RE: NOTICE/REPORT/WARNING BY HON. EKE UDENSI (FAMILY HEAD) AND
UBA IGWE THAT NO. 4 UMUIKPO BY EZE NWAGBARA IN OSISIOMA NGWA
LOCAL GOVERNMENT AREA OF ABIA STATE IS NOT FOR SALE AS THE
PROPERTY IS A FAMILY LAND
We act as solicitors to Mrs. Rose IGWE of No. 4 Umuikpo by Ezenwagbara,
Ariaria, Aba, Abia State, Nigeria hereinafter referred to as Our Client and on
whose instruction we write as follows

1. That the attention of our client has been drawn to your letter dated 9th
day of September 2024 written to His Royal Highness, the Eze of
Umuikpo in Osisioma Ngwa L. G. A and copied Our Client on the above
subject.
2. Our Client has referred the said letter written on behalf of Hon. Eke
Udensi and Uba Igwe to us for necessary action.
3. Our Client informed us that the property known as and called No. 4
Umuikpo by Ezenwagbara Ariaria Aba, Abia State is neither a family
property nor that of Hon. Eke Udensi and Mr. Uba Igwe, rather it is
absolutely owned by Late Mr. Daniel Igwe who died in 2021 which
property by devolution of powers is now the property of his widow – Mrs.
Rose Igwe and her four surviving male children namely Divine Daniel,
Nkemdirim Daniel, Ugochukwu Daniel and Emmanuel Daniel.
4. The instruction of Our Client is that the land in dispute was bought by
her Late husband before the said sale of her late father in-law’s
bungalow at Alaukwu Village, Osisioma L. G. A of Abia State and neither
your clients nor any of their family members were signatories to the
document evidencing the purchase transaction of the land in dispute.
5. Our Client view the claim of your clients as ridiculous in the sense that
it is laughable for them to claim that their Late father’s uncompleted
bungalow (neither plastered nor painted, having wooden doors and
windows, not tiled, having pit toilet and located in an interior village of
Alaukwu) was sold, then the proceeds was enough to purchase land in
heart of the town as Ariaria and also complete the building of an upstair
of four flats with modern appurtenances. Their claim is Dead on Arrival
(DOA).
6. Our Client’s instruction is that after the death of her husband, your
clients attempted claiming her Late husband’s house (through their
obnoxious custom/tradition of inheritance by “IKWU NNE” (which is
repugnant to natural justice, equity and good conscience) but they did
not succeed. Since then, they have been scheming on how to claim the
house, hence, this concorted story of selling three uncompleted rooms
to purchase land and build an upstair of four flats with modern
appurtenances in a place such as Ariaria.
7. Our Client informed us that her Late husband never informed her that
the proceeds from the sale of her Late father in-law’s house was used to
build the house in dispute rather he informed her that he (Mr. Daniel
Igwe had arrangements with their Late mother, Mrs. Virginia Igwe) to
inject the proceeds of the sales into business, bring his poor siblings to
town, feed and maintain them and their mother, train them in business
and open shop for them.
8. It is the instruction of Our Client that ownership of the property known
as and called No. 4 Umuikpo by Ezenwagbara, Ariaria Aba was never in
dispute during the lifetime of her Late husband and her husband was in
full control, collecting rents from his tenants and after his death, Our
Client has continued to collect the rents from the tenants without any
encumbrance until the attempts by your clients.
9. Our Client informed us that the character of your clients in contesting
ownership of her husband’s property is an abuse of her Late husband’s
kindness and large heartedness in bringing his family members under
his roof and may not hesitate to activate lawful means to eject them
therefrom.
10. Given the above, Our Client instructed us to inform you to give wise
counsel to your clients for them to immediately withdraw their notice
dated 9/9/2024 and tender an unreserved apology to her or be prepared
for the legal consequences of their actions.
