FUNDAMENTAL RIGHTS
INTRODUCTION
The Fundamental Rights are a group of rights that have been
said as a high protection from encroachments . Fundamental
Rights are mainly found in a constitution or in a process of
law .
The Fundamental Duties are the legal responsibilities imposed
on the citizens . They are the moral responsibilities of all the
citizens in order to achieve prosperity and respect .
FUNDAMENTAL RIGHTS

The Fundamental Rights are an important organ of a democratic


society . These are those claims of the citizens which are
guaranteed and enforced by the State . These are present in Part
– III of the Indian constitution . These are also the basic rights
which are important for a person to progress in his/her life . It is
the duty of a state to ensure that these rights are not denied to
the citizens .
I. Reasons for inclusion of Fundamental
Rights

• The Fundamental Rights guaranteed by the Constitution


are corresponding to the International Covenant on
Civil and Political Rights {ICCPR} , 1996 .
• These are imposed on every Indian citizen irrespective
of their caste , race , color etc.
• These are also justiciable . They can also be filed in
High Court or Supreme Court if they are violated .
II. Characteristics of Fundamental Rights

• The Fundamental Rights are bestowed on every citizen of


India . They are universal rights .
• These are justiciable also i.e. a person can seek to the court
if they are denied to him/her .
• These can be only enjoyed till the time they don’t interfere in
someone else’s rights .
• In emergency , these rights can be suspended also .
III. Types of Fundamental Rights
• Right to Equality {Articles 14 -- 18}
• Right to Freedom{Articles 19 -- 22}
• Right against Exploitation {Articles 23 -- 24
• Right to Freedom of Religion{Articles 25 -- 28}
• Cultural and Educational Rights{Articles 29 -- 30}
• Right to Constitutional Remedies{Article 32}
WHAT ARE WE HAVING THIS LIBERTY FOR?
WE ARE HAVING THIS LIBERTY IN ORDER TO
REFORM OUR SOCIAL SYSTEM , WHICH IS FULL OF
INEQUALITY , DISCRIMINATION AND OTHER
THINGS , WHICH CONFLICT WITH OUR
FUNDAMENTAL RIGHTS.

FUNDAMENTAL DUTIES

The Fundamental Duties were added in the Indian constitution


through the 42nd Amendment of the Constitution {1976} , Part
IV {Article 51A} . This section enumerates 11 duties of Indian
citizens . The 11th Fundamental Duty was added through 86th
Constitutional Amendment Act , 2006 .
I. Reasons for inclusion of Fundamental Duties
• They will remind the duties of people towards their society ,
fellow citizens and their nation .
• They will inspire the citizens and promote a sense of
discipline and commitment among them .
• They help the courts in examining and determining the
constitutional validity of a law .
II. Characteristics of Fundamental Duties

• The Fundamental Duties contain both the moral as well as


civic duties .
• They are only confined to Indian citizenship and are not
imposed on the foreigners .
• They are also non – enforceable in nature . The government
cannot enforce legal sanction for their violation .
• They are the duties that are the codification of tasks integral
to the Indian way of life .
III. Different types of Fundamental Duties

• Abide by the Constitution and respect National flag and


National anthem .
• Follow ideals of the Freedom struggle .
• Protect sovereignty and integrity of India .
• Defend the country and render national services when called
upon .
• Spirit of common brotherhood .
• Preserve composite culture .
• Preserve natural natural environment .
• Develop scientific temper .
• Safeguard public property .
• Duty of all parents/guardians to send their children in
the age – group of 6 – 14 years to school .

FUNDAMENTAL RIGHTS
Life can be only balanced if rights and duties go hand to
hand . Rights are what we want from others and Duties are
what we should perform for others . In order to improve
rights , we have to perform certain duties which ought to
be performed by the citizens . A right comes with an
obligation to show respect for the rights of others .
For example --- Right to live in pollution free environment
is an implied right which comes under Article – 21 of our
Constitution . Article 51A , Clause g says that ; It is the
duty of every citizen to protect and improve the natural
environment . So , if the duty will be followed ; the right
will automatically come to the point .
Hence , it is clear and obvious that Fundamental rights and
Fundamental duties are complementary to each other .
EVERY RIGHT IMPLIES A RESPONSIBILITY ;
EVERY OPPURTUNITY , AN OBLIGATION ,
EVERY POSSESSION , A DUTY .
