The Applicant respectfully states as under:

1. That this suit is vitiated by the defect of misjoinder of defendants and cause of action and
unless the defect is removed, the suit must fail.
2. That plaintiff prays that he may allowed to withdraw the claim in respect of plot no 4 against
the defendant no 2 with permission to institute a fresh suit in respect of said plot against the
