Drafting Tutorial 1.
Question 1.

(a) What offence/s can Michael johns be charged with under the criminal law of
Vanuatu? Explain your answer.

In relation to the facts of the scenario, Michael Johns action to the victim was
an unintentional harm, to which no person shall unintentionally caused
damage to the body of another person, through recklessness or negligence,
or failure to observe the law. The result of his action has causes injuries and
damage to Joseph Tabi, with a broken nose, and knee which is likely
permanent.

(b) What is the name of the criminal law in Vanuatu and the section/s that would
apply to the offence/s you have identified?
Under the Vanuatu Penal code CAP 135, section 108; Unintentional harm, sub
section (b) if the damage so caused is permanent, imprisonment for 2 years.

Question 2.

What are the two golden rules or principles that apply when looking at internal
factors to interpret a document.
What are these rules?
1. The ‘Ordinary Sense of the Words’ – this means that the words are given their
ordinary English meaning
2. Interpret the Document as a Whole.

Explain how the two rules apply in legal interpretation.


In the ordinary sense of the words, the meaning of the words must be in their
ordinary English meaning.
Interpretation of the document as a whole; A document must be interpreted as a
whole document that means individual parts of the document must be read in context
with the whole document. Reading the `whole document with regard to the purpose
of the document is.
