SELECTION NOTIFICATION OF ASSISTANT PROFESSOR (ANAESTHESIA)

1. Hon’ble Supreme Court in Rajesh Kumar Daria Vs Rajasthan Public Service
Commission held as follows:

“Social reservations in favour of SC, ST and OBC under Article 16(4) are ‘vertical
reservations’. Special reservations in favour of physically handicapped, women,
etc. under Articles 16(1) or 15(3) are ‘horizontal reservations’’. Where a vertical
reservation is made in favour of a Backward Class under Article 16(4), the
candidates belonging to such Backward Class, may compete for non-reserved
posts and if they are appointed to the non-reserved posts on their own merit,
their number will not be counted against the quota reserved for the respective
Backward Class. Therefore, if the number of SC candidates, who by their own
merit, get selected to open competition vacancies, equals or even exceeds the
percentage of posts reserved for SC candidates, it cannot be said that the
reservation quota for SCs stood filled. The entire reservation quota will be intact
and available in addition to those selected under open competition category.

But the said principle applicable to vertical (social) reservations, will not apply to
horizontal (special) reservations. Where a special reservation for women is
provided within the social reservation for SCs, the proper procedure is first to fill
up the quota for SCs in order of merit and then find out the number of
candidates among them who belong to the special reservation group of
‘Scheduled Caste Women”. If the number of women in such list is equal to or
more than number of special reservation quota, then there is no need for further
selection towards the special reservation quota. Only if there is any shortfall, the
requisite number of Scheduled Caste Women shall have to be taken by deleting
the corresponding number of candidates from the bottom of the list relating to
Scheduled Castes’.

2. Hon’ble High Court in W.P.No.27884 of 2022 in its orders dated 23.9.2022 related
to Group-I Services recruitment of Telangana Public Service Commission, has directed
the respondents to follow the decision of Hon’ble Supreme Court in case of Rajesh
Kumar Daria Vs Rajasthan Public Service Commission.

3. In view of the above, horizontal reservations for women will be followed in this
recruitment, rather than vertical reservation in the following matrix:

Note: The number of women in each category shall be at least 33 1/3 %

4. If the vacancies earmarked for EWS and meritorious sports persons category
cannot be filled due to non-availability of suitable candidates, such vacancies shall not
be carried forward to the next recruitment year as backlog. These unfilled vacancies
shall be converted to OC category.

5. On the basis of the points obtained based on the qualifying exam marks and
weightage points for contract/outsourced service in state government institutions/
programmes/ schemes and subsequent certificate verification, 155 candidates have
been selected for appointment to the post of Assistant Professor (Anaesthesia) in
Directorate of Medical Education pursuant to Notification No.2/2022, Dt: 06.12.2022.

6. The selection list is published here-with subject to the following conditions:

(i) Name in this selection list confers no right to appointment unless the
appointing authority is satisfied that the candidates having regard to their
character and antecedents are suitable in all respects for appointment to
the service.
(ii) That the candidates are found physically & mentally fit for the post.
(iii) That the candidates should produce such original certificates as required
in accordance with the rules / notification.

7. If it comes to the notice of the Board later that any candidate has furnished false
information or the selection is not in order due to any act of omission or commission of
any candidate, then his/her selection is liable to be cancelled at any stage and they will
forfeit all consequential benefits including that of selection.

8. Besides that, the Board reserves the right to take any action as it deems fit in the
circumstances of the case, in terms of the relevant government rules.

9. With this the general recruitment process for the posts of Assistant Professors
(Anaesthesia) in Directorate of Medical Education pursuant to Notification No.2/2022
has been concluded.

10. The selections are subject to the final outcome of W.P.s and other cases pending,
if any, before the Hon’ble Courts of Law.
