1. Agreement
This agreement is made between the Madin hotel Varanasi referred to as the “Hotel” and the “Guest”. In the
event that this agreement is signed in the name of the company, partnership, agency, firm, club or similar
society, the person signing represents to the Hotel that they have full authority to sign such a contract. If the
person is not authorized, they will be personally liable for the complete performance of this contract. Any
reference to the “Manager” will refer to the person nominated by the Hotel to represent the Hotel in all matters
relating to the function.
2. Confirmation of Booking
Hall availability is offered on a tentative basis, until the advance is received. To confirm a function, 50% of total
estimated billing is required as a non-refundable advance at the time of booking and the balance amount seven
(7) days prior to the function date.
3. Deposit
If the rate is not decided at time of advance deposit, 50% advance will be calculated on our banquet rack rate.
(Vegetarian or Non-Vegetarian).
Guests will be liable to pay the total amount of guaranteed persons with an extra 20% amount as caution deposit
one week before the function, which is refundable. Any further balance is to be paid immediately after the
function by cash or credit card.
4. Cancellations
Any cancellation / amendment must be made at least thirty (30) days in advance in writing, else a retention
charge equivalent to 50% of the entire billing will be charged. For cancellations / amendments made in less than
fifteen (15) days in advance, 100% retention will be charged.
5. Payments
Payment through cheque or RTGS should be made one week before the function date.
Bill to the company shall be allowed only to listed companies who are clearing the amount from the local office
in Varanasi and on the approval of our finance department.
6. Guaranteed Numbers
An estimated number of guaranteed attendees must be given at the time the booking is made.
Menu and minimum number of guaranteed guests should be finalized at least seven (7) days in advance. For
any minor changes, the hotel should be intimated at least 72 hours in advance.
The minimum number of guests guaranteed by you will be charged in full and any shortfall on the same will not
attract any discount.
The menu composition provided by the Hotel is fixed and cannot be splitted, combined or adjusted in any
manner.
7. Expected Numbers
Food will be prepared for only 20% in excess of the guaranteed number. If the number exceeds, the hotel would
not be responsible for dissatisfaction in food and service quality.
Extra surplus charge of 10% per plate will be charged in case the number exceeds the expected number of
people.
Circulation of snacks & service of Chaat items, fresh Juices, Mocktail & milk shakes, fresh fruits & soft drinks will
be for a maximum of two hours only from the start of function.
8. Setting up Requirements
All requirements, together with food and beverage requirements, catering times, meeting timetable and audio-
visual / room set-ups must be received by the Hotel no later than 14 days prior to the function. The Hotel often
sources professional audio-visual equipment from external sources and is affected by unpredicted price changes.
Audio-Visual Equipment prices are subject to change without prior notice.
The Client shall pay the cost of any special electrical equipment; installation or fitting that may be required for
the function. Any such installation or fitting shall be carried out by a person approved to do so by the Hotel.
9. Hall Allocation
The Hotel reserves the right to assign an alternative venue for a function in the event that numbers change and
the Hotel at its sole discretion deems the room unavailable or inappropriate.
10. Prices
All prices quoted are current and are valid only for 15 days from the date of inquiry. Kindly finalize your rate at
the time of confirming the booking. In case of any dispute, the decision of the management will be final.
There is no discount for children. No discount cards of any kind are applicable.
Tax will be charged as per government regulations. In the event of any alteration in such regulations, the hotel
reserves the right to amend the same without prior notice.
11. Storage
The hotel does not provide storage facilities and will not accept liability for any damage caused to uncollected
items or for loss of any valuables.
No alternate venue will be provided by the Hotel in case of adverse weather conditions for outdoor functions
(including poolside). If the poolside function is canceled due to adverse weather etc, the hotel is not liable to
refund any amount collected in advance or offer an alternate venue / date.
The Guest shall make good and pay for any damage made to the Hotel or furniture or fixtures or fittings
(including accidental damage) caused by any act or neglect by the Guest, the Guest’s employees or agents, or
any persons attending the function by reason of the use of the Hotel by them.
The Guest shall not make any alterations to the structure, fittings, decorations or furnishings of the Hotel nor
permit nails, hooks, adhesive fasteners, tacks or screws to be installed on any part of the Hotel without prior
written permission from the Manager and shall leave the Hotel in the same condition as it was at the first day of
the function.
The Guest shall not allow anything to be displayed, attached or to be suspended from the ceilings, walls, fittings
or draperies of the Hotel without the previous written permission of the Conference and Banqueting Department.
Functions that end after 12 midnight will incur a charge of Rs. 10,000 per 30 minutes and the extension of timing
is at the sole discretion of the management and a requirement that music is turned down to an acceptable
background noise level.
16. Security
The Hotel reserves the right to cancel a function in writing at any time without liability if it believes the function
may adversely affect the smooth running of the Hotel, its security or reputation, and to exclude or reject any
persons from the function and Hotel. The Guest remains liable for all costs associated with the function even in
the event of cancellation. The Hotel reserves the right to provide security for any function as it deems necessary.
For evening functions, music will be permitted till 22:00 hrs only. For day functions, music is permitted only on
weekends.
All necessary permits, licenses and “no objection” certificates, as required by the law, will have to be applied for
by the company / guest and submitted to the hotel seven days before the function.
The Liquor rates can change without prior notice and will be served as per availability.
22. Prohibitions
a. Fireworks beyond the entrance gates of Madin hotel i.e. they must end on the road itself. The band,
drummers, dhol players will not be permitted beyond the Main porch of the Hotel.
b. Hanging of banners, posters or any other objects by using nails, thumbtacks, tape or by any other means
is not permitted. Freestanding framed banners shall be permitted at designated places.
d. Smoking and chewing of tobacco / paan masalas inside the hotel premises is strictly prohibited.
e. Loud music & dance beyond 2200 hrs is prohibited as per applicable laws.
i. Under the Fire Prevention Act (as in force with regard to the management of places of entertainment) the
fire escape provided on the premises shall be maintained unobstructed and accessible.
j. Loose electrical wires will have to be dressed and insulated properly by outside vendors.
23. Communication
Guest is required to nominate a Key Contact Person in the interests of facilitating clear communications. All
correspondence will be done with nominated person.
This Contract constitutes the entire agreement between the parties, supersedes any previous agreement
or understanding and may not be varied except in writing between the parties. All other terms, express
or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
We trust that all of the services offered in the Agreement meet your requirements and satisfaction. If
there is any additional service, information or assistance required, please do not hesitate to contact us
at your earliest convenience.
Please confirm your acceptance of the arrangements for your function summarized above by signing and
returning this Agreement to the Hotel.
