“AN ORDINANCE PROVIDING THE GRANT OF HONORARIUM TO SANGGUNIANG KABATAAN


OFFICIALS PURSUANT TO REPUBLIC ACT (RA) NO. 11768.”
WHEREAS, Section 4 of RA No. 11768, amending Section 16 of the SK Reform
Act of 2015 (RA No.10742), insofar as pertinent, provides the following:

The [SK] members, including the [SK] treasurer and secretary, shall
receive a monthly honorarium, chargeable against the [SK] funds, in
addition to any other compensation provided by this Act and shall be
granted at the end of every regular monthly [SK] meeting: Provided, That
the monthly honorarium shall not exceed the monthly compensation received
by their [SK]
chairperson: Provided, further, That not more than twenty-five percent
(25%) of the [SK] funds shale be allocated for personnel services. The DBM
shall issue the necessary guidelines implementing this provision. The
local government units [LGUs] may provide additional honorarium as well as
social welfare contributions and hazard pay to the [SK] chairperson and
the elected and appointed members through their own local ordinances:
Provided, That the honorarium as stated in this section shall be subject
to the post-audit jurisdiction of the [Commission on Audit] COA;

WHEREAS, Grant of Honorarium to SK Officials, Charged Against the SK


Funds:
In the performance of their duties enumerated under Sections 8, 14, and 15
of RA No. 10742, the SK Officials shall each receive a monthly honorarium,
chargeable against the SK funds, in addition to any other compensation
provided by RA No. 11768, and shall be granted at the end of the month.

Other compensation not authorized by the Act, such as Mid-Year Bonus,


Year-End Bonus, Clothing/Uniform Allowance, and other unauthorized
benefits/allowances, shall not be granted to the SK Officials.

WHEREAS, The SK chairperson automatically serves as an ex officio member


of the Sangguniang Barangay pursuant to Section 430 of RA No. 7160. He or
she enjoys the same privileges as the regular Sangguniang Barangay members
and he or she shall be entitled to a pro-rata honoraria for every session
of the Sangguniang Barangay he or she has attended.
As such, the SK chairperson shall no longer be entitled to receive any
honorarium charged against the regular SK funds, except those funded by
higher-level LGUs, subject to the limitations in Section 3.2 hereof.

WHEREAS, The amount of the monthly honorarium of the SK Officials shall be


subject to their attendance at SK meetings, deliberations, and official
activities of the SK.
WHEREAS, The monthly honorarium shall be pro-rated based on the actual
work and/or attendance vis-a-vis the work and/or meeting schedule or
performance standards as may be prescribed under the internal rules of the
SK concerned.

Whereas, The monthly honorarium of the SK Officials shall be monitored by


the Budget Monitoring Officer^ in a separate budget registry for Personal
Services (PS) and recorded in the appropriate registers being maintained
by the SK Treasurer. The amount to be allocated for PS shall not be more
than twenty-five percent (25%) of the SK funds. For this purpose, SK funds
shall refer to the: (i) ten percent (10%) of for the budget year; and (ii)
other funds accruing to the general fund of the SK, such as the proceeds
from their fund-raising activities pursuant to Section 8 (e) of RA No.
10742, as amended by Section 1 of RA No. 11768, provided that such
proceeds are not mandated to be used for specific program(s), project(s),
or purpose(s).

WHEREAS, the Local Government Unit shall establish adequate, effective and
enabling mechanism and support systems that will ensure meaningful
participation of the youth in local government and nation building.

WHEREAS, Republic Act of 10742 also known as SK Reform Act of 2015, there
is no such provision prohibit giving compensation, allowance to the SK
Secretary, SK Treasurer and SK Members.

WHEREAS, the Sangguniang Barangay of Brgy Muñoz, Catbalogan commended the


hard work and recognizes the nationalism and patriotism of the SK
Officials thru participating in local governance.

WHEREAS, based on the pronouncement made by the Supreme Court in Marquez


vs. COMELEC (G.R. No. 127318, 15 August 1999) and consistent with Art, 71,
Rule XIV of the Rules and Regulations Implementing R.A. 7160 which
include members of the Sangguniang Kabataan in enumeration of elective
barangay officials;

Article 71. Elective Local Officials – The elective Officials of


provinces, cities, municipalities and barangay are the following:
(a)Punong Barangay
(b)Members of the Sangguniang Barangay, and
(c)Members of the Sangguniang Kabataan

WHEREAS, Section 423 of the Republic Act No. 7160, also known as Local
Government Code of 1991 provides the composition of Sangguniang Kabataan
amended by the Republic Act 10742 also known as SK Reform Act of 2015
states that:

SECTION 7, Creation and Election of the SK – There shall be in every


barangay an SK to be composed of a chairperson and seven (7) members who
shall be elected by the KK, based on the COMELEC list of registered
voters.

The SK Chairperson shall, with the concurrence of the majority of


all the SK members, appoint from among the members of the KK, a secretary
and a treasurer.

WHEREAS, the Sangguniang Kabataan Officials honorarium is in Quarter


Basis.

WHEREAS, upon the motion of SK Member Hannah Mae Catienza and duly
seconded by the rest of the SK Member present, this resolution is hereby
approved.

WHEREAS, item 3.2.2 of the DBM-DILG-NYC JMC No. 1 series of 2019 provides
that for efficiency and economy purposes, it is strongly encouraged for
the SK to open and maintain a depository account in the same bank and
branch of the barangay;

WHEREAS, Section 393 of the Local Government Code of 1991 provides for the
benefits of the Barangay Officials.

SECTION 393. Benefits of the Barangay Officials –

(a)Barangay Officials, including barangay tanods and members of the


lupong tagapamayapa, shall receive honoraria, allowances and such other
emoluments as may be authorized by law of barangay, municipal or city
ordinance in accordance with the provisions of this Code, xxx xxxx xxx
Provided, however, That the Annual Appropriations for the Personal
Services shall be subject to the budgetary limitations prescribed under
Title Five, Book II of this code

NOW THEREFORE, BE IT ORDAINED:

SECTION 1. TITLE. – This Ordinance shall be known as an Ordinance giving


Compensation to Sangguniang Kabataan Officials of Barangay Muñoz,
Catbalogan City, Samar.
SECTION 2. SK Treasurer shall be entitled to receive monthly compensation
and allowance in the amount of Nine Hundred Pesos (Php 900.00) only.

SECTION 3. SK Secretary and all the SK Councilor shall be entitled to


receive monthly compensation and allowance in the amount of Seven Hundred
Pesos (Php 900.00) only.

SECTION 4. The honorarium shall be granted at the end of every regular


monthly Sangguniang Kabataan meeting, provided, that the Sangguniang
Kabataan Official is present at the said meeting.

SECTION 5. Appropriation. The amount necessary to carry out


implementations of this Ordinance shall be appropriated to be charged
against the current appropriation in the Personal Services and until the
availability of the said fund.

SECTION 6. Separability Clause. If any of this provision of the Ordinance


is declared unconstitutional or invalid, the remaining parts or provision
not affected shall remain in full force and effect.

SECTION 7. Effectivity. This ordinance shall take effect on May 16, 2023.

NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that a copy of


this resolution be furnished to Land Bank of the Philippines – Danao City
Branch for present and future reference.
RESOLVED FURTHER, that the copies of this resolution be furnished to the
office of DILG, and other offices as it may deem concerned.
RESOLVED FINALLY, that the above resolution valid and existing until
revoke or amended.

ADOPTED on this 16th day of May, 2023 in Barangay Muñoz ,Catbalogan City
Samar.

RESOLUTION APPROVING THE MONTHLY HONORARIUM OF SK MEMBERS,


INCLUDING THE SK TREASURER AND SK SECRETARY CHARGEABLE BY 25% OF SK
FUNDS PURSUANT TO REPUBLIC ACT (RA) NO. 11768.
WHEREAS, Section 4 of RA No. 11768, amending Section 16 of the SK
Reform Act
of 2015 (RA No. 10742), The [SK] members, including the [SK] treasurer
and secretary, shall
receive a monthly honorarium, chargeable against the [SK] funds, in
addition to any other
compensation provided by this Act and shall be granted at the end of
every regular monthly
[SK] meeting: Provided, That the monthly honorarium shall not exceed
the monthly
compensation received by their [SK] chairperson: Provided, further,
That not more than
twenty-five percent (25%) of the [SK] funds shall be allocated for
personnel services;
WHEREAS, The amount of the monthiy honorarium of the SK Officials
shall be
subject to their attendance at SK meetings, deliberations, and
official activities of the SK;
WHEREAS, The monthly honorarium shall be pro-rated based on the actual
work
and/or attendance vis-a-vis the work and/or meeting schedule or
performance standards as
may be prescribed under the internal rules of the SK concerned;
WHEREAS, The monthly honorarium to be received by SK Officials
shall not exceed
the rate equivalent to Salary Grade (SG) 9, Step 1 in the salary
schedule implemented by
the city or municipality/ where the barangay belongs;
WHEREAS, The monthly honorarium of the SK Officials shall be
monitored by the
Budget Monitoring Officer in a separate budget registry for Personal
Services (PS) recorded in the appropriate registers being maintained
by the SK Treasurer. The amount to
be allocated for PS shall not be more than twenty-five percent (25%)
of the SK funds. For
this purpose, SK funds shall refer to the: ten percent (10%) of the
general fund of the mother
barangay that is set aside for the SK for the budget year; and (ii)
other funds accruing to the
general fund of the SK, such as the proceeds from their fund-raising
activities pursuant to
Section 8 (e) of RA No. 10742, as amended by Section 1 of RA No.
11768, provided that
such proceeds are not mandated to be used for specific program(s),
project(s), or
purpose(s);
WHEREAS, The total honorarium to be included in the SK Annual
Budget shall cover
SK Officials, whether the SK position is filled or vacant;
WHEREAS, The grant of honorarium to SK Officials shall be included in
the
Comprehensive Barangay Youth Development Plan and Annual Barangay
Youth Investment
Program of the SK, and shall be subject to the SK planning and
budgeting process pursuant
to Department of Budget and Management (DBM)-Department of the
Interior and Local
Government (DILG)-National Youth Commission (NYC) Joint Memorandum
Circular No. 1, s.
2019 dated January 23, 2019" and DILG Memorandum Circular No. 2019-151
dated
September 10, 2019;
WHEREAS, The SKs are strongly advised to observe funding
priorities in the
determination of the amount of honorarium to be given to the entitled
SK Officials. It must be
understood that the SKs shall prioritize in the allocation of funds
the delivery and
implementation of local youth development and empowerment programs,
projects, and
activities (PPAs) pursuant to Section 20 (c) of RA No. 10742, as
amended by Section 6 of
RA No. 11768;
WHEREAS, The grant of honorarium to entitled SK Officials charged
against the SK
funds shall be subject to pertinent budgeting, accounting and auditing
laws, rules, and
regulations;
NOW THEREFORE, On the motion of SK Kagawad Hon. Xerxis Gregg
Gabia, duly
seconded by SK Kagawad Hon. Raniel Jay Arquita with the full consent
of all members of
the Sangguniang Kabataan present;
RESOLVED, as it is hereby resolved for the resolution approving
the monthly
honorarium of SK members, including the SK treasurer and SK secretary
chargeable by
25% of SK funds pursuant to Republic Act (RA) no. 11768.
RESOLVED FURTHER, that the copy of this resolution be furnished
to the offices
concerned for their information and ready perusal
HEREBY CERTIFY, to the correctness of the foregoing SK Resolutions No.
