Video Concept: A day in my life as an Obligations and Contracts student

Dialogue:

Hi guys! A DAY IN MY SEMESTERAL LIFE AS AN OBLICON STUDENT AND A STUDENT LEADER...

Today, we will share a few principles and concepts about ObliCon.

First Video: Do you know what an obligation is? There are four requisites for an obligation to be valid. Dapat
merong active subject, passive subject, prestation at efficient cause.

Active subject – creditor or oblige, the party who has the right to demand the performance of an obligation.

Passive subject – debtor or obligor, who is oblige to perform the obligation

Prestation – the object of the obligation. It is either to do, to give, to nor do.

Efficient cause – the juridical tie that binds the parties to an obligation.

For example,

Since you’re an engineering student, under a building contract, you obliged yourself to build a house for Jamie
for 2,000,000.000.

The active subject is? The passive subject is? The prestation? How about the efficient cause?

Second Video: Do you know that there are five sources of obligations?

(a) LAW wherein they are imposed by law itself.

Examples: obligation to pay taxes and obligation to support one’s family

(b) CONTRACTS when they arise from the stipulations of the parties.

Example: obligation to repay a loan by virtue of an agreement

(c) QUASI-CONTRACTS when they arise from lawful, voluntary and unilateral acts which are enforceable to
the end that no one shall be unjustly enriched or benefited at the expense of another.

Example: obligation to return money paid by mistake or which is not due

(d) CRIMES OR ACTS OR OMISSIONS PUNISHED BY LAW when they arise from civil liability which is the
consequences of a criminal offense.

Example: obligation of the thief to return the car stolen by him

(e) QUASI-DELICTS OR TORTS when they arise from damage caused to another through an act or omission,
there being fault or negligence, but no contractual relation exists between the parties.

Example: obligation of the possessor of an animal to pay for the damages which it may have caused.

Third Video: Do you know that you have the rights to the fruits of the thing from the time the obligation to deliver
it arises. It is under Article 1164 of the New Civil Code. Pero you have to take note that the ownership is only
valid when it is delivered. This will also include the personal rights which right to demand and the real rights
which is right of ownership.

Monica sold her dog to Rachel for 5,000 pesos and while in the possession of Monica, the dog gave birth to a
puppy in which Rachel is the one entitled to the puppy if Janine has already paid the amount of 5, 000 pesos
to Monica.
