BRIEF DESCRIPTION

This course will examine all phases of the litigation process in civil actions.
Specific subjects covered may include: pleadings; discovery; disposition of cases
without trial; the right to jury trial; post-trial motions; appeals; the bases for
jurisdiction over persons and property; notice; venue; subject matter jurisdiction;
choice of federal or state law in diversity cases; joinder of claims and parties; and
preclusive effects of judgments.

1.1 Course Overview and Objectives;


The subject will generally focus on how aggrieved parties to civil legal disputes can resolve their disputes
through a formal court process or alternative dispute resolution (ADR). The course is only subdivided into two
(the first part Covered in Semester 1 and 2 nd Part Covered in Semester 2) not because the applicable
principles are wholly distinct but because the entire course can’t be covered in one semester. Nevertheless,
the part covered in the 2nd semester is merely an extension of the introductory part covered in the 1 st
semester otherwise quite several legal principles may overlap.

The course covers Provisions of the Constitution, statutory law, Rules of Procedure and Practice. After the
course, students are expected to have acquainted themselves with theoretical knowledge of procedures and
actual practice. Demonstrations of what transpires in courts of law, how presentations are made, and the
documents relied on are all part of the course from the court's perspective, the parties and counsel. Areas
worth recommending for reform are also to be considered.

1.2 Constitutional and Statutory Analysis;


Civil Procedure is derived from an interplay of statutes and procedural rules and how the same have
been applied and interpreted by the courts over time as well as the relevance of provisions of the
Constitution in civil proceedings. This is intended to enlighten students on the applicable rules to
particular civil remedies, and the scope of the rules as applied in practice to suit the varying

practical situations. The courtroom decorum, the legal arguments and the art of presentation shall
be considered.

1.3 Policy Approach;


Modern litigation leans in favour of Alternative Dispute Resolution and out-of-court settlements, and the
advantages and disadvantages, thereof vi-a-vis litigation are of pertinent importance and intended
to enhance the student’s ability to determine matters that merit court action and ones capable of
being settled. Consideration shall be had to Arbitration, mediation, and evaluative mediation
among others.

1.4 Topics Covered and Materials


The course is extensive and all the topics and sub-topics to be covered are highlighted in the reading
guide. The authorities are also indicated, which relate to the legal positions on those topics. Most of
the cases are online. Students shall be required to acquaint themselves with internet and
technological research.

1.5 Learning Outcomes;


At the end of the course, students are expected to have appreciated among others, the following;
• The relevant applicable laws both substantive and procedural to particular remedies being sought
in courts of law; together with the relevant legal principles relating to and applicable at every stage
of civil proceedings
• Comprehend the different mechanisms of resolving civil disputes through a court process (all
courts be it of first instance or appellate courts) or otherwise, the procedure of invoking the power
of courts to grant specific and varying reliefs both before, during and after the trial and means of
enforcement of court orders;
• Identify the practical skills involved in the process of litigation, including conduct of the practitioners,
the courts and other stakeholders.
• The students must have mastered the powers of all the courts in the structure of court system in
Uganda, relevant documents to support any proceedings, the time limits of taking particular steps
in the proceedings and how best to safeguard the interests of the clients, whether as successful
parties or unsuccessful parties in an election.
• The specific aspects that must inter alia be appreciated are set out under each topic/sub-topic on
the reading list.

2.0 Recent Legal and Incidental Developments, Impact of Covid-19 Pandemic and
Technology on Conduct of Civil Proceedings and the Emerging issues including litigation before the
East African Court of Justice
2.1 There are recent developments in the area of Civil Litigation including the impact of technology
which had generated the need for amendment of the Civil Procedure Rules in 2019-2020

2.2 As a result of technological developments and the Covid-19 pandemic, more changes are emerging
in this area including the conduct of Civil proceedings through technological means;
 Filing of court pleadings, and submissions through technological means (e-filing) at all levels of
courts, save those without the requisite facilities.
 Conduct of proceedings including examination of witnesses via technological means including
Zoom, delivery of judgements by email or on Zoom.

 Service of court process through electronic mechanisms like Facebook, email, WhatsApp, X
(formally twitter), and other technological means.
 Other issues include the growing impact of the human rights’ legal regime on various aspects of
civil procedure including the modes of execution like arrest and imprisonment in civil prison.
 The growing reluctance of the courts to insist on what are considered to be technical points and the
need to reconcile the rather varying decisions by different judges on similar legal points.
 There is a need to reconcile domestic law and community law, especially with the emerging
jurisprudence of the East African Court of Justice and cross-border transactions.
 The need to integrate gender, disability and incidental legal aspects in procedure and practice
where applicable.

3.0 Conduct of Lectures


i. Lectures may be conducted either physically or technologically via zoom or Module, whichever
shall be appropriate. Either way, the relevant material shall be delivered.
ii. At the commencement of every topic, the students shall first be addressed on the essence of the
topic, what they are expected to consider, both the law, procedure and practice and the learning
outcomes at the end of the discussion.
iii. The issues of challenges, areas for legal reform, reconciliation of the law procedure and practice
with the human rights concerns, shall equally be considered
iv. The lectures will be conducted in a number of formats including class/zoom discussions,
presentations by students, and a combination of both the theoretical and practical approaches, the
best practices, coupled with the ethical considerations.
v. Each Student must possess a copy of the Civil Procedure Act and the Civil Procedure Rules
for every class. The students must read the other statutes referred to and the cases under each
topic in advance to be able to follow the discussion.
vi. Any changes in topics to be covered shall be communicated.
4.0Authorities;
The law and rules applicable to civil procedure have been and continue to be elucidated in several
decisions of courts. Some of the cases have been set out in the reading list, which is not
exhaustive. Other cases shall continue to be cited and relied on in class from time to time.

5.0 Examinations
The examination is twofold; First is the coursework that shall be conducted and shall be marked out of
30 marks. The coursework shall be either in form of a test or a take-home test as the subject
Lecturers shall at their discretion advise. At the end of the semester, the final examination shall be
conducted marked out of 70 marks. The exam shall be partly open book with students being
allowed to enter the exam with clean copies of the Civil Procedure Act, the Civil Procedures and
the Reading list only (save that a supplementary reading list approved by the subject Lectures may
equally be allowed.
