ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into this ___ day of

1. JUANA L. CORDERO, widowed, Filipino, of legal age, and with


current residence address at Brgy., 01, Lipa City, Batangas, hereinafter
referred to as the HEIR/SELLER;

2. CAROLYN CORDERO OLVIDO, married to BENJAMIN


HIBIONADA OLVIDO, Filipino, of legal age, and with current
residence address at Bacood St., Sta. Mesa, Manila, hereinafter referred
to as the HEIR/SELLER;

3. MYLENE CORDERO CRUZ, married to CHRISTOPHER DE


GUZMAN CRUZ, Filipino, of legal age, and with current residence
address at Bacood St., Sta. Mesa, Manila, hereinafter referred to as the
HEIR/SELLER;

4. GILBERTO JEON CORDERO JULIAN, married to LARA MELISSA


INDICIO JULIAN, Filipino, of legal age, and with current residence
address at M.K. Lina St., Lipa City, Batangas, representative of the late
ANNALYN CORDERO JULIAN, the daughter of DIONISIO P.
CORDERO, hereinafter referred to as the HEIR/SELLER; and

5. SPOUSES ARNULFO EGAMA RUSSELL AND GEMMA ANDAYA


RUSSELL, Filipinos, both of legal age, and with current residence
address at Unit 1113, Adria Tower, Tierra Lorenzo Condominium,
Altamirano Street, Brgy., Mataas na Lupa, Lipa City, Batangas,
hereinafter referred to as the BUYER;

WITNESSETH THAT:

WHEREAS, we are the heirs of the deceased DIONISIO P.


CORDERO who died on _______________________, at
_____________________________, copy of his/her death certificate is hereto
attached as Annex A;

WHEREAS, DIONISIO P. CORDERO died intestate, without Will or


Testament, and without any outstanding debts in favor of any person or
entity;
WHEREAS, DIONISIO P. CORDERO is the absolute and registered
owner of a parcel of land situated in Brgy., San Felipe, Cuenca, Batangas,
covered by Tax Declaration No. 08-0020-01018 and Transfer Certificate of
Title No. T-97664 containing an area of containing an area of FIVE
HUNDRED SEVENTY SEVEN (577) square meters, more or less, and more
particularly described as follows:

being a portion of Lot 2345-C-2, Psd-04-090690, L.R.C. Record No., situated
in the Barangay of San Felipe, Municipality of Cuenca, Province of
Batangas, Bounded on the NE., along line 1-2 by Lot 2345-C-2-G, (Alley);
on the SE., along line 2-3 by Lot 2345-C-2-E, both of the subdivision plan;
on the SW., along line 3-4 by Lot 2345-C-1, Psd-04-090690; on the NW.,
along line 4-1 by Lot 2345-C-2-F of the subdivision plan. Beginning at a
point marked on plan, being S. 43 deg. 55’W., 1765.61 m. from BLLM No. 1,
Cad-610-D, Cuenca Cadastre. thence S. 2 deg. 28’E., 16.15 m. to point 2;
thence S.82 deg. 39’W., 35.13 m. to point 3; thence N. 7 deg. 01’W., 16.15. m
to point 4; thence N. 82 deg. 44’W., 36.40m. to the point of beginning,
containing an area of FIVE HUNDRED SEVENTY SEVEN (577) SQUARE
METERS. All points referred to are indicated on the plan & are marked on
the ground by PS. cyl. conc. mons. 15 x 60 cm.; bearings true; date of
original survey, Nov. 1978 – Sept. 1, 1979 and that of the subdivision
survey, June 20, 1997 and was approved on Dec. 1, 1997.

WHEREAS, pursuant to Rule 74, Section 1 of the Rules on Special


Proceedings and with full capacity to contract, we do hereby adjudicate unto
ourselves the parcel/s of land described above, in equal shares.

FURTHER, FOR AND IN CONSIDERATION of the sum of


NINE HUNDRED THOUSAND PESOS PHILIPPINE CURRENCY
(PHP900,000.00) the receipt whereof is hereby acknowledged in full sum
from SPOUSES ARNULFO EGAMA RUSSELL AND GEMMA ANDAYA
RUSSELL, Filipinos, both of legal age, and with residence address at
Unit 1113, Adria Tower, Tierra Lorenzo Condominium, Altamirano Street,
Brgy., Mataas na Lupa, Lipa City, Batangas, do hereby SELL, TRANSFER,
CONVEY, and DELIVER, by way of ABSOLUTE SALE, unto said
BUYER, the property above described with all the improvements existing
thereon;

That we hereby warrant our valid title to, and peaceful possession of
the property herein sold and conveyed and further declares that the same is
free and clear of all liens and encumbrances of any kind whatsoever.

IN WITNESS WHEREOF, we hereunto set our hand on this _____ day

That the SELLER/S hereby warrants his/her/their title over the land
above-described, with full right to dispose of the same, free from all liens
and encumbrances, and that henceforth, full right of ownership and
