Sub: Legal notice under section 138 of Negotiable Instrument Act for dishonor of
cheque.

Dear Sir,

Under instruction and authority from my client Mr. Rahul Kumar we serve upon
you the following legal notice.

1. That in the month feburary’2024 you have approached my client through


phone call to ask for support in form of money borrowing on returnable
basis. Subsequently you have issued Union Bank of India vide cheque
no. 382121 amounting 30,000/- rupees for withdrawal.
2. That you have promised our client to return the amount in the form of
cheque dated 19-03-2024.
3. That our client had relied on your promise and as instructed by you
delivered the cash amount of 30,000/- rupees by hand to you.
4. That you have issued Cheque No. 382121 dated 19-03-2024 for Rs.
30,000/-(Rupees Thirty thousand only) drawn in SBI Bank, Seemapuri
branch, Delhi.

5. That the aforesaid cheques No. 382121 dated 19-03-2024 for Rs.
30,000/- was presented by our client Mr. Rahul Kumar on 19-03-2024 to
your bankers i.e, Union Bank of India.
6. Our clients shock and surprise the said cheque had been dishonoured
by your banker with the reason “Account Blocked”, A/c No.
349902010050883 (Banker- Union Bank of India) which was intimated
to our client by their SBI bank through their cheque return memo dated
21-03-2024
7. That client has tried calling you, to know the reason of status by the
Bank, but you deliberately ignored the calls.
8. Our client re-submitted the cheque in the Bank for clearance on 10-04-
2024. Again the said cheque had been dishonoured by your banker
with the same above stated reason “Account Blocked”; which was
intimated by cheque return memo dated 11-04-2024.
9. That there after inspite of many telephonic reminder calls by our client,
you failed to make the payment due to my client.
10.My client states that you have issued the above said cheques only with an
intention to cheat our client which amounts to an offence punishable
under section 138 of Negotiable Instruments Act.
11.Under the circumstances, we call upon you to pay of Rs. 30,000/-
within a period of 15 (fifteen) days from the date of receipt of this
notice, failing which our client will be constrained to take legal action
against you in a court of law for an offence punishable under section 138
of Negotiable Instruments Act for which you will be liable for all costs
and consequences.
12. This is without prejudice to all other legal rights and remedies available
to our client for the above-stated purpose.
13. You are liable to pay a sum of Rs. 30,000/- as necessary cost and
expenses of sending the present legal notice to you.
14. Copy of this legal notice is also kept at my office for further ready
reference if required in future.
