(Under Section 96 of the Civil Procedure Act Cap 282, Order 5 Rule 1(2) and
Rule 32 of the Civil Procedure Rules SI-7-1)

LET ALLL PARTIES CONCERNED attend the Learned D/REGISTRAR on the___ day
of______20___ at______O’clock in the fore/afternoon or soon thereafter as Counsel for the
Applicant can be heard on the application for orders that:

i. An order doth issue extending the time within which to serve the
summons to file defense in CIVIL SUIT 025 OF 2025.
ii. The costs of this Application be provided for.

TAKE FURTHER NOTICE that the grounds upon which this application is based are
contained in the affidavit in support of LUMBUYE JAMADA which shall be read and
relied on during the hearing of the Application but briefly they are;
a) That Applicant filed CIVIL SUIT NO 025 OF 2025 on the 10TH day of
December 2024.
b) That the summons to file defense was issued and endorsed on the 15TH
day of December 2024 and uploaded on the court electronic filing
system, ECCMIS.
c) That on the 15th day Of January 2025, the applicant checked on
ECCMIS And discovered that summons to file defense were issued on
the 15th Day of December 2024 and that the time for effecting service of
the summons to file defense had already expired.
d) That it is therefore just, fair and equitable that this application for Order
of extension of time within which to serve the summons to file defense
be granted.

AFFIDAVIT IN SUPPORT

I LUMBUYE JAMADA of C/o M/S FIRM A1 ADVOCATES, LDC KAMPALA CAMPUS,


KAGUGUBE ROAD, KAMPALA so solemnly swear and state as follows;

1. That I am male adult Ugandan of sound mind, the applicant and depone this
affidavit in support in that capacity.

2. That the on the 10th Day of December 2024, CIVIL SUIT 025 OF 2024 was filed
in this honorable court. (A copy of the plaint is attached and marked “A”)

3. That the on the 15th Day of December 2024, summons to file defense was issued
and endorsed by this Honorable Court. (A copy of the summons to file defense
is attached and marked “B”)

4. That on the 15th Day of January 2025, I was informed by my lawyers of M/S FIRM
A1 Advocates that summons to file defense had been issued and endorsed and
the same had expired.

5. That I was informed by my lawyers of M/S FIRM A1 Advocates which information


I verily believe to be true that the time within which to effect service of court
process of the summons to file defense had expired on the 5th Day of January
2025 and could as such not be served onto the defendant in civil suit 025 of 2024.

6. That I had never been made aware that summons to file defense had been issued
or endorsed. Prior to the 15th Day of January 2025.

7. That I have been advised by my lawyers of M/S FIRM A1 ADVOCATES which


information I verily believe to be true that mistake of Counsel should not be visited
on the applicant.

8. That I was informed by my lawyers of M/S FIRM A1 ADVOCATES which


information I verily believe to be true that an application for extension of time within
which to effect service of summons to file defense must be filed in this honorable
court seeking orders to extend the time within which to serve summons to file
defense.

9. That it is therefore just, fair and equitable that the application seeking orders to
extend time within which to serve summons to file defense be granted.
10. That I swear this affidavit in support of the above application for extension of time
within which to effect service of summons to file defense.

11. That whatever is contained herein is true and correct to the best of my knowledge
and belief, save for information whose source is disclosed herein.
