Role of Consumer Organizations and NGOs in Protecting and Promoting Consumer Interests

Consumer organizations and NGOs perform several functions for the protection
and promotion of consumer interest. These include :
 Consumer organizations and non-governmental organizations work consistently towards
providing education to the general public on the subject of consumer rights.
 They undertake the publication of periodicals and other publications to communicate about
varied issues of consumer interest.
 These organizations carry out comparative tests to ascertain the quality standards of different
types of consumer products in accredited laboratories and provide feedback.
 They need confidence and support from the grieved consumers to enable them to protest strongly
and take an action against the unscrupulous, exploitative and unfair trade practices of the
marketers.
 They extend legal assistance to consumers required for seeking legal justification through
guidance, legal advice etc.
 They also take initiative and file complaints in appropriate consumer courts on behalf of the
consumers.
 They may also initiate a legal procedure by filing a case in consumer courts in the interest of the
general public, not for any individual.
Who is the
Consumer ?

According to the Consumer Protection Act a consumer is

One who buys goods or heirs services for some


value.

Any use of such goods or beneficiary of services


with the approval of the buyer.

Anyone who uses the goods bought or services


hired for earning livelihood by self-employment.
Who can file a
Complaint ?

A complaint before the Appropriate Consumer Forum can be made by :


a) Any consumer.

b) Any registered consumers association.

c) The Central government or state government.

d) The central authority.

e) In case of the death of a consumer, his legal heir or legal representative.

f) One or more consumers on behalf of numerous consumers.

g) A legal heir or representative of a deceased consumer.


Against whom a
complaint can
be filed ?
a) The seller, manufacturer or dealer of
defective goods.
(‘Defect’ means any fault, imperfection or
shortcoming in the quality, quantity or
purity of goods).

b) The provider of services if they are


deficient in any manner.
(‘Deficiency’ means any imperfection,
shortcoming or inadequacy in the quality,
nature and manner of performance of
services).
Following persons are not considered a
consumer under Consumer Protection Act 2019
a) The person who obtains goods for resale.

b) The person who uses the goods without the approval of


the buyer.

c) The person who avails of the services without the


approval of the buyers.

d) The person who obtains goods without any consideration.

e) The person who hires or avails of any services without


consideration.
