Learning Outcome:

a) The answer to whether a lessor can use a part of the leased

so largely depends on the terms set forth in the Lease
Deed. If the deed specifies that the lessor retains rights to
certain areas of the property or to access the property

3
D.M. HARISH SCHOOL OF LAW

under certain conditions, the lessee may be obligated to

comply. If such clauses are not specified, the general
assumption under most lease agreements is that the lessee
enjoys exclusive possession of the property, with limited
exceptions for specific rights of access by the lessor (e.g.,
for repairs, inspection, or emergencies).
Thus, it’s crucial to study the specific clauses in the Lease
Deed to determine the lessor's rights and the lessee’s
obligations in this regard.

property), but reforms have shifted this legal position.
Study the significant provisions of the Hindu
Succession Act, especially after the 2005 amendment
that gave daughters equal rights in ancestral property,
making them coparceners with the same rights as sons.
Learn that daughters have the same rights as sons when
it comes to self-acquired property, as it is entirely the
father’s discretion to decide who inherits it (through a
will or legal inheritance if there is no will).

Understand the landmark decision in the Vineeta

Sharma vs. Rakesh Sharma case, where the Supreme
Court ruled that daughters have equal rights in the
ancestral property, even if the father passed away
before the 2005 amendment to the Hindu Succession
Act. This decision clarified that daughters, as
coparceners, can claim a share in the ancestral property,
irrespective of whether the father was alive before or
after the amendment.
The case reinforced that daughters have a birthright in
ancestral property, and their rights are not dependent on
when the father passed away, making the legal position on
the matter more clear and equitable.
