CRIMINAL PEITION No.4592 of 2024

ORDER:

1. This criminal petition under section 482 of the Bharatiya


Nagarik Suraksha Sanhita (for short ‘the BNSS Act, 2023’) (under
section 438 of the CrPC) is filed by the petitioners/A2 and A3 to
grant anticipatory bail in connection with Crime No. 154 of 2024
of Gudlavalleru Police Station of Krishna District for the offences
punishable under Sections 109, 115(2) read with 3(5) of the
BNSS Act, 2023.

2. The de facto complainant was impleaded as respondent


No.2 by virtue of orders of this court dated 16.07.2024 in I.A.No.1
of 2024 in Crl.P.No.4592 of 2024.

3. Heard arguments of Sri Akula Vamsi Krishna, the learned


counsel for petitioners and Sri Subrahmanya Kumar, the learned
counsel appearing on behalf of Sri P.S.P.Suresh Kumar for
respondent No.2 and learned Assistant Public Prosecutor for
respondent No.1/State.

4. A perusal of the case diary indicates that the cause of


dispute is about the release of sullage water into the drain. On
03.07.2024, the de facto complainant questioned his neighbours
about release of sullage water into the drain and aggrieved by
that one Mr. Sai shouted at him and using a knife stabbed on his
back near the spinal card and on the back of the neck and hit him

with hands and legs. The present petitioners are the parents of
the assailant. The allegations against them are that on hearing
the galata and the cries of the victim, they came out of their home
and shouted at the victim and accosted their son to attack and kill
him. Thus, there are no specific overt acts against the petitioners.
Looking at the nature of the dispute, custodial interrogation does
not seem necessary. Therefore, prayer is granted.

5. In the result, this criminal petition is allowed. In the event of


arrest, the petitioners herein/A2 and A3 shall be enlarged on bail
on each executing a personal bond for a sum of Rs.10,000/-
(Rupees Ten Thousand only) with two sureties of the like sum
each to the satisfaction of the Investigating officer concerned.
Petitioners/A2 and A3 shall mark their attendance before the
investigating officer once in a fortnight i.e., on 1st and 15th of every
month between 10.00 AM and 1.00 PM till filing of the charge
sheet. The petitioners/A2 and A3 shall make themselves
available for interrogation by a police officer as and when
required, and they shall not, directly or indirectly, make any
inducement, threat or promise to any persons acquainted with the
facts of the case to dissuade him from disclosing such facts to the
court or to any police officer.
