Subject: Directions under section 31 (A) of Air (Prevention and


Control of Pollution) Act, 1981, read with Rule 20 (A) (6) of the Air
(Prevention and Control of Pollution) (Union Territories) Rules,
1983, to enforce strict ban on construction activity in GNCTD in
terms of the direction dated 29.10.2022 issued by Commission For
Air Quality Management in National Capital Region and Adjoining
Areas, in pursuance of the Revised Graded Response Action Plan
(GRAP).

Whereas, Central Pollution Control Board is the State Board for all the
Union Territories to exercise powers and performs functions under the Air
(Prevention & Control of Pollution) Act, 1981.
And whereas, Central Pollution Control Board has delegated all its
powers and functions under Air (Prevention and Control of Pollution)
Act, 1981 in respect of NCT of Delhi-to-Delhi Pollution Control
Committee vide Notification No. S.O. 198(E) dated 15.03.1991.

And whereas, the whole Union Territory of Delhi has been declared as
an Air Pollution Control area, under sub section (1) of section 19 of the
Air (Prevention & Control of Pollution) Act, 1981 vide notification no.
GSR 106 (E) dated 20.02.1987.
And whereas, Delhi faces grave air pollution particularly in winter
season and level of pollutants like Particulate Matter Concentration
(PM2.5 and PM10) goes much beyond the prescribed standards for
Ambient Air Quality.
And whereas, the Commission for Air Quality Management in NCR
and adjoining areas has repeatedly taken up the matter relating to air
pollution with Government of NCT of Delhi and various organizations
and has issued various Directions, Advisories and Orders for effective
implementation of measures for abating air pollution in NCR from time to
time.

And whereas, Commission For Air Quality Management in National
Capital Region and Adjoining Areas (CAQM) issued revised Graded
Response Action Plan (GRAP), vide directions dated 05.08.2022.

And whereas, as per the dynamic model and weather/ meteorological


forecast, the overall air quality over Delhi is likely to remain in Very Poor
to Severe category from 29.10.2022 and 30.10.2022. The air quality is
likely to deteriorate and remain in Severe category from 31.10.2022 to
01.11.2022 and for the subsequent 6 Days, the air quality is likely
to fluctuate between Severe to Very Poor category.
And whereas, the winds are forecasted to be calm in the coming days
and the wind direction is likely to change course frequently. Thus, there is
a high likelihood of the pollutants getting trapped in the region and not
getting dispersed effectively.
And whereas, in the wake of deteriorating air quality of the National
Capital Region, the Sub-Committee for invoking actions under the
Graded Response Action Plan (GRAP) of the CAQM held an emergency
meeting on 29.10.2022; and the Commission while comprehensively
reviewing the overall air quality parameters noted that due to
unfavourable meteorological conditions with slower wind speed and
sudden spike in the farm fire incidents, it is considered necessary to
implement Stage III of GRAP with immediate effect in the entire NCR.
And whereas the following action on construction and demolition
activities is one of the crucial actions envisaged and invoked under the
Stage III of GRAP for strict implementation:

(I) Enforce strict ban on construction and demolition activities in the entire
NCR, except for the following categories of projects:
a) Railway services / Railway stations
b) Metro Rail Services including stations.
c) Airports and Inter State Bus Terminals.
d) National security/ defence related activities/ projects of
national importance;
e) Hospitals/ health care facilities.
f) Linear public projects such as highways, roads, flyovers, over bridges,
power transmission, pipelines etc.
g) Sanitation projects like sewage treatment plants and water supply
projects etc.;
h) Ancillary activities specific to and supplementing above categories
of projects.

Note: The above exemptions shall be further subject to strict compliance
of the C&D Waste Management Rules, dust prevention/ control norms
including compliance with the directions of the Commission issued from
time to time in this regard.
(II) Other than the projects exempted under (I) above, dust generating/ air
pollution causing C & D activities to be strictly banned during this period
shall include:
∙ Earthwork for excavation and filling including boring & drilling
works.
∙ All structural construction works including fabrication and welding
operations.
∙ Demolition works.
∙ Loading & unloading of construction materials anywhere within or
outside the project sites.
∙ Transfer of raw materials either manually or through conveyor belts,
including fly ash.
∙ Movement of vehicles on unpaved roads.
∙ Operation of batching plant.
∙ Laying of sewer line, waterline, drainage work and electric cabling
by open trench system.
∙ Cutting and fixing of tiles, stones and other flooring materials.
∙ Grinding activities.
∙ Piling work.
∙ Water Proofing work.
∙ Road construction/ repair works including paving of sidewalks/
pathways and central verges etc.

(iii) For all construction projects in NCR, non-polluting / non-dust


generating activities such as plumbing works, interior decoration, electrical
works and carpentry related works shall be permitted to be continued.

Now, therefore, in view of the above and in exercise of the powers


conferred under Section 31(A) of Air (Prevention and Control of
Pollution) Act, 1981, read with Rule 20 (A) (6) of the Air (Prevention
and Control of Pollution) (Union Territories) Rules, 1983, and keeping
in view the need in public interest to curb severe air pollution in Delhi,
Delhi Pollution Control Committee hereby directs implementation and
enforcement of the strict ban on construction and demolition activities
except for exempted categories and activities, without any default and
demur, whenever the Stages III and IV of GRAP are in force.

Compliance of the above direction shall be emailed at [email protected] and
[email protected] during the GRAP period without fail.

The list of construction and demolition projects covered under the


exempted categories of projects shall be emailed at [email protected] and
[email protected] on or before 02.11.2022.

The violation of the directions issued under Section 31(A) of the Air Act,
1981 shall be punishable under Section 37 of the said Act which includes
imprisonment upto Six years and fine.
