Sub: Requirement of Cable Tray Erection – reg.

=============================================
Kindly send us your competitive offer for removal of old MS cable tray and re-fixing & erection of
FRP cable tray with new support (with fabrication & painting) as per the scope of job given in the
Annexure-1 required for our SBU Performance Chemicals, at our Manali Works. The size and
quantity of the able trays to be erected as follows-

FRP Cable Tray (Width- 300X75 mm) : 200 mtrs

FRP Cable Tray (Width- 450X75 mm) : 150 mtrs

Your offer should be given in enclosed bid form in Annexure-1 duly signed with company seal with
a covering note in your letter head. In the Technical Specification form, you may confirm your
specifications against our requirement. The details of the vendors to be provided in Annexure- 2.

Your offer should be valid for a minimum period of 60 days for our acceptance from the due date
for submission of tender. The company reserves the right to reject any or all offers. The prices
should be firm till the completion of order.

Completion of Job: within 3 months from date of purchase/service order

LD Clause: For delay beyond committed schedule, LD will be charged @0.5% on total order value
subject to max 5% on total basic value.

The bids of any tenderers may be rejected if a conflict of interest between the tenderer and the
Company is detected at any stage

Statutory Obligations:
The Contractor on award of contract shall ensure compliance with all relevant statutory provisions
under the relevant labour laws viz. Minimum Wages Act (notified by Ministry of Labour,
Government of India), Contract Labour (Regulation & Abolition) Act, ESI (Employees State
Insurance) Act, Workmen's Compensation Act, Employees Provident Fund and Miscellaneous
Provisions Act (EPF & MP Act) and other applicable labour enactments as amended from time to
time in respect of personnel deployed by him in company's premises for the above job

The Contractor shall be solely responsible for all matters, including safety, welfare and disciplined,
in respect of personnel deployed by him in the company's premises and shall keep the company
indemnified thereof.

Arbitration Clause: If any dispute or difference arises between the Parties inter alia in respect of
the interpretation of this Agreement or of the rights or liabilities of either in respect of anything done
or omitted or to be done or omitted hereunder, the Parties shall endeavour to settle such dispute
amicably. If the dispute is not amicably resolved within a period of 30 (thirty) days from the date of
receipt of such notice by a Party, the dispute shall be settled by reference to the following for
resolving disputes:

Any dispute or difference arising under this Contract shall be referred under jurisdiction of Chennai
to a sole arbitrator to be appointed by the Chairman & Managing Director, Balmer Lawrie & Co.
Limited and the provisions of Arbitration and Conciliation Act, 1996 including any statutory
modifications or enactment thereof shall apply to the Arbitration proceedings. The fees of the
arbitrator, if any, shall be shared equally by both the parties. The award shall be a speaking award
stating reason therefor and is final and binding on the parties. The proceeding shall be conducted
in English language and courts at Chennai will have exclusive jurisdiction to settle any dispute
arising out of this contract

Validity: The offer must be kept valid for a minimum period of 60 Days from the date of opening
the offer

AWARD OF CONTRACT:
a. The lowest [L1] bid would be arrived on the basis of “Nett Delivered Price.
b. 100% order will be placed on the lowest (L1) quoted tenderer

PAYMENT TERMS:
30 days from submission of certified bill, upon completion of job. Any other credit term may be
clearly mentioned. Suitable adjustments will be made in arriving at the landed cost while price
comparison. Offers seeking advance payment before completion of job will not be
considered.

SECURITY DEPOSIT:
Successful tenderer will be required to pay Security Deposit equivalent to 5% of the Basic Value of
the Order within 15 days of issue of the Purchase Order by way of Demand Draft / Pay Order in
favour of ‘Balmer Lawrie & Co. Ltd., payable at Chennai at our No. 32, Sattangadu Village, Manali
Office, Chennai- 68

Cheque /Cash or any other forms of payment are not acceptable towards Security Deposit.
 The Security Deposit will not bear any interest.

 Security Deposit is liable for forfeiture, if

- Successful tenderer fails to complete the job tendered as per the contract
period.
- Successful tenderer violates the tender condition,
- Security Deposit will be refunded only after 3 months from successful
completion of the contract.

Terms if any not specified in offer will be considered as per our tender only.

Your detailed offer with a covering letter, filled in Annexure-1 along with Annexure-2 duly
signed and stamped with company seal, shall be kept inside an envelope duly sealed and
superscribed as “OFFER FOR CABLE TRAY ERECTION“ should reach the undersigned at our
Manali works on or before 27.11.2014. Please avoid sending your offer by fax/ e-mail.
