Terms and Conditions

1) All payments have to be made in favor of ANON ET COMMUNICATIONS PVT. LTD ("ACPL").

2) • Payments Terms:

■ ARC-Monthly advance (MRC). 1st month charges will be paid in advance with the P.O
• The pricing are Inclusive of all Taxes.

, 2) Validity: Minimum Contract term is 12 months from the date of link delivery. However the
shifting will be permitted during the contract period from second month billing,

3) Service Delivery: Standard Implementation time period is 3-4 week, Subject to clear the
feasibility. No last mile access shall be given to any ISP Customer.

4) Circuit Acceptance - ACPL will conduct the following tests on implemented circuit as per ow
standard parameters.

• NLD/Local Loop - Ping and Packet Loss, and Throughput (Upload and Download).
■ Internet- Ping (up to peering points), Packet Loss, and Throughput (Upload and
Download). On successful testing of the above parameters, the circuit will be deemed
ready for use & for acceptance by customer.

S) Billing Start date: 48 hours post the handover of link by ACPL to the customer. No Separate
LOC signoff shall be taken from the customer.
6) Delay in the Payment terms: Payment should be clear by the due date. Any delay in the
above will attract late payment charges @12% p.a. of the outstanding amount.

7) Barring service on account of payment delay: Service of all/delayed payment links will be
barred if the payment is not received within 15 days post the due date without any
obligation or liability of ACPL

8) Service Restoration: In case of disconnection on account of non-payment, reconnection of

the same will be undertaken within 3 days from the date of clearance of outstanding dues. In
case of any technical constraint from ACPL end, the link restoration timelines shall be
extended.

9) Contract Period: Tenure of contract start with change in services either up gradation/down
gradation/renewal in commercials.

10) Pre-Termination Penalty & Link Shifting: Customer is allowed to shift their bandwidth to any
• other location at the prevailing rate. This will be affected basis a link of shift order. In case
the shifting is in off-net location ACPL reserves the right to say no for connectivity and the
customer need to be take delivery from the nearest point of presence. Link also can be
terminated on non-solve able technical grounds at any moment in contact period with no
notice period and no pre- termination clause.

11) Upgrade: For any upgrade affected to the circuit, the upgrade circuit's contract will also be
for the 12 months or mutually agreed Fixed Rate Contract period.

12) Downgrade: Internet bandwidth will be not be downgraded before contract, if required that
pre termination charges will be applicable of balance 12th month contract.

13) Disconnection post completion of minimum contract period: A notice period of 30 days shall
be given by the customer. Customer is liable to pay any charges of remaining period of fixed
rate contract, If applicable.

14) Renewal: All contracts will be renewed after completion of 12-month cycle or FRC period
with existing terms and conditions unless communicated otherwise.

15) Rest all terms and conditions of master service agreement will be applicable on these new
links.
