MOST RESPECTFULLY SHOWETH:

1. That the complainant is a company duly incorporated under

the Companies Act, 1956 having its registered office at BSES
Bhawan, Nehru Place, New Delhi - 110019 and Corporate,
Legal and Enforcement Cell at Andrews Ganj, Next to
Andrews Ganj Market, New Delhi-110 049.

2. That the present complaint has been signed and filed by Shri
Pankaj Bhatty, Authorised officer of the complainant
company, who has also been duly authorized to sign, file,
institute and proceed with all the petitions including the
present complaint inter alia under Section 135 of the
Electricity Act, 2003 on behalf of the complainant company
vide Power of Attorney dt. 23.08.2022. A true copy of the
aforesaid Power of Att01ney of the authorised representative

of the complainant company is also filed alongwith this
complaint for perusal of the Hon'ble court.

3. That the complainant company is a licensee under the

provision of Section 14 of the Electricity Act, 2003 for the
distribution of the electricity in the areas of South and West
Delhi including the area i.e. H. No. B-35, Bhusalia Mohalla,
Bhati Kalan, New Delhi-110 074 (Floor Booked-Ground
Floor) where the offence under consideration in the
complaint has been committed by the accused person.

4. That on 22.11.2023, a joint inspection team comprising of Er.

Manish Singh, Asst. Manager, Mr. Ghufran Ahmed,
D.E.T, Mr. Gaurav, Lineman, of the Enforcement Cell of
the Complainant company etc., who have also been duly
authorized to enter, inspect, break open, search, seize and
remove all such devices, instruments, wires etc., as per the
provisions of the Electricity Act, 2003, along with witness
Mr. Sanoj (VIG), inspected the H. No. B-35, Bhusalia
Mohalla, Bhati Kalan, New Delhi-110 074, which falls
within the distribution area of the complainant.

5. That at the time of inspection of the premises in question the

accused person as mentioned above, was found to be the
illegal user of the electricity of the premises in question.
However, at the time of inspection, the joint inspection team
observed that no meter was found installed at the site. The
accused person was found indulged in direct theft of
electricity with the help of illegal supply from BSES AB
cable, via illegal 2- core wire which was further connected to
the direct theft load. Hence, the accused person was found

committing direct theft of electricity as the entire load of the
premises was found running on it illegally. Hence, this is a
case of direct theft of electricity. The material / wires
description of which are more particularly mentioned in
Seizure Memo dt. 22.11.2023 were removed at site and
seized as per seizure memo dt. 22.11.2023 by the joint
inspection team at site. At the time of inspection of connected
load running of direct theft supply was found at 3.729
KW/DX/DT in Domestic category.

6. That the inspection team also prepared Inspection Report,

Load Report in the 'Form for Assessment ofConnected Load'
as well as Seizure Memo at site and the same are attached
herewith, which may also be read as part and parcel of the
present complaint, contents whereof are being not reproduced
here for the sake of brevity. Necessary photography and
videography were also got done by the Joint Inspection
Team with the help of Digital Camera, at site. The accused
person/ their representative however refused to sign the
aforesaid seizure memo.

7. That by the aforesaid illegal act, the accused person was

found to be causing wrongful loss to the Complainant
Company and wrongful gain to himself and was thus acting
dishonestly.

8. That since it was a case of direct theft of electricity, a theft

bill dt. 23.11.2023 as per the DERC regulations and tariff
order was raised by the complainant company for a sum of
Rs.1,15,827 /- (Rupees One Lakh Fifteen Thousand Eight
~)

Hundred and Twenty-Seven Only) with due date as

08.12.2023. Initially, the accused person approached the
complainant company and agreed to make the said due
payment but later on failed and neglected to adhere to his
commitments ·to the complainant company regarding
payment of theft assessment bill.

9. That thereafter, an official of the Complainant company gave

a written complaint dated 22.11.2023 to the SHO, PS Maidan
Garhi, detailing the Offence committed by the Accused, but
no action has been taken yet. Hence, this complaint.

10. That from the aforesaid facts and circumstances, it is clear

that the accused person has committed the offence punishable
inter alia under the provisions of the Section 135 of the
Electricity Act, 2003.

11. That as the accused person has committed the aforesaid

offence inter alia U/s 135 of the Electricity Act, 2003 within
the territorial jurisdiction of this Hon'ble Court, hence this
Hon'ble court has got the jurisdiction to ente1iain, try and
decide the present complaint.

PRAYER

The complainant company, therefore most respectfully prays that

this Hon'ble comi may kindly be pleased:

a) to summon, try and punish the accused person U/s 135

of the Electricity Act, 2003, or by adding any other
sections as this Hon'ble court may deem fit and proper;

b) to detennine the civil liability as per the provisions of
Section 154(5) of the Electricity Act, 2003 and the
amount so recovered may kindly be ordered to be paid to
the complainant company for the losses suffered by it;
c) to pass any other/ further order(s), which this Hon'ble
court may deem fit and proper keeping in mind the facts
and circumstances of the case.

WHEREAS the Company being the Licensee, is in the business of distribution ·and retail

. supply of electricity in the licensed area of supply within Delhi.

WHEREAS the Company in furtherance of its. business operation, in strict adherence of

the law and for the enforcement of the provisions of law in this regard, time and again
initiate legal proceedings and/or has to prosecute/represent/defend the legal proceedings
initiated against the Company before various Courts, Judicial and Quasi-Judicial
Authorities.

WHEREAS the company in legal proceedings instituted by/or against it is required to

defend, appear; compound, settle in any claim, de_mand or dispute before any court,
tribunal, commission or board whether at civil, criminal or labour and whether original or
appellate and for such purposes it is required to appoint or remove, replace any
consultant, professional, advocate, attorney, lawyer, solicitor on retainership 'basis or
otherwise· and to fix the terms & remuneration.

WHEREAS the company for the purpose of appointment of. advocates /attorneys /
lawyers on regular or retainer basis is required to delegate ·this .authority. Ih furtherance,
the Companis board of Directors in their meeting held on 09th August, 2022, delegated
authority on the Chief Executive Officer of BSES Rajdhani ·Power Ltd. to put his hands
on this General Power of Attorney.

NOW THIS DEED WITNESSETH .that CEO, do hereby,_ con~titute, appoint and
declare Mr.Pankaj Bh.atty S/o Sh. M.S. Bhatty currently working, as Manager (Legal)
with the Company as duly.constituted lawful attorney and to do, perfonn all or any of the

proceedings and/ or representation in ongoing litigation including Suit, execution
proceedings, review, revisions, writ, appeals, SLP's, Arbitration Proceedings and
to withdraw, compromise, recording of settlement, execution, ~nd filling of
settlement agreement, to receive the settlement amount and to file and /or
authorize to file applications for compounding/settlement the case be that it be of
civil and/or criminal nature and pending'before any authority /court/quasi- judicial
Authority and to take all essential/ancillary actions in furtherance of the
performance of the task under this instant clause including bur not limited to
leading evidence, cross examination of the witnesses, etc.·

3. To file and procure/obtain documents/orders/notices for and on behalf of the

Compariy and to apply and/or to obtain copies includfog certified copies of the
documents and papers for and on behalf of the Company.

4. To take all actions necessary for filing/conducting execution proceedings

including initiation/ filling the execution proceedings for the Enforcement Orders
/Settlements / Decree amongst other legal proceedings.

5. To retain, engage, and remunerate Advocates, Solicitors and other legal

practitioners and advisors and to sign "Waqants", '~akalatanama' and other
necessary authorities including to take/procure · opinions from
Advocates/Solicitors and/or to brief them for appearance before various
Courts/Authorities.

6. To do all other lawful acts and deeds which are necessary to be performed for the
progress and in th~ course of proceedings and the other prosecutions of various
nature including Suits, Writs, Arbitrations, SLP, Complaints; Execution
Proceedings and other cases & proceedings, _in~luding ongoing litigation and the
Company do hereby agree .that all the acts and the things lawfully d<;me by and
perform~d by the above· said Attorney of the· company shall be construed l;lS the
acts ang the things done by the company. The Company do her~by undertake· to
