12. Personal Attributes & General

(a) How would you describe yourself?

I am a dedicated and ambitious individual with a strong passion for law and justice. My
ability to analyze legal issues critically, coupled with a meticulous approach to research,
helps me excel in complex legal matters. Being resilient and adaptable, I thrive under
pressure and remain composed in challenging situations. My commitment to fairness and
ethics guides my actions, both professionally and personally. I also have strong
communication skills, which allow me to articulate arguments effectively and advocate for
causes I believe in.

(b) Describe a challenge that you have faced either at work or university. How did it
arise? How did you respond?

During my legal studies, I was once assigned to prepare a research paper on an intricate
constitutional law topic with a very tight deadline. The challenge arose due to the vast scope
of the subject, requiring extensive research and critical analysis. To tackle this, I structured
my approach by breaking down the topic into sub-issues, prioritizing primary sources like
case laws and statutes. Despite time constraints, I remained focused, cross-referenced
multiple materials, and sought guidance from faculty. My perseverance paid off, as I
submitted a well-researched paper that was appreciated for its depth and clarity.

(c) What is the most important decision you have made in the last two years? What
factors did you consider?

One of the most important decisions I made was to pursue an LLM after completing my law
degree. I carefully weighed the benefits of further specialization against the immediate
prospect of entering legal practice. Factors such as career growth, academic interest, and the
potential to contribute more effectively to the legal field influenced my decision. I also
considered financial implications, time commitment, and how an LLM would align with my
long-term goals of advocacy and public interest litigation.

(d) Describe any non-academic situation in which you have had to defend your point of
view. What was the outcome?

In a family discussion about environmental conservation, I argued against certain traditional

practices that contribute to ecological degradation. Given my family’s orthodox beliefs, it
was challenging to present a counter-narrative. I used factual data, legal provisions, and
ethical reasoning to emphasize the importance of sustainable practices. Though not everyone
agreed, I managed to convince a few family members to adopt eco-friendly habits, marking a
small but significant change.

(e) What are your plans after you finish your law course and are given a law degree to
practice?
As a law graduate, my ultimate goal is to become a judge. I plan to prepare rigorously for the
judicial services examination to enter the judiciary. My focus is on gaining a deep
understanding of legal principles, judicial precedents, and procedural laws to ensure a fair
and just approach to decision-making.

In the meantime, I aim to gain practical legal experience by working under experienced
advocates and engaging in legal research. This will help me develop the analytical skills and
courtroom exposure necessary for a judicial career. Additionally, I intend to stay updated
with legal reforms and judgments to strengthen my judicial acumen.
Becoming a judge aligns with my passion for justice and my commitment to upholding the
rule of law with integrity and impartiality

(f) What do you understand by descriptive fair use in the Trade Marks Act, 1999? (300
words)
Descriptive fair use under the Trade Marks Act, 1999, refers to the legitimate use of a
registered trademark in a manner that does not constitute infringement. Section 30(2)(a) of
the Act allows the use of a registered mark when it is employed in a descriptive manner
rather than as a trademark. This doctrine ensures that trademark owners do not monopolize
common descriptive words necessary for businesses to fairly describe their goods or services.

For instance, if a company registers the mark "Sweet Delight" for chocolates, another
company may still use "sweet delight" in a descriptive manner to explain the taste of its
products. However, if such use creates confusion among consumers about the origin of
goods, it may be deemed infringing.

The principle of descriptive fair use balances trademark protection with free competition.
Courts evaluate factors such as the manner of use, intent, and whether the term is being used
in good faith without misleading consumers. Indian courts have upheld fair use when the
term is used in its ordinary descriptive sense rather than as an indicator of trade origin.

In conclusion, descriptive fair use prevents unjustified trademark monopolies while allowing
businesses to describe their products and services truthfully. However, businesses must
ensure that such use does not mislead consumers or create unfair competition.

(g) What is a terrorist act under BNS? (300 words)

Under the Bharatiya Nyaya Sanhita (BNS), 2023, a terrorist act is defined as an act intended
to threaten the unity, integrity, security, or sovereignty of India or to create terror in the
public. Such acts involve violence, the use of explosives, biological or chemical weapons,
cyber terrorism, or any means that cause significant harm to life, property, or national
security.

A terrorist act includes:

Causing Death or Injury – Any act resulting in serious harm or death to individuals.

Destruction of Property – Targeting critical infrastructure, government buildings, or public

spaces.

Use of Explosives or Weapons – Employing bombs, firearms, or hazardous materials.

Cyber Terrorism – Attacks on national security databases or critical digital systems.

Financial Support for Terrorism – Funding, harboring, or aiding terrorist groups.

The BNS provisions align with international counter-terrorism laws while ensuring strong
legal mechanisms for national security. The punishment for a terrorist act under BNS
includes life imprisonment or the death penalty, depending on the severity of the crime.
Additionally, stringent measures exist for individuals or organizations involved in the
planning, financing, or execution of terrorist activities.
This law aims to deter terrorism through strict penalties while balancing civil liberties and
human rights. It provides law enforcement agencies with necessary legal tools to combat
terrorism effectively and maintain national security.
