Contract of Lease -Argao
RICARDO ORTEGA DELA PEÑA, Filipino, of legal age and a resident of Bogo, Argao
Cebu, hereinafter referred to as the LESSOR;
– and –
W I T N E S S E T H:
WHEREAS, the LESSOR is the absolute owner of a portion of a parcel of land situated
in Bogo, Argao Cebu (the LEASED PREMISES)
WHEREAS, the LESSOR agrees to lease-out the the foregoing leased premises to herein
LESSEE, and the LESSEE is willing to lease the same, under the following terms and
conditions:
1. That the lease shall be for a period of FIVE (5) years from January 6 , 2025 to January
6, 2030.
2. That the LESSEE shall pay monthly rental of TWELVE THOUSAND PESOS (P
12,000.00), Philippine Currency , payable every 25th day of the month;
3. That the LESSEE shall deposit to the LESSOR upon signing of this contract and prior to
move-in an amount equivalent to the rent for THREE (3) MONTHS or the sum of
THIRTY SIX THOUSAND PESOS (₱36,000.00), Philippine Currency, wherein the TWO
(2) months shall be applied as advance rent for the 1st two (2) months and the remaining
ONE (1) month equivalent shall be retained as deposit and will be returned only after the
LESSEE vacate the leased premises, after deducting the cost of repair for any
damage(s) of the property, if any.
4. That the utilities expense such as electric and water bills shall be for the account of the
LESSEE.
5. That the leased premises shall be devoted exclusively for pharmaceutical space only;
7. That all improvements to be made or introduced on the premises shall require the prior
consent of the LESSOR and that improvements that can no longer be removed by the
LESSSE shall become the property of the LESSOR;
8. That any expenses for repair arising from damage willfully and knowingly caused by the
LESSEE on the premises shall be shouldered by the LESSEE and any damage to the
personal effects of the LEASED PROPERTY and any LEASEHOLD IMPROVEMENTS
due to natural calamities like typhoon, earthquake and flood, the LESSOR shall not be
liable for such damages;
9. That the maintenance of the air conditioning units, cleaning service of water dispenser ,
replacement of busted electric bulbs and minor repairs shall be for the account of the
LESSEE;
10. That under no circumstance that the leased premises be subleased to any
other person or entity without the written consent and approval of the LESSOR;
11. That the LESSEE hereby agrees to return the leased premises at the expiration
of the contract in as good a condition as reasonable wear and tear will permit
without any delay whatsoever. That if said premises is not surrendered to the
LESSOR at the expiration of the lease contract, the LESSEE shall be
responsible to the LESSOR for all damages which the LESSOR may suffer by
reason thereof;
12. That in case the leased premises shall be abandoned, vacated or deserted for a
period of two (2) weeks, without any previous notice to the LESSOR and during
the time the LESSEE is in default in the payment of the monthly rental, then
under such circumstance the LESSOR can consider the leased premises as
legally abandoned and may enter the premises and take possession thereof
without prejudice to its right of action against the LESSEE;
13. That the LESSEE is obliged to observed cleanliness and maintain peaceful
condition inside and outside the premises. The use of prohibited drugs in the
premises is not allowed and the LESSOR has the right to terminate the contract
if found that the LESSEE is engaged in illegal activities, and will not be entitled to
refund of the two (2) month deposit;
14. That should the LESSEE decide to pre-terminate the contract before its
expiration, he should give one (1) month notice to the LESSOR. Thereafter, the
advance rental will be consumed by the LESSEE and the one month deposit will
be charged to unpaid electric and water bills and for any damages in the
property that needs repair;
15. That the LESSEE hereby warrants that he read and understood all the foregoing
provisions of this contract and shall abide by the same, otherwise, any violation
will subject the LESSEE to ejectment and other legal sanctions.
IN WITNESS WHEREOF, the parties have hereunto set their hands at the place first above written,

ACKNOWLEDGMENT
all known to me and to me known to be the same persons who executed the foregoing
instrument and they acknowledged to me that the same is their free and voluntary act and
deed in which they were PARTIES to.
This CONTRACT OF LEASE is consists of three (3) pages, including the page on
which this ACKNOWLEDGMENT is found, has been signed on the left margin of each and
every page thereof by the PARTIES and the instrumental witnesses.
