Obligation b/w Employer and Employee:
Employer obligation to Employee: These are the following obligations which employer has towards his employees. 1. Obligation to pay Fair Wages: Wages should be paid to employees according to following criteria. Rank / Position Expertise / Experiences Society and public expectations Minimum labor market wage according to job Firm’s Profitability Govt; law of minimum wage Nature of the job 2. Obligation to provide Safe Working Environment: An organization named Occupational Safety & Health Administration (OSHA), “[It enforces the employer to provide certain level of safety to employee]” The safety hazards stems from the following; Lack of knowledge of reliable information about the nature of job. Lack of proper compensation for the job. Lack of alternative job in the market. The competitive wages that are commensurate with experience or the market are the salaries that are equal to or higher than the industry standard for similar jobs in the same area. 3. Obligation to provide Meaningful Work: Proper tasks should be assigned to employees for job satisfaction. There should be control on work task. The quality of work life (QWL) should be followed QWL means (If you provide autonomy control to the employees, they will be more productive and efficient for long term employee relationships. Employee obligation to Employer: These are the following obligations which employees have towards their employer. The contractual obligations of corporation should be followed by employees The goals, procedures and rules of organization should be followed by employees. Employee should be offering competence towards his / her task and being productive. There should be timeliness, avoid absenteeism and acting legally and morally. Respecting and protecting intellectual property or private property. Employee Right in Workplace: 1. Right not to be terminated without fair / just cause. If employer has to terminate the employee he should follow the following process; Notify the employee → [Right of Equal Employment] Investigation Absence of discrimination They should have to give reasonable penalty → [Right of Opportunity] 2. Right to due Process (Procedures, Rules, Decisions) Public hearing should be done Peer evaluation External arbitration Mutually agreed grievance procedures “(These all could be applied in all aspects of privacy, safety and health and environment)” “[Arbitration means right with 3rd party to discuss or take decisions] “[Negotiation means right to discussion of two persons]” 3. Right to privacy It is basically self governing It contains two types; Physical privacy (Space and time of any employee) Psychological privacy (Inner life of any person) How much control an employer can have over the life of employee ? There employer should control as the following; Polygraph & Psychological Testing: Polygraph is a lie detector, which checks heart rate and pulse rate. Psychological testing involves two types; Question of why (To hesitate victims) (To occupy information by pressurizing them) Drug Testing (Can be used only for jobs that have clear present potential to cause harm to others) It is ethical if results are notified Appeal on results Results should be kept confidential and discarded Problems of Privacy arises; Lie detectors are not reliable These can be easily manipulated by operators Irrelevant questions about family / personally Confidentiality of results Doctrine of Equal Opportunity: Everyone should have an equal chance to get employment / job Affirmation Action Programs: These are the proactive programs that attempt to recruit applicants from minority group. These were formed for groups who had experienced past discriminatory practices. Affirmation action programs attempt to make employer blind to gender, color, age disability. Discriminatory Harassment: When someone harasses another due to the victim’s membership in a protected class. State and federal laws prohibit the harassment. Harassment of Race / Racial Harassment: The harassment which is based on “(Ancestry, Skin color, Citizenship, Race)” It includes slurs, racist jokes and insults. We can not change the factors like [skin color, ancestry etc] on which this occurs. Gender Harassment: Discrimination on the basis of gender at workplace. These are negative stereotypes of men and women roles in a society. Religious Harassment: The harassment which is based on “(Religious beliefs, Customs, Traditions, Holidays, Clothing etc)” Also include intolerance towards other religions. Disability Harassment: It include harassing someone who is either disable or has a relation with a disable person. Using of disability services like “(Isolating, Pressurizing, Ignoring a person)” Age related Harassment: According to [Civil Right Act 1964], they prohibits age related discrimination of people above 40. It include the situation of being left out. Personal Harassment: The harassment which is based on “(Bullying, Humiliation, Intimidation, Criticism, Ostracism)” Ostracism means [excluding someone from a group] This type is not legal / or having any law. Physical Harassment: Threats of harm Shoving or Hitting Destruction of property Power Harassment: Difference in Power Difference in Hierarchy level Difference of status Psychological Harassment: Harm to victim’s mental well-being Negatively impact work and social life Isolating, belittling Online Harassment: It include negative use of technology Retaliation Harassment: To retaliate against someone who has used their lawful right
