THE GOVERNOR

 A Governor is the Chief Executive head of a State.


 Usually, there is a Governor for each State, but the Constitution (7th
Amendment) Act of 1956, facilitated the appointment of the same person
as a Governor for two or more States or Lt. Governor of the Union Territory.
Appointment and Term of Office

 A Governor is appointed by the President of India by a warrant under his


hand and seal, on the recommendations of the Union Council of Ministers.
 His usual term of office is five years but he holds office during the pleasure
of the President.
 The governor may by writing under his hand addressed to the president,
resign his office.
Qualification and Conditions of
Governor’s office

To be eligible for appointment as governor, a person:


 1. must be a citizen of India;
 2. must have completed 35 years of age;
Conditions of governor’s office:
 He shall not hold any office of profit.
 He should not be a member of either House of Parliament or the State
legislature;

1. Executive Powers

 All Executive actions of the Government a State are formally taken in the
name of governor.
 He appoints all important officials of the State including the Chief Minister,
other ministers, advocate-general, Chairman and members of the State
Public Service Commission and so forth.
 The governor also reserves the right to recommend to the President that
the government of the State is not being carried on in accordance with
the provisions of the Constitution.
 When the State is placed under President's rule, the governor acts as the
representative of the President in the State and assumes extensive powers.
2. Legislative Powers

 (a) nominates one-sixth members of the legislative council;


 (b) nominates one member of the Anglo-Indian community to the legislative
assembly if it does not get representation otherwise;
 (c) summon or prorogue either House of the State Legislature and dissolve the
State Legislative Assembly;
 (d) send messages to the State Legislature on bills pending before it;
 (e) address the first session of the State Legislature after the general elections;
 (f) give assent to the bills passed by the state legislature;
 (g) reserve certain types of bills passed by the legislature for the assent of the
President.
 (h) make laws through ordinances during the recess of the State Legislature
3. Financial Powers

 (a) Money Bill can be introduced in the State Legislature only with the prior
recommendation of the Governor.
 (b) He can make advances out of the Contingency Fund of the State to
meet any unforeseen expenditure.
 (c) He constitutes a Finance Commission after every five years to review
the financial position of the Panchayats and the Municipalities.
4. Judicial Powers

 a) The governor is consulted by the President while appointing the Chief


Justice and judges of the State High Court.
 (b) He appoints judges of courts below the High Court.
 (c) He can grant pardons, reprives, respites and remissions of punishment
or suspend, remit and commute the sentence of any person convicted of
any offence against any law relating to a matter to which the executive
power of the State extends.
5. Discretionary Powers

 (a) Appointment of the Chief Minister when no party has clear cut majority
in the State Legislature.
 (b) Recommendation for the imposition of the President's rule in the State.
 (c) Reservation of a bill for the consideration of the President.
 (d) Dismissal of a ministry.
