A. Provisions of Agreement:
1. The role of the mediator: The mediator shall use her/his skills to help the
parties reach a settlement of their dispute. The parties may reach a written

agreement but the mediator shall not write the agreement nor will the
mediator sign the agreement.
2. The role of the parties: The parties shall work in good faith with the
mediator to reach a settlement of their dispute. It is the responsibility of the
parties, not the mediator, to decide and write the terms of the settlement. The
mediator may help the parties draft the agreement but it is the parties that
consent to and sign the agreement.
3. Payment of mediator: The parties shall sign an agreement, prior to
commencement of any mediation, stating how the mediator shall be paid. The
payment agreement shall be provided to the parties by the mediator before
the first mediation session.
C. After The Negotiation, The Parties Have Agreed To Settle Their Dispute As
Follows:
2. That Mr. A has agreed upon the refund of the said amount without any
extra compensation or damages.
4. It is agreed that if Mr. B fails to refund the money within a week after the
negotiation the he will be liable to pay Mr. A an interest of 15% on the
10,00,000/- Rupees every month.
5. The dispute arising from the arbitrary breach of contract between the
parties has been settled through this negotiation and no party can
further file a civil or criminal proceedings in any Competent Court of law
on this matter. If any case/petition/suit etc has been pending in the
Court then the it should be withdraw/disposed by the respective parties.
6. That the issue arose between both the parties has been settled on the
above said terms and conditions of the negotiations.
7. The parties have settle their dispute through their own free will without
any force, fear, coercion and undue influence by either side.
