PETITION FOR BAIL FILED U/S 437 OF Cr.P.C , U/S 480 OF B.N.S.S

The address for service of all notice on the petitioner is that of his
counsel M/S. T.ASOKAN, A.NETHRA Advocates having office at No.14 Thiru
Nagar,yercaud main road, Hasthampatty, Salem District. The address for
service of all notice on the respondent is as stated above.

1. The Petitioner/Accused herein has been charged for an offence


under section. 296(b), 121(1), 118(1), 132, 351(3) of BNS Act, 2023. The said
occurrence said to have taken place on 22.01.2025 at about 16.30 Hrs and the
FIR was registered on the same day at about 20.40 hrs. The Petitioner/Accused
has been remanded to judicial custody on the same day.

2. The Petitioner /Accused submits that the case of the prosecution is that
the S.I. of Police attached to the respondent police herein received a written
complaint from the de-facto complainant one Sivashanmugam , the Shristrar at
Karaikal Court , through the special court police SGHC 3140 one Vivek.

The Complaint is as follows: The De-facto complainant while he was in his duty,
a female aged about 45 years(the accused herein) at about 12.00 P.M abused
the staffs working in Judicial Magistrate No.1 Karaikal, in filthy language and
by recording the court procedures via mobile phone and thereby she caused
nuisance and disturbance to the court functioning. Later she was removed
from that place with the help of the guard presented. Further, at about
4.30 P.M she(the accused herein) repeated the same by abusing with filthy
language and even tried to attack the staffs and threatened them with dire
consequences. Further, when tried to move her from the said place she bite
the female guard one Jayachitra and also removed the batch wore by
her.Based on the written complaint received respondent police registered the
case in Cr.No.21 of 2025 for an offence under section 296(b), 121(1), 118(1),
132, 351(3) of BNS Act, 2023. This is the Gist of the F.I.R.

But the fact remains that the petitioner is an innocent. She has
completed M.Com and did not get any suitavle job for her livelihood.She is
deeply under the depression and not in a normal state of mind. She had
undergone a divorce and for the past many years she is living in a depressed
state of mind. She was under the custody of her father. Since her father died
few years back, she could not be able come of the depression and undertaking
treatment for the same. She has two children who are pursuing their
undergraduation and post graduation. She did not receive any monetary
support from her ex-husband. This deeply hurted her and she is unstable.

3. The Petitioner/Accused submits that she is innocent.

4. The Petitioner/Accused submit that she will abide by any condition


imposed by this Hon’ble court for her release and also undertakes to furnish
sufficient Solvent sureties for her release.

5. The Petitioner/Accused this is the first bail petition filed before this Hon’ble
court and no similar bail petition is pending before this Hon’ble court or any
other court.

Hence, it is prayed that this Hon’ble Court may be pleased to enlarge The
Petitioner/Accused on bail in connection with the Crime. No. 21 of 2025
pending investigation on the file of the respondent Police and thus render
Justice.
