latest by the stipulated day of the meeting. Failure to comply with this
shall attract a fine of Five Hundred Naira (N500.00) .
vi. The list of defaulters shall be displayed on all information dissemination platform of the association
after any meeting.
vii. All fines shall be paid immediately by the defaulter and a receipt to this payment shall be issued
accordingly by the financial secretary.
viii. A student sessional registration shall be considered incomplete if he/she fails to pay the sessional PANS
due as at when due, and shall be subjected to any disciplinary action that pertains to student with
incomplete or no registration.
SECTION 4
SUB-SECTION 1: ELECTIONS
i. Elections into all executive offices and P.S.H.S offices of the Association shall be held at most
2 weeks after the resumption of the first semester.
ii. There shall be an Electoral Committee appointed at the last congress before PANS week.
iii. The last congress before PANS week shall come up few weeks after the resumption of the
second semester and the electoral committee that is set up at the last congress before PANS
week shall have a period of at most two weeks into a new session to carry out the elections
and voting.
iv. In case of any change in the above recommendation, such change is subjected to the
ratification of the general congress.
v. The swearing in of the new executives shall be conducted by the Dean or representative of the
Faculty and the outgoing President shall have the honor of giving his/her parting speech, the
new President shall also have the honor of giving his/her acceptance speech.
vi. The election into executive offices shall be held by open secret ballot.
viii. The electoral committee shall have at least two (2) representatives from each level in the
faculty and two members of the PSHS randomly selected by the house and ratified by 2/3
majority of the congress, and shall be headed by a returning officer, which shall be a 400/500
Level student.
SUB-SECTION 4
VOTING
i. Except in case of annual general election into executive committee and PSHS positions,
voting at a n y o t h e r meeting shall be by a show of hand.
ii. No interruption shall be allowed during the voting and counting exercise. The president may
entertain objection after the exercise.
iii. In case of tie, members should be re-educated on the issue at stake after which a second
voting and counting exercise shall be carried out.
iv. When a second tie results, the presiding officer at such meeting(s) should cast the decisive
vote.
v. Voting at general elections shall be by open secret balloting only.
SECTION 5
RESIGNATION/IMPEACHMENT/RECALL/SUSPENSION
SUB-SECTION 1: RESIGNATION
i. Any member of the executive council or PSHS can declare his/her intention to resign through
the clerk of the PSHS to the Senate House.
ii. In case the clerk of the PSHS is the one resigning, his/ her letter of resignation shall be
directed to the Senate President.
iii. The Senate House shall reserve the right to approve or reject any resignation after due
consideration by 2/3 majority of the Senate members presents at such meeting.
iv. No member shall be deemed to have resigned until such member receives letter from the
PSHS accepting his/her resignation.
v. Such an officer(s) shall continue to act in his/her official capacity until the PSHS accepts
his/her resignation.
vi. All resignation letters must be addressed at most, two weeks after submission.
vii. Any resigning officer should submit all association’s property in his/her possession to the
President through the General Secretary.
viii. Boards and committees shall follow the same protocol for resignation.
SUB-SECTION 2: IMPEACHMENT
i. The Executive Council and/or members(s) of Executive council shall be constitutionally
removed from office if he/she is found acting contrary to his/her oath of office or
constitutional provisions or if the executives or a member of the executive has acted in a way
that is aimed at discrediting the Association.
ii. Any members acting on behalf of his/her self and the Association and in line with the
constitutional provision shall if necessary move a motion on the floor of the congress for the
impeachment of the executive(s) or any of its members. Such a member shall defend his/her
reason for such motion on the floor of the congress.
v. If such reason(s) are accepted by two-third (2/3) majority of the congress, then such
Executive(s) speaking through the president or any member, or speaking for him/herself shall
be called upon to defend him/herself.
vi. If such defence is unacceptable by two-third (2/3) majority of the member at the congress then
the congress will proceed to pass a vote of no confidence on such Executive(s) or such a
member.
vii. When a vote of no confidence is passed on the Executives, the PSHS shall function as
caretaker committee pending the election of new Executives.
viii. When a vote of no confidence is passed on an official of the Association. He/she forfeit
his/her post and handover all documents and properties of the association to the President and
if the officer is the president, he/she shall handover all the association’s document and
property to the Vice president.
ix. The caretaker committee shall conduct fresh elections within Two (2) weeks to elect a new
executive while the executive will appoint an interim within the executives to fill vacant post
in the case of an official within one (1) week.
SUB-SECTION 3: SUSPENSION
i. All Executive member who fail to honor the PSHS summon on second notice, is liable
to 4 weeks suspension as adopted by 2/3 majority of the PSHS.
ii. Any suspended executive shall hand over all of the association’s property in his or her
possession to the president and in case such executive is the president, then he/she shall
hand over the association’s property to the Vice President.
iii. Any Executive member could be suspended from office by 2/3 majority of the PSHS,
and his/her recall to office will be determined by the next congress.
SUB-SECTION 4: FORFEITURE
i. A member of the PSHS shall be deemed to forfeit his seat in the house if he absents
himself from three consecutive meeting of the house without justifiable excuse or
written permission from the Senate President
ii. Any member who loses his seat by virtue of the provision contained in (i) above shall be
disqualified from being elected into the house again and holding any other office in the
association.
iii. A member of the PSHS shall be deemed to have forfeited his seat if he has been recalled
in accordance with the provisions of this constitution.
iv. A member of the parliament shall vacate his seat on ceasing to be a member of the
PSHS or he is suspended or expelled from the University as a result of any misconduct.
v. The Senate President's ruling on whether or not the explanation for absence adduced is
good, valid or acceptable shall be subject to his being over ruled by at least two-third
(2/3) majority of PSHS members present by voting
SUB-SECTION 5: RECALL
i) Recall of any PSHS members is vested upon the level that the members belongs
to.
ii) A petition written by any member of the class and signed by 2/3 majority of the class shall
validate a recall which shall be submitted to the senate President and shall be read at the
next emergency PSHS meeting which must be called within 2 days of receiving the petition.
iii) A bye election shall be conducted by the class rep of the affected level into filling the
position of the recalled PSHS member.
iv) A recalled member shall no longer be liable to contest for the position.
SECTION 6
THE EXECUTIVE COUNCIL
SUB-SECTION 1: COMPOSITION
ii) Officers shall cease to be in office after one session unless re-elected.
iii) The office of the president will be contested for by the “ 400L” or “500” students. While the office
of the General Secretary will be contested for by the “400L” students. A bye election shall be, in case any
of the elected officers dies, withdraws or is expelled from the university.
iv) The office of the vice president shall be exclusively reserved and contested for by the “400L” students
while the Assistant General Secretary be exclusively reserved and contested for by the “300L” students
v) All other offices shall be contested for by the 300L, 400L and 500L students.
i) Shall have the Executive power and the number one (1) student, as well as the chief
Spokesman of the Association.
ii) Shall consider all academic matters affecting members as his primary assignment from time to
time and mobilize members towards achieving their academic goals through a peaceful means.
iii) Shall coordinate and supervise all the activities of the Association.
iv) Shall preside over all the Executive and General meetings (congress)
v) Shall summon all general and executive meetings through the General Secretary
vi) Shall together with the Treasurer Sign vouchers and cheques for withdrawal of money from
the Association’s account.
vii) Shall review all contracts awarded by the Executive Council with a view to approving or
disapproving them.
viii) Shall verify all requisition with a view to approving or disapproving such requisition.
ix) Shall in conjunction with the Financial Secretary of the Association present a detailed
sessional budget to the PSHS for approval within 2 weeks of being sworn in.
x) Shall organize a Dean-students/Lecture-students forum in conjunction with the faculty
Authority, a least once every semester
xi) Shall have casting vote at a general or executive meeting only when there is tie
xii) Shall in consultation with other Executive officers form committee(s) for the Association
which must be ratified by 2/3 majority of the PSHS
xiii) Shall lead delegates to convention or fiesta, at the National Level
xiv) Shall represent the Association at the National Executive Council as National Vice President
xv) Shall ensure that a copy of the constitution is given to all fresh students on or before
orientation day
xvi) Shall participate actively in fund raising for the Association
xvii) Shall have the power to delegate responsibilities to all Executive members
(vii) Submit a well prepared and comprehensive financial report and statement of account to the
PSHS at the beginning of each semester.
(viii) Maintain an accurate account of the Association’s assets and liabilities such as vests, memos,
stickers and stationeries among others which shall be published on all the association’s
information dissemination platform at the beginning and end of every tenure.
(ix) Shall publish the list of all members who failed or refused to pay their dues not later than 48
hours before the commencement of the first semester examination.
(x) Perform other functions given to him/her by the president.
(i) Be responsible to matters relating to the general welfare of all members of the Association
as well as all guests of the Association.
(ii) Be the Chairman of the Welfare committee.
(iii) Be the student’s representative on all relevant committees on student’s welfare
(iv) Report the condition of any hospitalized member of the Association to the Executive
committee within 24 hours, if such a member is within the four walls of Olabisi Onabanjo
University Teaching Hospital, OOUTH and 48 hours if /she is hospitalized outside.
(v) Perform any other functions delegates to him/her.
ARTICLE 9: THE EDITOR IN CHIEF
SHALL
(vi) Shall handle the publications of the Association’s journal, periodicals, Newsletters and
others as many as are determined from time to time.
(vii) Be the chairman of the Editorial Committee.
(viii) Coordinate the activities of the Editorial Board whose members shall be appointed by
him/her which shall be subjected to ratification by 2/3 majority of the PSHS.
(ix) Enter into legal transaction with the printer(s) on behalf of the Association to produce
among others good an acceptable magazine that shall be approved by the executive
council.
(x) Furnish the PANS OOU Chapter information dissemination platforms with relevant
articles and notices including in conjunction with the PRO.
(xi) Perform any other duties given to him/her
ARTICLE 10
DIRECTOR OF SPORT
SHALL
i. Oversee all sporting activities of the Association ii. Procure and keep any available Association
sports equipment, indoor games and ensure adequate supply of such, within the financial limits of
the Association for members.
iii. Be the Chairman of the sport committees and shall appoint members of the committee
subjected to approval by 2/3 majority of the PSHS.
iv. Shall perform any other functions delegated top him/her.
ARTICLE 1: ESTABLISHMENT
(i) There shall be a PHARMACY STUDENTS HOUSE OF SENATE of the association.
(ii) Shall be inaugurated by the Dean on the same day as the inauguration of the executive.
(iii) Shall be made up of twenty (20) elected members whose tenure shall be (1) one academic
session.
(iv) Level two – five (2-5) shall elect five (5) representatives each to the Pharmacy Students
House of Senate (P.S.H.S).
(v) Attendance of P.S.H.S session shall be compulsory for all PSHS members.
(vi) Absence without proper information to the Senate President through the Clerk and written
permission from the Senate President through the clerk to the senator involved shall attract a
penalty as subjected by SECTION 2, SUB-SECTION 5 (xi) of this provision.
(vii) Refreshment shall be made available to all members of the P.S.H.S present at the first and last
Senate session of every semester by the Executive Council through the Assistant general
secretary of the association, which shall not be served earlier than A.O.B.
(viii) The Executive shall release the sum of Thirty thousand naira (N30,000.00), (N15,000.00 per
semester) for the operational administrative cost of the PSHS.
iii) The ECO committee shall preside over the election of the P.S.H.S members into office
(C) CLERK
(i) Shall summon meeting of P.S.H.S at the request of the Senate President
(ii) Shall keep the minutes of the P.S.H.S as well as display the minutes of each meeting on all
information dissemination platforms of the PSHS at most 48 hours after such meeting.
(iii) Shall attend to the internal and external correspondence of the P.S.H.S.
(iv) Shall present to the P.S.H.S a comprehensive report of the of the P.S.H.S activities at the end
of his/her tenure.
(D) ASSISTANT CLERK
(i) Shall take and keep the minutes of the Executive meeting of the P.S.H.S.
(ii) Shall keep the attendance register of the P.S.H.S and submit the names of erring members
within 48 hours after such meeting to the Senate President.
(iii) Shall assist the clerk in his/her duties.
(iv) Shall perform other duties as may be assigned to him/her by P.S.H.S
(v) Shall be in charge of the financial duties of the P.S.H.S
(E) CHIEF WHIP
(i) Shall maintain decorum in the P.S.H.S sessions.
(ii) Shall arrange the venue of the P.S.H.S sessions.
(iv) Shall use the same standing orders as spelt out for the association in Section 3.
(v) The title of the President shall be substituted for the title of the Senate President as used in the
standing order of the house.
i) mediate in any disputes within members of the Executive Council through Mediation
committees made up of five (5) members elected at the floor of the P.S.H.S, such disputes
shall be the only ones brought before it by the Senate President or any concerned member of
the Association in writing through the clerk.
(ii) Its decision on such disputes shall be binding on all members of the of the Association except
where the constitution is silent in which such matters will be taken to the congress.
(iii) Shall entertain petition from members of the Association and look into the issues raised in
such petitions with a view to finding solution to them.
(iv) Shall initiate bills and pass them through the clerk to the Executive council for consideration
and/or approval and such bills shall be ratified by 2/3 members present at the congress.
(v) Shall reserve the power to approve all proposal for dues or levies for the association.
(vi) Shall assist in achieving the aims and objectives of the Association.
(vii) All budgets (income and expenditure) including those of the Executive council, Ad-
hoc/standing committees must pass through the P.S.H.S for deliberation and necessary
approval and ratification before any form of spending by the executive council..
(viii) The P.S.H.S shall summon an emergency meeting of the congress either in favor or against
the will of the Executive, provided it is ratified by 80% of the entire members of the P.S.H.S
SUB-SECTION 5: COMMITTEE/BOARD
ii) No committee or committee member shall get any form of financial reward for their service to
PANS as these are voluntary services to the progress of the association, except in cases of
business transactions with the association which shall be reviewed by the PSHS for ratification.
(i) Shall comprise of five (5) members, one (1) representative from each level which shall be nominated
by the congress.
i) They shall have the power to interrogate, for the purpose of establishing the guilt or innocence
of any member reported before it as an accomplice or suspect in any allegation and effect
necessary measures in the cases of established guilt.
ii) They shall investigate without fair or favor, complains of against any member of the
association on recommendation by the executive council, S.R.C or members of the association
in writing
iv) Shall forward a report of all reported cases to the staff advisers and/or the Dean as well as
forward a copy to the Senate and the Executive council through the clerk and general
secretary respectively
(C) DISCIPLINE
Discipline shall be enforced within the association and the offending members shall be liable to punishment as
resolved by the disciplinary committee.
Offences shall include
i) Acting in a manner likely to bring the association to ridicule, disrepute or contempt.
iii) Carrying on fraudulent or dishonest practices with may embarrass or disgrace the association.
v) Refusal or failure of any member to serve or participate actively in the activities of the
committee into which he/she has been duly elected or appointed, in accordance with the
constitution.
vi) Default or breach of the dress code
vii) Absence from or lateness to the congress without due notice to the congress through the
general secretary shall constitute an act of indiscipline and shall be treated as such
viii) Other offences as may be determined by the executive council, PSHS or Congress.
i) Congress shall have the power to enforce all forms of punishment as resolved by the disciplinary
committee.
(iii) Punishment adopted without prejudice to the provision of this constitution shall depend on the
seriousness of the case in question, removal from office, debar from holding office, fines, refunds,
censure and caution are a few of the several punishments possible.
(iv) Any office member found guilty of misappropriation of fund or other malpractice shall be reported to
the pharmacist councils of Nigeria via dean of the faculty, if already out of the university and the
dean of the faculty if still in school and shall be made to refund misappropriated funds, if possible
through legal means.
i) The electoral committee shall have two (2) representatives from each level in the faculty headed by
the chairman who shall be a returning officer from 400 or 500 level and a secretary who shall be a
300 level or 400 level student, elected by 2/3 majority of the congress, at the second to the last
congress.
ii) It shall in accordance with the provisions of this constitution organize/supervise election into the
executive council/ Pharmacy House of Senate (P.S.H.S).
iii) It shall have the onus to disqualify aspirant who does not satisfy all the electoral conditions as stated
in SECTION 4, SUB-SECTION 2 which shall also include at least 75% attendances to all pans
functions, fulfillment of financial obligation and other constitutionally instituted conditions
iv) It shall publish the list of candidates for each of the offices in accordance with Section 4, Subsection
2(c) at most forty eight (48) hours before the elections
v) it shall draft a budget which shall be presented to the PSHS for ratification by 2/3 majority of the
PSHS
vi) Shall organize and co-ordinate manifesto on the eve of the election
vii) Shall make arrangement for the inauguration of the incoming executive council and PSHS members
by the dean of the faculty of pharmacy at most ten (10), days, after elections have been completed
viii) No member of the electoral committee shall contest for any executive/P.S.H.S office
ARTICLE 7: ELECTORAL PETITION COMMITTEE
Shall
i) be constituted at the second to the last congress of an administration, alongside the Electoral
and Audit committee.
ii) be made up of eight (8) members with two members from each level from 200l to 500l.
iii) have a chairman from 400l or 500l and a secretary from any of the members from 200l to
500l, nominated by the congress and ratified by 2/3 majority of a well constituted congress
iv) listen and keep records of all petitions made not later than three (3) working days after
elections have been concluded
v) Shall be dissolved at the first congress of a new administration after the newly elected
officials have been sworn into office
vi) members shall have no voting right in any of the association’s congress until its dissolution
at the first congress of a new administration
vii) it shall have the right to call an emergency congress through the PSHS with the sole aim
of addressing matters relating to electoral petitions only.
i. Shall be made up of ten (10) members, two members from each level except the “would be”
200 level and two (2) members from the PSHS.
ii. A returning member from 400 level or 500 level shall be the chairman and any member of the
committee shall be the secretary which shall be subject to voting by 2/3 majority of the
congress.
iii. Shall be constituted at the second to the last congress, give its report at the last congress and
submit its report to the newly inaugurated Executives as well as the PSHS.
iv. Shall not include any outgoing executive member.
v. Shall have full access to all receipts, bank books, statement of accounts and every other
financial books and transaction that occurred during the administration within one week of its
ratification.
vi. Shall reconcile the financial secretary and treasure’s account book with bank transactions.
vii. Shall request evidences other than oral, such as receipt, requisition form, slip etc. during her
deliberations.
ix. All receipt, voucher, tickets, slips e.t.c shall be submitted along with the account book
x. Evidence may be request by the audit committee, shall be granted at any period during
auditing. iii. The account of the association shall be audited annually
xi. The committee shall remain dissolved after submitting his report, and may need to appear
before the PSHS, if need be.
i. Shall consist of the chairman /chairperson and a secretary which shall be appointed by the
executives and ratified by 2/3 majority of the PSHS.
iii. Shall together with the executives raise funds and materials needed for the organization of
the pans week.
iv. Shall operate the same account with the association and shall be very much accountable to
the executives where concerned.
v. The head of various sub-committees under the PWOC shall be their accounting officers.
vi. All member of the executives shall automatically be members of the PWOC
vii. Shall organize award and certificate of merit and honour to deserving members of the
association as part of her programs.
ix). Shall submit all report of all funds raised and spent during the pans week to the PSHS before its
dissolutions.
i) Except the Executives, PSHS, and standing committees, all others committees are ad-hoc
committees.
iii) All ad-hoc committee shall be set up by the executive council and shall be subject to
ratification by 2/3 majority of the PSHS.
iv) Shall present its reports to the executive council and defend its reports before the congress
where and when necessary.
v) Shall have the power to recommend any member or group of members who refuse to appear
before it to the disciplinary committee.
A) CONSTITUTION REVIEW COMMITTEE (CRC)
i) Shall be made up of the Senate President, and four (4) other senators, one from each
class nominated by the PSHS, three (3) executives and one (1) member from each
level, nominated by the congress and ratified by 2/3 majority of the congress in the
line with the provisions of the constitutions.
ii) The Senate President shall be the Chairman of the committee and a secretary shall be
nominated from members of the committee.
iii) Shall forward her material and financial request to the Executive council.
iv) Shall solicit for from memoranda from the members of the association and treat
appropriately.
v) Shall submit her recommendations at most one (1) semester after its constitution at a
well constituted congress for ratification and adoptions.
vi) Shall be dissolved immediately after the adoption.
SECTION 7: FINANCE
Shall include:
i) Compulsory sessional dues as determined by the EXCO and approved by the PSHS which
must be paid by every member of the association.
ii) Fines of various type as stated in the constitution.
iii) Donations, grants, loans, subsidies and sponsor from interested individual and organizations.
iv) Every member of the association shall pay for a copy of association’s magazine and
constitution, the price of which shall vary depending on the prevailing cost of production.
v) Through any variable approved scheme, venture or program of fund raising
.
NOTE: only cheques or bank transfer to the association’s account are acceptable for
financial assistance.
i) Renewal of the signatory to the association account shall be within four (4) week of
inauguration into office of a new executive council.
ii) Administrative expenditure.
iii) Publication, public enlightenment, seminar, symposia and work shop e.t.c
iv) Grant to delegate sent by association on approved mission.
v) Grant or donation made to a member of association approved by the association.
vi) Social entertainment approved by the association.
vii) Withdrawal from the association account shall be through the three (3) signatories made
up of the Treasurer, the financial secretary and the President.
SUB-SECTION 3: BANKING
i) The association shall operate one current account with a viable and reputable commercial bank.
ii) The association Bank used by the association shall be made know by the financial secretary of
the association at the beginning of every academic season (precisely at the first congress) and the
account for the internal running of the PSHS shall be made known to the members of PSHS at the
first sitting.
iii) Signatories to the bank account should be three (3) and shall comprise: the President, the
treasurer and the financial secretary. The account shall be transferred to the next officials of the
association within the next four (4) week of their inauguration.
iv) The financial secretary shall give a detailed financial report to the association at the first
congress of every administration.
(vi) ENACTMENT
The congress shall by resolution enact, repeal or amend any section of the constitution by the two
third (2/3) majority vote of a well constituted congress
(vii) INTERPRETATION
The Senate president shall have the right to interpret any provision of the constitution which is
ambiguous or subjects on which the constitution is silent provided such interpretations is approved by
2/3 majority vote of a well constituted congress and such interpretation shall be without prejudice to
the oath of office or the constitution.
(viii) AMENDMENT
Any amendment of this constitution shall be done by a two third (2/3) majority vote of a properly
constituted congress.
(ix) REVIEW
The constitution shall be subject to review at least every three (3) years, if need be, upon resolution
passed and adopted by not less than 2/3 of the member of the congress.
v) OATH OF OFFICE
i) The dean faculty of pharmacy, olabisi onabanjo university, shall administer an oath
of the office to newly elect executives and PSHS members at the inauguration
ceremony marking the beginning of a new administration.
