Dear Sir,
We are now informed by our Client, that the Alagbeji Family have now
engaged another Developer to re – built the property which led to the
demolition of the present building on the 29th November, 2024.
According to our Client, there is no pre – notice from the Family to our
Client in respect of engaging another Developer “The Ruwfar Enterprises”
who we understand make all the moves on how the present building was
demolished on the 29th of November, 2024.
Sir, is our understanding that before any steps can be taken in respect of the
property situate, lying and known as No. 16/18 Alagbeji Street, Isale – Eko,
Lagos State, our Client should be given proper notice on any steps about to
be taken as our Client Lease Agreement is still pending which still have
about four (4) years to expire.
We want to acknowledge that our client was given a letter dated the 7th day
of June, 2024 from Lagos State Building Control Agency (LASBCA) in respect
of request to conduct a non – destructive integrity test on the distressed
structure at 16, Alagbeji Street, Lagos Island, Lagos State and immediately
our client moved into action by contracting the Lagos State Materials
Testing Laboratory and was given the costs for the Non – Destructive,
Stability and Integrity Test dated the 10th day of June, 2024.
Sir, after our Client investigation at the Lagos State Building Control Agency
(LASBCA) on showing them the report dated the 13th June, 2024
STF/NDT/13/06/2024/1017 prepared for RUWFAR ENTERPRISES, we are
told that the report is not from their office at all.
Sir, we want to states that the Alagbeji Family have the right to engage
another Developer to help the family to re – develop their property but this
will come after the expiration of the existing lease agreement agreed by the
parties in 2015 which to our own calculation will expire on the 30th day of
September, 2027.
It is our client instruction to demand for the sum of Seventy – Five Million
Naira (N75,000,000.00) which is the amount our client will realize from the
un – expire lease period of three (3) years from November, 2024 to 30th of
September, 2027 as it is very clear and obvious that your family unilaterally
terminated the Lease Agreement but the parties as you have now transfer
the property to RUWFAR ENTEPRISES without first offering our client
option to redevelop the property and not allowing the Lease Agreement to
expire before given another Developer to re develop the property.
Lastly sir, since our Client lease period is still subsist which we understand
will expire on the 30th September, 2027 and it is our Client believe that the
property and structure developed by our Client was demolished illegally
and not according to the Rules and Regulations of Lagos State Building
Control Agency (LASBCA) without any notice to our Client and all the
tenants put in by our client, we demand on behalf of our client in the sum of
SEVENTY FIVE MLLION NAIRA (N75,000,000.00) as our Client is the
Developer in respect of the Building situate, lying and known as No. 16/18
Alagbeji Street, Isale – Eko, Lagos State.
We shall be expecting your response to this our Letter on or before the 30th
day of December, 2024, Otherwise our Client shall take necessary and
lawful steps to protect their interest in respect of the Building.
