Lecture 05/06: Legal Rule; Definition, Characteristics

Rules are those legal commands which differentiate legal from illegal
behavior in a simple and clear way, also are the foundation of any legal
system, providing guidance and regulations for individuals, businesses,
and governmental bodies. They are essential for maintaining order,
fairness, and justice in society.

Definition of Legal Rules


A legal rule can be defined as a principle or regulation enacted and
enforced within a given legal system. These rules are created and applied
by authorised institutions, such as the government, courts, and
regulatory agencies, ensuring predictability and consistency in their
implementation and interpretation.

Characteristics of Legal Rules


Legal rules share several characteristics that set them apart from
other types of rules or principles in society.

Subject; general an abstract because they address a wide range of


issues pertaining to society, such as civil rights, property, contracts, and
crime. They cover various aspects of private and public matters.

A rule of behavior because guiding behavior and relationships between


individuals, businesses, and the state.

Enforcement by Sanction; Legal rules are enforced by institutions that


are authorised to monitor compliance, resolve disputes, and impose
sanctions in cases of non-complianc
