said as they pulled up and parked, he pulled out his phone and started taking pictures of Tyler doing this and then quickly exited the
car to intervene said he yelled at Tyler, "take your hands off her", and Tyler did so. corroborated this and said they believed
Tyler did not expect them to show up when they did and that he likely thought Massiel was alone. They said they heard Tyler yelling "I still
love you" at Massiel.
said she was "shocked" as she drove up and saw this. She was concerned, and is still concerned, for her mom s safety.
As they joined Massiel, they then went inside and Tyler returned to the lower area around the back of the residence that he stays in. A
little while later the decided to come to the PD to ask about the restraining order process.
showed me the multiple pictures he had taken of Tyler grabbing ahold of Massiel which illustrated what they had depicted.
I explained the crime of Harassment to them but that Massiel would need to initiate the complaint as she is the victim of it. They said they
would go home and discuss that with her and call back.
A short while later I received a transferred call through LOCOM from . She was on speaker with Massiel. I introduced myself and
asked Massiel to tell me about what had occurred.
Massiel said she was in the yard, watering her garden this afternoon, when Tyler approached her. She said he "wanted to talk" because he
is very upset about their now contentious relationship. Massiel said she turned her back to him to try and ignore him, while acknowledging
to me on the phone that that was "not wise to do". Massiel said she then felt Tyler s arms wrap around her body, to include her shoulders,
which trapped both arms in his grasp. She said she began "screaming", saying things like "let me go". Massiel said Tyler was telling her that
she "wanted him to do this" to her. Massiel tried to spray him away with the water hose but was unable to. She said luckily arrived,
yelled at him as they exited their car, and he backed off. Massiel said she is unsure of how long Tyler held onto her, but thinks it was
possibly 30 seconds to one minute.
Massiel told me Tyler has been banging on their windows this past week, kicking the front door, and often yelling nonsensical things
because he is "always on heroin and speed". She described him as "erratic and violent" and said she is "pretty scared" and that this keeps
her from leaving her house much. She said he also keeps yelling that he is not going to leave and will be getting a "stay from county".
Massiel told me she has known Tyler for approximately 5 years. Around Christmas time last year he was homeless and because it was
snowing she invited him over for a little bit, but "never said he could stay". They have had a romantic relationship which she confirmed she
ended earlier this week.
I thanked Massiel and said I would be making contact with Tyler later this evening.
I checked Tyler s status on my MDC and saw he is clear and violation suspended. I saw he had multiple non-extraditable warrants out of
Washington State and Florida that included FTA s on Larceny, DUII, and traffic charges. I saw he is the respondent in a valid protection
order for a female in Washington State.
Around 1911 hours, myself and Officer Blyth went to the residence. came out front and directed us around the side of the house to
access Tyler s area.
Upon opening the gate I saw the front door to this unit wide open. I called out, announcing who we were and for Tyler to come outside to
talk to us, which he did. I recognized Tyler from the pictures had shown me and saw he was wearing the same clothes from earlier
today.
I asked to sit on a nearby small retaining wall and he did so. I asked him to tell me about what had occurred this afternoon between
him and Massiel. Tyler provided an extremely similar account to the ones everyone else had given.
Tyler told me he is very frustrated about the situation, that he deserves to stay here and that he cannot leave anyways because his car will
not start. Tyler said Massiel was watering and deliberately "sprayed his windows". He said this upset him because she had sprayed his
items that were outside his door earlier also with water and had "thrown flour" on them.

Tyler said he walked up to Massiel and "bear hugged her" from behind, "to get her to stop". Tyler said "that is the most violent I have ever
been with her". I told him regardless of her spraying water, he cannot put his hands on her like that. He began arguing that it was valid and
did not see any issue. He denied saying anything to her during it and admitted he only let go because pulled up in their car and
intervened.
I told Tyler to put his hands behind his back and that he was under arrest for Harassment. Although hesitant and verbally argumentative,
he complied and I handcuffed him without incident. I had him stand up, checked the fit of the cuffs and double locked them. We walked
him to my patrol car where I read Tyler his Miranda Rights from my department issued card. Tyler refused to answer if he understood
them, so I read them again line by line slowly but he refused to speak anymore.
Officer Blyth searched Tyler, removing some miscellaneous items like lighters and cords, which Tyler said were ok to store in his vehicle.
Tyler was eventually transported to CCJ by Officer Blyth and lodged without issue.
I returned to the residence and spoke with Massiel and inside. Massiel told me Tyler had not been violent before until a few weeks
ago. She said he "slammed her" into a wall which caused her to fall to the ground. She said he held her on the ground momentarily and
later told her to not call the police about it. He told her he would not do it again and she said she believed him and was not injured from
the incident. Massiel said Tyler has been saying things like he has "nothing to live for" if they are not together.
showed me a large handwritten note they claimed Tyler had given Massiel. It is apologetic in nature, and pleading with Massiel to
stay with him and not kick him out. I photographed this and later uploaded it along with the pictures provided, to the "R" Drive under
my name and this case number.
Massiel confirmed to me she was not injured in the incident today. She said she is very scared of Tyler and will be pursuing a restraining
order.
I provided Massiel with a DV Purple Packet, explained all of the contents and resources, provided my card and the case number and
explained the next steps in the criminal process. Massiel said she understood and thanked me.
Massiel admitted to spraying water and "tossing some flour" on Tyler s items that were left out in front of his door earlier in the week. She
said something to the effect of, "to get back at him" and, "I swear I thought he had finally left and it was just a little fun because I was glad
he was finally gone". She conveyed believing they were discarded items by him. Massiel agreed to leave the items currently there
completely alone until Tyler could retrieve them with a civil standby request.

On the above date around 1735 hours I took the report of a harassment in the lobby at WLPD. Massiel informed me
they had witnessed Tyler Lofall, Massiel s now ex-lover who still lives in the lower portion of their house, grab ahold of Massiel in the
backyard.
I later spoke with Massiel over the phone and she told me Tyler is angry at her for her ending the relationship and trying to evict him from
the property. She was in the yard watering when he came up behind her, wrapped his arms around her from behind tightly, said something
to the effect of "You know you love me and want this" and held on to the point of her feeling the need to scream, which she then did so.
She said she was very scared and fearful of him.
I reviewed the photos and saw Tyler with his arms wrapped firmly around Massiel with his chest to her back and holding her arms. It
appears Massiel is uncomfortable with the contact in the photos.
I spoke with Tyler and he said that is the "most violent he has ever gotten" [with her]. He said he "bear hugged her" to get her to stop
watering and claimed she had sprayed his windows and belongings. He said he held onto her for a period of time to get her to stop but her
kids interrupted it and he left the yard. He maintained he had the right to do this.
I arrested Tyler for the above charge and Officer Blyth transported him to CCJ where he was booked and lodged without issue.

On 03/07/22 at approximately 2018 hours I received text messages to my work cell from Massiel regarding harassment issues with Tyler
that she had forgotten to share with me while taking the initial report.
Massiel detailed many back and forth problems that the couple had been experiencing which includes both of them accusing each other
of taking or ruining their things. Massiel said in one text message that Tyler "cut the wires" to her water heater, and included a picture.
She also included four photos of handwritten notes that she said were written by Tyler.
The first note is titled "Monday To-Do List" which appears to detail steps of submitting paperwork possibly in attempts to stay at the
residence.
Two other pictures show a letter that appears to be written to Massiel declaring the writer s love for her, hopes of reconciling, and
confusion over being asked to leave.
Massiel told me she found the letter folded and taped to her front door, and another propped up against her bathroom window.
The photos were uploaded to the "R" Drive under my name and this case number.

Mr. Lofall then had another experience with the local police department when he woke up to
being drenched with some liquid and a knife being stabbed into the wall inches from his face from his
girlfriend who’s gotten taken to the mental ward three times by the police in the last 6 months) , and
Mr. Lofall had film of said and similar incidences yet no one seemed to care, further violating his due
process rights of equal rights by law enforcement officers considering he can do four months in jail over
taking a hose from her and when he gets menacing in return, he gets sent off soaking wet from Massiel
throwing water on him, threatening him with a butcher knife, on film, made leave soaking wet in a
cookie monster onesie of his teenage girlfriend’s daughters, on a bike with no breaks, in temperatures
in the 40’s at 3am to ride a bike home and the police wouldn’t even allow Mr. Lofall to retrieve his
property from the room he was in upon their arrival.
Moreover, damage to a civil claim (to be determined to what extent but estimated valued at no
less than $180,000.00) for the civil claim that was negligently interrupted. Plaintiff will be seeking,
economic and non-economic damages, and will be seeking compensatory, punitive, consequential, and
treble damages where available for the full amount recoverable by trial if settlement is not chosen.
II. THE DEFENDANT: County of Clackamas, West Linn Police Department, Dana Gunnerson,
