infrastructure and the adoption of contemporary policing methods. The court emphasized the need
for greater accountability and professionalism within the police force to uphold the rule of law and
protect citizens' rights.
Court on its Own Motion v. Union of India 4 [(2016) 3 SCC 314]: This landmark case addressed
various issues related to police modernization, including the importance of enhancing investigative
capabilities through the use of advanced technology and forensic tools. The Supreme Court
emphasized the need for comprehensive reforms to strengthen law enforcement and improve crime
detection and prosecution.
Greetings of the day to one and all present here. I’m the speaker 1 and I stand in
favor of the motion that “AI and LAW: Power or Peril to the World”. Before
raising the debating points, I would like to say a quote that “The combination of AI
and human intelligence forms an indomitable alliance, a powerful force against the
darkness of criminal activity.” The introduction of Artificial Intelligence
technology has been beneficial for Criminal justice system in India. It has fastened
the pace of case disposal, deter and discover crime, improving research quality and
has brought transparency.
In many cases the Apex or the Supreme Court like “Own Motion v. Union of
India, People's Union for Civil Liberties v. State of Maharashtra, R. K. Malik
v. State of Haryana etc. addressed the issue of police modernization and the need
for technological advancements in law enforcement It emphasized the importance
of equipping police personnel with modern tools and technology to effectively
combat crime and ensure public safety.
AI can act as a portal for FIR, Surveillance for preventing crime, crime details,
crime prediction, crime control etc. for example Delhi witnessed highest number of
crime against women among any metropolitan area in 2021, so based on this fact
along with tracing daily number of cases registered of crime against women in
Delhi, AI can predict any specific area in Delhi after analysing all the past events
as well as present trends; AI can predict the specific timing of any particular crime;
as evidentiary value and provides history to the case. The Court believes that AI is
a mechanism which will help us to control or stop crime.
Law enforcement agencies are already unlocking the potential of AI in several
ways:
1) Face Recognition: Police officers use facial recognition to identify criminals
on the run and missing persons using image data. AI in law enforcement
promises greater accuracy than humans in matching faces and saves officers
time.
2) Predictive Policing: AI predictive policing refers to the ability to predict
where crimes will occur, the individuals who will commit them, the types of
crime, and who the victims will be. AI is also able to paint a better picture of
who is at risk for committing a crime, and who will likely re-offend once
released from prison based on data collected and analysis of historical
patterns.
3) Money Laundering cases: Through analyzing images, AI can pick out
counterfeit goods and counterfeit bills with a high probability of accuracy,
spotting details that the human eye may miss.
AI may still be new to the law enforcement community, so its applications have
not yet been fully realized. Nonetheless, it’s already making an impact in key
areas like surveillance, crime prevention, and crime-solving. AI also may
capture criminals that would otherwise go free, and solve crimes that would
otherwise go undetected.
Crime GPT, is an AI too which helps police forces with crime detection and
prevention. It is a gurugram- based startup which is hoping to help the police
with its AI-powered platform in tackinglng the crime. It works in a way like in
case a police officer is looking for a 21-year-old suspect who will be charged
with Indian Penal Code (IPC) Section 307 (attempt to murder), Crime GPT will
sift through the database, identify relevant records, and provide detailed
information of the suspect’s history, associated crimes, and even list police
stations with his recorded offences. It can help as an effective assistant. For
instance, some police forces do not have any platform. They can neither
perform facial recognition or nor an audio search. So today, the police have a
virtual assistant. the impact of this AI is already being felt across India, with
nine state police forces, including Uttar Pradesh, Bihar, Rajasthan, Haryana,
and Punjab, actively using the this platform. The response from the ground has
been overwhelmingly positive, with the demand for the technology spreading to
other states like Madhya Pradesh, Chhattisgarh, and Tamil Nadu. The
acceptance of AI in so many states and courts holding AI necessary is the base
to prove that AI does help in detecting crime and further in crime prevention.
