Alternative Methods of Procurement

▪ Approaches for acquiring goods and services outside standard bidding, used in
exceptional cases with approval from the HoPE and BAC.

Direct Contracting
a method of procurement where a contract is awarded directly to a specific
supplier without a competitive bidding process

Repeat Order
purchasing additional items from the same supplier without a new bidding
process.

Shopping
A procurement method for small-value items using price quotes, with limits of
₱50,000 and ₱500,000.

Negotiated Procurement
A flexible method for urgent situations where competitive bidding isn't practical,
divided into categories:

1.Two Failed Biddings


▪ Direct negotiation with a qualified supplier after two failed bids.
2.Emergency Cases
▪ Used for immediate action to protect public safety.
3.Take-Over of Contracts:
Allows a new contractor to finish a project if the original fails

• Change Order: Adjusts the amount or details of work already in the contract (e.g.,
adding or removing materials or tasks).
• Extra Work Order: Adds new work that wasn’t planned in the contract (e.g., fixing
unexpected problems like hidden pipes).

The DPWH Blue Book, officially known as the "DPWH Standard Specifications for Public
Works and Highways, " is a comprehensive guide published by the Department of Public
Works and Highways (DPWH) in the Philippines.

CSI stands for the Construction Specifications Institute.


Project Readiness
➢ Before the procurement of construction services, government agencies are required
to conduct thorough project planning and preparation, which may include
identifying and securing necessary permits, clearances, and right-of-way for the
project.

Regulatory Requirements
1. Right of Way Acquisition
2. National Commission on Indigenous People ( NCIP )
Certificate or Clearance
3. Environmental Compliance Certificate ( ECC )
issued by the DENR
4. DOLE approved Construction Safety and Health program

Contract Implementation
➢ This is to ensure that the construction activities are carried out effectively,
efficiently, and in accordance with the contractual obligations. Successful
implementation contributes to the timely completion of the project, meeting the
required quality standards, and achieving the project objectives.

Contractor’s Receipt of Notice to Proceed


➢ Upon contract signing, the agency issues a Notice to Proceed (NTP) to the winning
contractor, granting authorization to commence the infrastructure contract works.
The contractor's receipt of the NTP signifies the official start of implementation.
Pre-Construction Conference
➢ This conference serves as a platform to discuss the following, to wit:
i. Clarification of Project Requirements;
ii. Coordination and Collaboration;
iii. Contractual and Administrative Matters;
iv. Contractor’s Project Execution Plan; and
v. Environmental, Safety and Quality Assurance

Management & Execution of the Contract Works.


➢ This includes the following, to wit:
i. Construction Management Plans;
ii. Payment of Monetary Claims;
iii. Process of Time Extensions, Suspensions & Resumptions;
iv. Process of Variation Orders; and
v. Environmental, Safety and Quality Controls

Contract Time Extension Per Sec. 11.1 Annex E of the Revised IRR of RA 9184,
➢ The Filing of the request for Time Extension must be “prior to the expiration of the
contract time and within thirty (30) calendar days after such work has been
commenced or after the circumstances leading to such claim have arisen

Work Suspension Order


➢ is to be issued by the Implementing Office regardless of the suspension duration, to
suspend the contract work wholly or partly for such period as may be deemed
necessary based on the grounds hereof.

Work Resumption Order


➢ the approving officials shall be based on the Delegation of Authorities and issued by
the Implementing Office to the contractor to resume construction after the cause of
or reason for the work suspension has been resolved.
Variation Orders
➢ shall be subject to the provisions of Annex E of IRR and may be issued by the PE to
cover any increase or decrease in quantities, including the introduction of new work
items not included in the original contract or reclassification of work items due to
valid grounds provided.

“Once the project reaches an accomplishment of ninety-five (95%) of the total contract
amount, the Procuring Entity may create an inspectorate team to make preliminary
inspection and submit a punch-list to the Contractor in preparation for the final
turnover of the project. Said punch-list will contain, among others, the remaining
Works, Work deficiencies for necessary corrections, and the specific
duration/time to fully complete the project considering the approved remaining
contract time.”

iii. Initial As-built Drawings / Proposed Firmed-up Contract Quantities and Costs.

> Compliance with the Findings during Final Inspection
> Certification that the Contract Works was Physically Completed

Final Billing
● Certificate of Completion;
● Final Firmed up Contract Costs and Quantities;
● Final Revised Construction Program;
● Operations and Maintenance Manual;
● As-Built Plans & Drawings
● Contractor’s Quit Claim
● Certification of No Third-Party Claimant
● Computation of Liquidated Damages (if any).

One (1) year from issuing the Certificate of Completion or what we commonly known
as the Defects Liability Period, the contractor may file its request for the issuance of
the Certificate of Final Acceptance if the Completed Structures is still in good
condition (no defects) beyond the said period
