IN THE HIGH COURT FOR THE STATES OF PUNJAB AND

HARYANA AT CHANDIGARH

Daljit Singh (Petitioner)

Versus

State of Punjab (Respondent)

Application under Section 482 Cr.P.C. for stay

on the arrest of the petitioner during pendency

of present petition.

RESPECTFULLY SHOWETH:

1. That the petitioner is working as

District Incharge of Newspaper Checkpost from

last two years and petitioner raised his voice

and exposed the corruption, mismanagement and

misdeeds of government officials and

politicians for their wrongdoings. So many

politicians and government officials are

inimical towards the petitioner. Because of


that the petitioner has been falsely implicated

in the above said case under vendetta politics.

2. That due to political pressure, on the

last date of hearing on 17-03-2023,

Investigating Officer Mewa Singh deliberately

did not submit the status report and is

misleading the Hon'ble Court by giving wrong

information that the petitioner has involved in

the other four FIRs. Due to which this Hon'ble

court has fixed the next date of hearing the

case on 05-05-2023. For a few days now, the

leader of the ruling party has been contacting

with the petitioner's colleagues for a

compromise under the conditions that petitioner

will not report any further news against them

and that they will cancel the current FIR.

3. That on 17-03-2023, Investigating

Officer Mewa Singh mislead this Hon'ble Court

by giving wrong information that the petitioner

has involved in the other four FIRs But in

fact, apart from the present case, there are

three false and baseless FIRs registered

against the petitioner, out of which the


challan has been submitted in two FIRs, the

details of those FIRs are as follows.

First FIR No: 97 dated 28-10-2017

Section 341,323,506,148,149 I.P.C. Police

station Kotwali Nabha in this FIR challan

is presented before the court of S.D.J.M

Nabha and no charges have been framed.

This case No. is CHI/86/2019 State versus

Daljit Singh and others which is pending

for the reply to the application under

section 178(8) Cr.P.C. for future

investigation. This false FIR was filed by

the complainant Manpreet Kaur who is the

wife of the petitioner's cousin. While on

28-10-2017 at around 9:30 am the

complainant along with her husband

assaulted her father-in-law, the

petitioner admitted his uncle Gurnam Singh

to Civil Hospital Nabha at 9:45 am for

treatment.
After that, the complainant

Manpreet Kaur admitted her husband

Harpreet Singh at 11 AM. Later, as part of

a conspiracy, a person named Surjit Singh

admitted the complainant Manpreet Kaur to

the Civil Hospital Nabha at around 12

noon. Police Station Kotwali Nabha Police

registered the said false FIR against the

petitioner and his family members based on

the statement of the complainant Manpreet

Kaur. And on the basis of the statements

of the petitioner's uncle Gurnam Singh,

cross FIR under Section 341, 323, 506, 34

IPC was registered against the complainant

Manpreet Kaur and her husband Harpreet

Singh In the said case CHI/87/2019 State

vs. Manpreet Kaur, the petitioner is an

eye witness.
Second FIR No. 45 dated 31-03-2020 against

the petitioner was registered under

Section 269,188 IPC at Police Station

Kotwali Nabha. At that time the petitioner

was working as President Punjab Pradesh in

Sarvajan Deshrakshak Sanghathan Delhi

(N.G.O.) and at that time Mr. Karan Avtar

Singh was the Chief Secretary Punjab.

Mr Karan Avtar Singh added the petitioner

as a facebook friend. On 26-03-2020 the

petitioner tagged him and posted a post on

Facebook with the petitioner and requested

him to report to the DGP Punjab. Issuing

instructions that police is beating

innocent citizens on the pretext of

curfew. On 31-03-2020 at around 2:30 PM,

the petitioner was outside in attempt to

deliver medicine to his pet dog, when Head

Constable Kulveer Singh stopped the

petitioner outside Police Station Kotwali

and took him to SHO Inspector Sarabjit

Singh and said that few days ago the

petitioner had complained to the Chief

Secretary Punjab against the police. The

SHO told the petitioner that you are


trying to act smart and becoming a big

social worker and complain against the

police. When the petitioner said that he

had not done anything wrong, on the orders

of the SHO, Head Constable Kulveer Singh

registered a false FIR against the

petitioner. In which the challan has been

presented and the said case is pending on

the prosecution evidence.

That the third false FIR No. 110 dated

24-08-2022 under Section 323, 341, 506, 34

IPC Police Station Kotwali Nabha against

the petitioner and his brother was

registered by Mewa Singh, the present

Investigating Officer. That on the night

of 13-05-2022, Jatinder Singh, the son of

the petitioner's uncle, abused the

petitioner under the influence of alcohol.

When the petitioner stopped him, he

entered the petitioner's house and

assaulted the petitioner. The petitioner

was taken to Civil Hospital Nabha for

treatment. Later, Jatinder Singh was also

admitted to the Civil Hospital Nabha,


despite the passage of many days, the

investigating officer Mewa Singh did not

register any FIR, on the contrary, he

asked me to compromise with Jatinder Singh

On 22-06-2022 an application No.

345/5P/DSP/Nabha was given to DSP Nabha to

take action against Jatinder Singh, but

the Investigating Officer Mewa Singh did

not register any FIR against Jatinder

Singh. He started telling the petitioner

that you have entered the house of

Jatinder Singh and assaulted him. If the

petitioner does not come to terms with

Jatinder Singh, he will register FIR

against the petitioner under section 458

of the IPC along with the assault clause.

The petitioner filed a blanket bail

application in the district court on 05-

08-2022 for fear of arrest. After which

investigating officer Mewa Singh

registered FIR No. 110 against the

petitioner on 22-08-2022 and Cross FIR

registered against Jatinder Singh.

According to the information of the

petitioner, no other FIR has been filed


against the petitioner but on 11-03-2019,

FIR No. 29 under section 406, 420 IPC and

13 of the Punjab Prevention of Human

smuggling Act 2012 were registered against

the three travel agents by the police

station Kotwali Nabha.

Later on this FIR was quashed by this

Hon'ble Court on the basis of compromise.

Perhaps the investigating officer Mewa

Singh is misleading the Hon'ble Court by

giving the details of that FIR .Due to the

present FIR, the petitioner could not

appear in the court of the Hon'ble SDJM in

the case of State vs. Daljit Singh, due to

which the Hon'ble court has started PO

proceedings against the petitioner and

case fixed for 21-04-2023

It is therefore most respectfully prayed that

the application may kindly be allowed in the

interest of Justice.
