May I have the honor to refer to you for your evaluation and disposition a
complaint of Murder (Under Article 248 of the Revised Penal Code), wherein the
suspects are:

1. Mayor Ronaldo Pepino y Cruz, 40 years old, married, incumbent Mayor


of Kabayo City and presently residing at Harmony Compound San Simon
Kabayo City (Under Custody);
2. Anthony Tan y Carodan, 41 years old, married, driver security and
presently residing at Sitio Broadway Painuman Kabayo City (Under
Custody);
3. Jack Vergara y Alonzo, 46 years old, married, close-in security and
presently residing at Banico St. Brgy. Dela Paz Kabayo City (Under
Custody);
4. Marvin Gulapa y Pena, 38 years old, married, close-in security and
presently residing at 5 hectares Sitio Tagumpay Kabayo City (Under
Custody);
5. Jay Santos y Malik, 40 years old, married, close-in security and
presently residing at Sitio Tabing Ilog Brgy Bagong Nayon Kabayo City
(Under Custody);

VICTIM:
1. PCPT LABRADOR TIRADOR y SY, 36 years old, married, PNP
member, presently assigned as Chief of Police of Kabayo City Police
Station and presently residing at 44 Yellowbell St. Kingstown Subdivision
Kabayo City (Deceased).

FACTS OF THE CASE:

Initial investigation disclosed that at about 02:00 o’clock in the afternoon of


March 15, 2021, Elements of Kabayo City Police Station Team Led by PCPT
LABRADOR TIRADOR while conducting a Checkpoint (OPLAN SITA) in front pf
Mang Vic’s Bulaluhan Bypass Road Brgy Kiskisan Kabayo City, the team flagged
down a Montero Sport SUV silver bearing plate number NAL 1889 driven by Anthony
Tan y Carodan with 4 others onboard including Mayor Pepino suddenly before
reaching the checkpoint, the said suspects with treachery and intent to kill open fire
while inside the vehicle towards the location of PCPT TIRADOR, and tried to fled
afterwards, however, elements of the checkpoint had chance to retaliate resulting in
an armed encounter which lasted in fifteen (15) minutes, right there and then the
suspects were manageably arrested. The victim sustained five (5) gunshot wounds
on his head and body and was rushed to Kabayo City Medical Center for medical
treatment but pronounced Dead on Arrival (DOA) by the attending physician. SOCO
Team led by PCPT YVES S GUARINO arrived and processed the crime scene.
Collected pieces of evidence were fifteen (15) pieces fired cartridge cases of
caliber.45, ten (10) fired cartridge case of caliber 9mm, four (4) caliber .45 pistols,
one (1) Mitsubishi Montero Sport bearing plate number NAL 1889 - colored Silver.
Whereas, the issued firearms of involved PNP personnel were turned over to the
SOCO team for Ballistics Examination. Cursory examination at the cadaver of the
victim PCPT LABRADOR TIRADOR showed that he sustained one (1) gunshot
wound on the head and four (4) gunshot wounds on the chest. The cadaver of the
victim was moved to PNP Crime Laboratory for autopsy. Case held under
investigation and follow-up.

The suspects, after having been informed of their constitutional rights, refused
to give any written statement. However, the suspects were positively identified by the
witnesses during the confrontation are the one responsible in the particular incident.
