III. MATTERS INVESTIGATED
3. To determine the facts of the circumstances surrounding the shooting incident
that transpired at about 2:15 in the afternoon of January 28, 2024 at San
Nicolas, Baao, Camarines Sur.
4. To determine who are the person/s liable.
IV. FACTS OF THE CASE
5. On January 28, 2024, at around 3:00 o'clock in the afternoon, I received a call
from PRINCESS GAILE DAZA, the principal of Baao, Central School, informing
me that one of her students named, Princess Mae Serrano (Princess Mae, for
brevity), was being rushed to the Sta. Maria Josefa Hospital due to a shooting
incident that was transpired at that time;
6. Me together with Pat. Begino and PCpl. Auxillo both assigned police officers
of the station immediate went to the said place.
7. When we arrived at the scene of the crime, me and my team conducted an
investigation with regard to the incident and assess whose persons were
involved in the incident.
 8. During the conduct of our interview, Mr. Josue Nuda, the security guard on
duty, saw what happened. According to Mr. Nuda, at around 2:15 in the
afternoon he heard gunshots near the school premises. He saw Ronel Baal
and Joven Labilles chasing a man while wielding their guns. He also heard
Chanda Beringuela, one of the students in the school and a friend of the victim,
shouting for help because her (Princess Mae) friend’s chest was bleeding.
Seeing the situation , he immediately assisted the victim and told Chanda to
ask for assistance to the school principal;

9. Later on, we conducted also an interview Chanda (Princess Mae's friend and
classmate). Chanda narrated that after their classes, she was playing with
Princess Mae in the school grounds when they heard shouts and loud noises
coming from one of the buildings near the school. They were curious and went
outside the gates of the school to observe. On their left, they saw a man
running away from Ronel Baal and Joven Labilles towards their direction. They
saw them firing their guns towards the man that they were chasing. However,
Princess Mae suddenly fell down. She heard Princess Mae crying and holding
her chest and asking for help since her chest was bleeding. Mr. Nuda saw
them, she was told by the latter to inform their principal regarding the incident.

10. Princess Gaile Daza, the school principal was also interviewed. She averred
that on the time of the incident, the School’s Division Office forwarded a
memorandum that the classes in the afternoon are until 2:00 in the afternoon
due to the high heat index. However, Chanda one of the students in the school
informed her that Princess Mae chest's was bleeding. She called up the
attention of the MPS Baao and ambulance in order for Princess Mae be
brought to the hospital. However, the latter was declared dead on arrival
evidencing by the Medico-legal report of Dr. Chua.

11. After the investigation, we were able to recover several slugs and casings
through the help of the PNP SOCO team such were mentioned in the SOCO
Investigator Report;
12. Based on the investigation report dated January 29, 2024, the investigator on
case sufficiently believes that the proximate cause of the death of Princess
Mae. Jose Nuda and Chanda Berenguela the eye witnesses positively pointed
Ronel and Joven as the suspects. Therefore, the suspects are liable for
Homicide.

V. DISCUSSION

13. Under Article 249 of the Revised Penal Code, the elements of HOMICIDE are
 a. that a person was killed;
b. the offender killed him without any of the justifying circumstances, and
c. that the offender killed another without the attendance of any of the
qualifying circumstances of murder.

14. Based on the foregoing facts, all elements of HOMICIDE are present. First, the
person was killed. In this case, Princess Mae was killed by gun shots made by
the respondents. Second, there was an intent to kill in the part of the suspects.
Well settled is the rule that, criminal liability incurred by any person committing
a felony although the wrongful act done be different from that which he
intended. Lastly, the respondents killed the victim without any justifying and
qualifying circumstance of murder.

VI. RECOMMENDATION
15. A case for Homicide be filed against the respondents.
