Public Body Conversion

• With effect from 15 July 2016, both HKGBC and BSL have
become Public Bodies

• Unique position entrusted by the Government

• Under jurisdiction of relevant provisions for public bodies as


provided in the Prevention of Bribery Ordinance (Cap. 201)

• All directors, employees and committee members under BSL are


regarded as “public servants”

• Any organisation or person shall NOT offer advantage to BSL


through official dealings or private social activities

• A BEAM Affiliate is a person accredited by the Hong Kong Green Building Council
Limited (HKGBC) as being competent to support green building design,
construction and operations.

• In a typical project setting, BEAM Affiliates work under a BEAM Pro to support the
green building certification process.

BEAM Practitioners – Rules of Conduct

BEAM practitioners will be required to sign an undertaking to


comply with the rules of conduct and to declare that they have not
committed misconduct in a professional respect at the time of
first-time login in HKGBC individual account portal.

BEAM Practitioners – Rules of Conduct

The Rules of Conduct require a BEAM Practitioner to:


a) Uphold the value, dignity and reputation of the Profession;
b) Abide by laws related to the Profession;
c) Comply with the rules and regulations of the Organisations;
d) Respect the intellectual property rights of the Organisations; and
e) Conduct his or her business in a competent, ethical and
objective manner.

• BEAM Assessors (BAS) are trained and


accredited by HKGBC
• Under BEAM Plus rating scheme, BEAM
Accredited
Assessors are anonymous to clients and
applicants
• There are In-house BAS from BEAM Society
Limited
• BEAM Society Limited will assign
respective BEAM Assessor to undertake
project assessments based on the profile of
the experts
• Could involve more than one BEAM
Assessor in the assessment of a single
project

Qualification of BEAM Assessors (NB/EB/BI)

Route 1 – Normal Scheme


• A degree in built environment related discipline; AND
• Minimum 8 years’ post-degree proven working experience
in the building sector; AND
• Hold valid BEAM Pro (NB, EB, BI) qualification; AND
• Close technical involvement in previous BEAM/ BEAM Plus
project, i.e. has been involved in the submission of at least
one project targeting at Gold rating or above.

Qualification of BEAM Assessors (NB/EB/BI)

Route 2 – Veteran Scheme


• Full member of HKIA, HKIE, HKIS, HKIP and HKILA or
recognised equivalent
• At least 25 years’ proven working experience in the
building sector after obtaining the full membership; AND
• (a) Be a current BEAM Pro (NB, EB, BI) *, or (b) have
attended the BEAM Pro NB V1.2, NB V2.0, EB V2.0 and BI
V1.0 training.

Qualification of BEAM Assessors (ND)

• A degree in a relevant discipline (Planner, architect,


surveyor, landscape architect, civil or environmental
engineer and mechanical or electrical engineer)
• Full member of related professional institute
• At least 8 years’ post-degree experience relevant to the
planning and design of sustainable neighbourhoods.

Submission cut-off time

• Submission of materials for BEAM Plus Assessment received after 12:00


noon will be recorded and processed on the following working day.

• Special arrangement for a designated public holiday of more than three


(3) consecutive days (including Saturday and Sunday)

i. Cut-off time for submission of BEAM Plus Assessment materials


will be 12:00 noon on the day prior to the last working day
before the designated public holiday

ii. Submission thereafter will be taken as received at 9:00 am


immediately after the designated holiday

Procedures of Post-TRC Clarification

The Applicant will receive a Notification of the Assessment Result after the ASC
meeting. If their target rating cannot be achieved, a Post-TRC clarification will be
issued.

The Applicant shall choose either one of the following options and confirm their
choice to BSL within 5 working days from the date of issuance of the Notification of
the Assessment Result:

Option A:
i. Notify BSL their acceptance to proceed post-TRC and answer the list of questions
ii. Assessment report will be issued in 20 working days
iii. The performance time pledge will only count up to the issuance of the
Notification of Assessment Result

Option B:
i. Notify BSL the acceptance of the assessment result and not to proceed with the
post-TRC clarification
ii. The normal performance time pledge will follow

Review Mechanism

There is a 10-working day review period where the BAS and the Applicant can
resolve any differences and misunderstanding via BSL.

Upon the conclusion of the review, or upon the lapse of the 10-working day
review period, or upon the acceptance of the results by the Applicant, the
result will be forwarded to HKGBC for issuance of certificate or the “First
Stage PA Result Letter” which can be used for submission to BD to apply for
consent to commence work.

If the applicant is still dissatisfied with the assessment result after the review,
a further period of 10 working days will be allowed for the applicant to
lodge an appeal following the established Appeal Procedures.

Certificates are valid for 5 years from the date of their issue.

Certified projects are listed in a website database to indicate their client, location,
size, rating and validity period.

The certificate shall also expire when the tenant leaves the premises.

Upon certificate expiry, Applicants are encouraged to commission and submit

refurbishment alterations of their space as they occur.

Bespoke Mechanism

Aim
• To provide flexibility to the special building types which are not intended to
be covered under the current BEAM Plus tools.

Principles
• All Bespoke projects shall follow the objectives of BEAM Plus credits as far as
practicable.

• Relevant existing BEAM Plus credit requirements and benchmarks shall be


reformulated to suit Bespoke building type in question with justifications.

• Performance based assessment shall be applied.

Eligibility
a) Buildings with restricted access (e.g. military, prison, fire station, power
substation, airport, boundary crossing facility)

b) Buildings not normally occupied or for transient stay (e.g. pump houses,
sewage treatment plant, carpark building)

c) Buildings subject to specialised environmental control requirements (e.g.


museum, hospital, cultural performance venues, cinema, lab)

d) Heritage buildings with special constraints on alterations and additions

e) Any other building types not listed above subject to BSL’s acceptance
