(Electronic mode only)

No: E1-573/2020 Dated: 28.12.2023

The Assistant Executive Engineer, Inland Navigation Subdivision, Kollam, for and on
behalf of the Governor of Kerala invites online bids for Electronic-Auction from competitive
bidders for the Maheendra Jeep kept at the locations specified in column (2) of the table below
through https://eauction.gov.in/eAuction/app. The bidders should be technically and financially sound for
participating in the bid and for executing the auction.

The tender cum auction shall be submitted electronically to the Assistant Executive Engineer,
Inland Navigation Subdivision, Kollam. All documents shall be submitted electronically by scanning
and uploading, before the due date and time.

The auction is invited in single cover system from the registered and eligible firms through e-
procurement portal of Government of Kerala https://eauction.gov.in/eAuction/app. Prospective bidders
willing to participate in this e- auction shall necessarily register themselves with above mentioned e-
procurement portal. The timeline is available in the critical date section of this e- auction published in
https://eauction.gov.in/eAuction/app.
INSTRUCTIONS TO THE BIDDERS

1) The following documents submitted through online.


Scanned copies of EMD details and Self attested copy of the PAN Card, Aadhar Card.
2) Any individual who possess a Class III DSC token will be allowed to participate in the auction process,
who will produce hard copies of his/her PAN and Aadhar Card along with demand draft for the EMD
amount mentioned against respective lots in the notice in favour of Assistant Executive Engineer, Inland
Navigation Subdivision, Kollam on/before 04/01/2024 3:00 PM by Speed Post/ Courier/By hand. . The
Department will not be responsible for the delay in receipt of relevant documents as mentioned in the E-
Auction Notice.
3) The bidder shall bear all costs associated with the preparation & submission of bids and site visits, and
the Government will in no case be responsible or liable for those costs, regardless of the conduct or
outcome of the bidding process.
4) The bidder is advised to visit and examine the Yard and its surroundings and obtain for itself on its own
responsibility all information that may be necessary for preparing the bid. He shall examine the site
condition and satisfy himself of the availability of transportation facilities, smooth flow of workmen and
difficulties which may arise during execution slit removal process. Any extra claims made in
consequence of any misunderstanding, incorrect information on any of these points or on the grounds of
insufficient description or information shall not be entertained or allowed at any later stage . The costs of
visiting the Site shall be at the bidder’s own expense.
5) Bidders are advised to quote their rates only after inspection of quality and quantity of materials at site.
6) The Government shall not be responsible for any failure, malfunction or breakdown of the electronic
system during the e-auction process.
7) The Government, in exceptional circumstances and at its own discretion, may extend the last date for
submission of bids, in which case all rights and obligations of the bidders previously subject to the
original date will then be subject to the new date of submission. The Government reserves the right to
accept or reject any Bid and to cancel the Bidding process and reject all Bids at any time prior to the
award of auction confirmation letter, without thereby incurring any liability to the affected Bidder or
Bidders or any obligation to inform the affected Bidder or Bidders of the grounds for the action of the
Government.
8) Bids shall remain valid for the period of 60 (Sixty) days from the date of e- auction. If Auction
confirmation Intimation Letter is dispatched within 60 days to the bidder, he should remit the whole bid
amount plus applicable taxes within 7 days of the receipt of that letter. He should also sign the
acknowledgement for taking over the site within 7 days of remitting of bid amount.
9) The bidder is bound to follow relevant Central and Kerala State Government orders, circulars, Manuals
etc prevailing even though specific reference to these are not provided elsewhere in the contract
conditions.
10) The selected bidder shall be liable and pay all taxes, duties, levies, royalties etc lawfully assessed.
11) If the Highest Bid (H-1 Bid) is accepted on closing of the e-auction, Auction confirmation Intimation
Letter will be issued to the respective Highest Bidder. It must be noted that The Government has the
power to accept or reject any highest bid, without citing any reason. The decisions towards acceptance
or rejection will be intimated to the respective bidders.
12) In case of unsuccessful bidders, the EMD will be returned to the bidders and In case of successful
bidders, EMD will be returned only after his payment of Sale amount.
13) The highest bidder will have to remit the full bid amount plus prevailing taxes including GST(18%),
IT(1%), Security Deposit (SD) 5% of bid amount . The SD shall be in the form of Demand Draft
payable to the Assistant Executive Engineer, Inland Navigation Subdivision, Kollam. The EMD of all
bidders will be refunded after elapse of one week since issue of acceptance order to the successful
bidder. After receipt of acceptance order the successful bidder has to execute an agreement with this
office as per prevailing rules incorporating all the conditions in this notice. The Security Deposit will be
refunded on successful disposal of materials and assurance of NOC from the offices concerned.
14) If the successful bidder fails to remit the Auction sale amount as prescribed in the Auction
confirmation Intimation Letter within the prescribed time period (7 days ) ,or fails to sign
acknowledgement for taking over the site , the bid will be treated as cancelled and all remittance
including EMD will be forfeited without giving any notice and the material will be re-auctioned at the
risk and cost of the successful bidder and all the loss incurred because of re-auction will be recoverable
from the defaulter. Loss as mentioned above will be realized from the defaulter as per Revenue
Recovery Act, 1968 or any other relevant Rules in force.
15) If the price fetched in the re-auction is less than the price fetched in the original auction, the difference
of bid values in the two auctions, inclusive of all taxes plus the expenses in conducting of re-auction
will be realized from the defaulter as per Revenue Recovery Act 1968 or any other applicable
Act/Rules
16) The defaulter will not be entitled for any payment if the price fetched in the re-auction is more than the
price fetched in the original auction.
17) The safe keeping of the materials sold is the responsibility of the Government till the successful bidder
takes the possession of site after remitting the sale amount and signing the acknowledgement for taking
over the site. The Government is not responsible for any loss or damage of the materials kept at the
yard thereafter.
18) Taxes as per the prevailing tariff wherever applicable at the time of delivery on the sale of materials
covered under this e-auction shall be payable by the successful bidders in addition to the quoted
amount , before taking delivery of materials.
19) The successful bidder should remove all the auctioned materials within 30 days from the date of
signing the acknowledgement for taking over the site. He is allowed to remove the materials for
another 30 days by paying the penalty at the rates noted below.

20) After the lapse of the above said time (60 days) the defaulter is not allowed to remove the bid material at
any cost. If the bidder did not remove the material even after the above specified period fully or partly,
all the remaining materials will be re-auctioned. The amount received on account of re-auction will be
treated as the revenue of the government and the bidder is not entitled to any claim on this amount and
material not removed.
21) The Government will not be in any way responsible for failure to deliver the materials due to cause
beyond their control such as strike, lockout cessation of work by laborers, shortened hours, act of God
or other causes of other contingencies whatsoever. In such cases the successful bidder shall not be
entitled to back out but he can apply for extension of time and, if the reason is found genuine and the
time prescribed will be extended without any penalty.
22) The successful bidders shall solely be responsible for movement and proper behavior of their deputies,
agents, and labourers within the premises. If any damage is caused to the Government property, the
bidder is responsible to make good such damage to the satisfaction of the Government, and the decision
of government in this regard shall be final and binding.
23) The Government will not at any point of time be responsible for any injuries caused, loss of men
machinery or materials due to accident within the premises or at the place of work and the bidder will
make proper arrangement for medical attention and treatment to his labour representative. The buyer
will be solely responsible for any claim arising out of the employment, injuries to labourers in the
course of the employment under any statute. It is the responsibility of the buyer to provide necessary
safety appliances (like hand gloves, tools, helmet, safety goggles, boots etc.) to the labourers who are
engaged for handling of the goods.
24) The materials shall be removed from the yard and return back the engine number and chaisis
number punched card .
