Subject: Reply of Bail application.

Respected sir,

The brief facts of the case are that a DD No. ----- was received in P.S. ------ from

PCR and the same was marked to me for investigation. I reached the spot and took

the Victim 'S' D/o 'S' along with her mother to ---- Hospital, --. It being a matter of

sexual Harassment counsellor was called, Victim's statement was recorded in front

of her mother and CIC Counsellor in which she stated that: 'My friend 'S' took me

to her home by saying that her mother is calling me. I went to her home and saw

there was no one. We both started playing. Suddenly, ------ (Victim's friend's

father) came and sent my friend 'S' to take the wafers and told me to accompany

him to fetch Wheat from the terrace. Where I went along with him. --------

removed my pajami and touched my chest. I pushed him in anger and rushed to my

home. I told about this incident to my teacher and she told my mother about this.

Then my parents called the police".


Further, she was sent to --- Hospital, ------- along with her mother. CIC Counsellor

and W/ct.--------------------, for medical examination. Victim 'S' D/o 'S' was

medically examined (Refused Internal Medical) Vide MLC

No.------------------------------------. In which doctor gave A/H/O molestation by

unknown person named------------ . No H/O physical assault. Types of Injuries-No

external injury scene at the time of examination. From the contents of complaint,

MLC and counselling report offence U/s ---------- Act is made out. Soon on

dt.--------, DO lodged FIR U/s -----------------Act.

On dt.----------, statement of Victim ‘S’ U/s 164 CrPC was recorded in which

victim supported the allegations levelled in her previous statement and answered in

positive.

Accused ----------- was arrested on dt.------ while following the Guidelines of the

Supreme court. The documents related to the arrest were completed and further he

was taken for MLC. On dt.---------, accused ---------- was taken to KKD Court and

produced before the Hon'ble --------------- Court, where Hon'ble Judge sent him to

JC for 14 days. Witnesses are being examined. Further, a notice has been sent to

the Principal of Govt. ----- School, ----------------- to provide pasting file of victim

'S' D/o 'S' for verification of birth certificate. According to the pasting file, age of

victim was found to be 13yrs 5 months. Further, I have discussed the file with the
senior officer and they have directed me to change section from -------------------

Act in the case.

The Chargesheet against accused ---------------- is being prepared and will be filed

in the Hon'ble court shortly.

Grounds for rejection of bail application: -

(1) ------------------------------------------------------------- have committed heinous

offence with a girl of 13 years old.

(2) Accused commit offence of -------------- Act.

(3) Accused can threaten and pressurised victim.

(4) Accused can jump his bail.

Hence bail application of accused ------------------ is strongly opposed. However,

undersigned is ready to abide any direction passed by Hon'ble court.
