1. SUMMARY
"Agriculture and Rural Development" is one of the 35 сhapters of the EU acquis. Ukraine gained EU candidate
status in June 2022, and the European Commission will likely provide the negotiation framework by the end
of 2024.

In the past, the EU's demands for transformation of the agricultural sector have largely determined the course
of accession negotiations with Poland 1 in 2004 and Bulgaria2 and Romania3 in 2007. Most of the candidate
countries in the Western Balkans have so far failed to make significant progress in integrating their
agricultural sectors into the Internal Market due to a lack of administrative capacity and inconsistent reforms 4.
Thus, and given the considerable size of the Ukrainian agricultural sector, this chapter may become one of
the cornerstones of the negotiations between Ukraine and the European Commission.

This policy paper – the first in a series of studies on the challenges and prospects of Ukraine's agricultural
sector integration into the EU – aims to identify the further steps in implementing European legislative and
institutional reforms in Ukraine in the context of agricultural production. The study provides an overview of
the most urgent – according to the European Commission – reforms and an assessment of progress in reforms
specified by the Association Agreement.

The main focus is further measures for sectoral integration - the relevant conclusions are based on a screening
of Ukrainian and European legislation, analysis of international experience, and interviews with experts.

2. THE BASICS OF THE EU'S COMMON


AGRICULTURAL POLICY
The EU's Common Agricultural Policy (CAP) was established by the Treaty of Rome 5 in 1957 to achieve the
following objectives:
• to ensure a fair standard of living for farmers;
• to stabilise agricultural markets;
• to ensure food security;
• and to promote the efficiency of agricultural production.

Until 2005, payments to farmers under the EU CAP were made in the form of subsidies for certain groups of
agricultural products. In 2005, with the introduction of the Single Payment Scheme (SPS) 6, payments were
decoupled from agricultural production. The 2008 review of the EU CAP ("Health check"7) consolidated the
abandonment of the subsidy-based support system and paved the way for further reforms. The Basic Payment
Scheme (BPS)8 introduced in 2015 offered a more homogeneous approach to calculating payments across EU
member states. In addition, the BPS introduced measures promoting environmental sustainability (the so-
called Green Deal), which farmers must comply with to be eligible for full payments.

Funds under the EU CAP are allocated to the following funds:


• The European Agricultural Guarantee Fund (EAGF, the so-called "first pillar"). This fund primarily
finances direct payments to farmers and market-related measures. Direct payments are intended to
maintain and stabilise farmers' incomes.
• The European Agricultural Fund for Rural Development (EAFRD, the so-called "second pillar"). This
fund focuses on rural development initiatives, including support for investment in agriculture,
environmental sustainability and rural economy diversification.

In addition, temporary funds can be used to finance agriculture in emergencies. For example, the European
Union Recovery Instrument (EURI) provided money to farmers in 2021 and 2022 to mitigate the effects of
the COVID-19 pandemic.

3. URGENT RECOMMENDATIONS OF THE


EUROPEAN COMMISSION
The eleventh chapter of the acquis, titled "Agriculture and Rural Development", is part of the cluster
"Resources, Agriculture and Cohesion". According to the latest available report of the European Commission,
dated 08.11.20239, regarding this negotiating chapter, Ukraine is at an early stage of preparation for
accession10.
The list of the most urgent recommendations includes the following:
1. сontinue harmonisation of legislation with EU legislation in the field of agriculture and rural
development, focusing on the requirements of the Association Agreement, and strengthen
administrative capacity for evidence-based policy-making;

2. finalise the National Strategy for the Development of Agriculture and Rural Areas for 2023-2030 and
start its implementation;
3. monitor and record farms in the State Agrarian Register and use it to support agricultural producers
financially. In addition, preparations should be made to establish payment agencies and farm
accounting systems that align with EU standards.

Let's take a closer look at each of the recommendations.

3.1. REQUIREMENTS OF THE ASSOCIATION AGREEMENT


Annex XXXVIII to the Association Agreement11 contains a list of 57 legal acts (including 19 directives 12 and
37 regulations13) regulating agriculture in the EU that were to be implemented in Ukraine (see Annex 1).
Before getting a candidate status, Ukraine had implemented most of the regulations governing quality and
marketing standards for various agricultural products (see Annex 1 for more details). However, several rules
related to common market organisation, necessary for further integration of Ukrainian agriculture into the
EU Internal Market, have not yet been implemented.

In particular, Regulation (EU) 1308/201314, which establishes the rules for the organisation of the agricultural
market in the EU, requires implementation. It serves as a legal basis for determining state intervention
measures, regulating the procedure for interaction between various stakeholders in the agricultural market,
anti-crisis measures, and determining minimum quality indicators. Ukrainian legislation involves several legal
acts regulating product quality and, to some extent, the organisation of agricultural markets (see Annex 1).
However, further implementation of the aforementioned European regulations will require an expansion of
the scope and scale of government intervention in agricultural markets and substantially higher spending on
farm support.
Regulation (EU) No 1307/201315 contains the main provisions on direct payments to farmers under the EU
CAP. The Delegated Regulation (EU) 639/201416 specifies direct payment schemes to support farmers'
incomes and increase agricultural productivity and sustainability. This regulation also introduces specific
greening measures (environmental practices) that farmers must implement to be eligible for additional
payments. Regulation (EU) No 1307/2013 contains specific provisions on funding from national budgets; in
particular, such funding must be consistent with the principles of the EU CAP and not disrupt the functioning

of the internal market. However, this is a right, not an obligation. Thus, the implementation of the regulation
will not have negative consequences for the Ukrainian national budget in the short term but may serve as a
signal of readiness for accession and simplify access to financial assistance in the pre-accession phase in the
field of rural development (Pre-accession Assistance in Rural Development - PARD).
EC Regulation (EU) 2021/228917 sets out the requirements for Member States to develop strategic plans under
the EU CAP. By establishing detailed rules for the presentation of strategic plans for the EU CAP and the
associated electronic exchange system, the regulation aims to harmonise the approach across Member States,
ensuring that all plans are comprehensive, comparable and in line with EU objectives. Developing a national
agricultural development strategy aligned with European principles and norms is another "homework"
assignment from the EC. Thus, the implementation of the regulation can serve two purposes at the same time.

3.2. MONITORING AND ACCOUNTING OF AGRICULTURAL


ENTERPRISES

Effective management of public funds under the CAP is possible thanks to monitoring systems, the most
important of which are the following:
• The IACS (Integrated Administration and Control System) is a system used to manage and control the
distribution of direct payments to farmers under the "first pillar" of the CAP. Its main objectives
include:
o ensuring the accuracy of agricultural payments by verifying eligibility criteria such as land
ownership, land use and compliance with environmental and agricultural regulations;
o monitoring of agricultural land use and changes in land plots over time;
o promoting the implementation of so-called "cross-compliance measures" that link subsidy
payments to compliance with environmental, food safety and animal welfare standards 18.
• LPIS (Land Parcel Identification System) is a component of IACS that serves as a digital mapping
system and is used to identify and delimit agricultural land parcels. Its objectives include:
o provide accurate spatial information on agricultural land plots, including their boundaries,
sizes and types of land use;
o support the administration and monitoring of CAP subsidy schemes by facilitating verification
of land eligibility and compliance;
o increase transparency and efficiency of agricultural subsidy management and monitoring 19.

• FADN (Farm Accountancy Data Network) (more recently, the Farm Sustainability Data Network20)
was established by the European Commission to collect and analyse financial and economic data from
farms in all EU member states. Its objectives include:
o provide policymakers, researchers and stakeholders with comprehensive and reliable data on
the financial performance, structure and dynamics of agricultural enterprises;
o support the evaluation, monitoring and development of CAP policies and measures by
providing evidence-based information on the impact of agricultural policy on farm incomes,
productivity and competitiveness;
o facilitate benchmarking and comparison of agricultural holdings in different regions and
sectors, thus promoting best practices and knowledge sharing in the agricultural sector 21.

The Ukrainian State Agrarian Register (SAR)22 was launched in August 2022 with EU assistance. The platform
allows agricultural producers to obtain information on current state aid programmes and apply for them.
Simultaneously, the registry collects, processes, and provides information on agricultural producers and their
agricultural activities. Thus, the SAR partially overlaps with the functions of the IACS. At the same time, no
systems in Ukraine would serve as equivalents for LPIS and FSDN.

3.3. NATIONAL STRATEGY FOR THE DEVELOPMENT OF


AGRICULTURE

National agricultural development strategies in EU Member States are tailored to the unique characteristics
of each economy. They also align with more comprehensive EU policies like the EU CAP. The geography,
climate, and economic characteristics of the Member States drive national strategies. However, they share
common goals, such as increasing agricultural productivity, sustainability and competitiveness, and
promoting rural development. Accordingly, successfully integrating the Ukrainian agricultural sector into the
EU will require developing and implementing a national strategy.
As of March 2024, the strategy for developing agriculture in Ukraine until 2023 has not yet been approved.
The State Targeted Programme for the Development of the Agricultural Sector of the Economy for the Period
up to 202223 was positioned as a document created in accordance with European norms and practices. The
document included specific provisions related to environmental protection and improving the quality of life
(in particular, in rural areas). However, it lacked sufficient detail and a logical link between problems,
strategic goals, and policies, not to mention quantitative indicators for monitoring and evaluation.
The current National Economic Strategy (NES) for the period up to 2030 24 presents several strategic goals for
the development of the agricultural sector:

• ensuring the implementation of incentive and advisory agricultural policy;
• providing market players with quality infrastructure (land, irrigation systems, finance, education and
science, transport, storage facilities);
• creating conditions for producers to provide affordable material and technical resources;
• balancing the production of high and low-margin products to increase the sector's profitability;
• promoting the development and complete provision of a market for the processing industry;
• optimising sales of products in the domestic and foreign markets;
• ensuring the production and export of safe and healthy agricultural and food products.

The document also describes tasks aimed at achieving each of the above goals. However, neither the State
Targeted Programme for the Development of the Agricultural Sector of the Economy until 2022 nor the NES
section on the agricultural sector meets European requirements.

The Romanian agricultural sector structure most resembles the Ukrainian one. However, Poland has a better
agricultural development strategy and is one of the five most prominent beneficiaries of the CAP.

Let us consider Poland's Strategy for Sustainable Development of Rural Areas, Agriculture, and Fisheries
203025 as an example of good practices. The aforementioned practices include:
• A detailed problem analysis from the economic, environmental, social and demographic per-
spectives. The strategy identifies low incomes in rural areas, out-migration from rural areas, and
low-tech rural production as the main barriers to agricultural and rural development. These problems
are addressed comprehensively. Thus, the development strategy aims to improve living conditions,
develop human capital, and increase productivity.
• A vision for the development of agriculture and rural areas in the long term. The Polish strategy
aims at fundamental improvements through structural change. The development strategy describes a
vision of agricultural production and the rural regions in a perspective that goes beyond the planning
period.
• Setting strategic objectives that go beyond the narrow scope of sectoral policies. Strategic
objectives address the economic aspects of agricultural production (e.g., productivity), improving
living standards in rural areas, environmental protection, human capital, and entrepreneurship.
• There is a clear link between policies and strategic goals. The document contains a detailed
justification for implementing each policy, and the proposed policies are logically aligned with
the strategic goals.
• Describe the monitoring process and identify quantitative indicators to assess the extent and
quality of strategy implementation. The strategy contains a list of quantitative indicators for each
strategic goal (e.g. real income per person, percentage of revenue from the sale of innovative goods
in exports, life expectancy, etc.)
Ukraine should develop a national agricultural development strategy, taking into account the criteria
described above, to implement the European Commission's most urgent recommendations. Given the long
planning horizon, it would also be advisable to develop the strategy in line with European policy documents,
in particular, EC Regulation 2021/2289.

4. FURTHER STEPS
The European Commission's recommendations described in the previous section address the most urgent
reforms. But further integration into the Internal Market will require more decisive steps. A discussion on
future directions is presented in the remainder of this section.

4.1. AGRICULTURAL ACQUIS


EU agricultural legislation covers a wide range of policies, standards, and rules governing agricultural
practices in the European Union, aimed at enhancing market integration, environmental sustainability, and
socio-economic development of rural areas. The critical aspects of EU agricultural legislation are governed by
the EU CAP, agricultural product standards, trade rules, and rural development (see Annex 2).

The EU CAP is regularly updated; accordingly, EU agricultural legislation is subject to constant changes and
revision. In such circumstances, formal approximation of the agricultural legislation of the candidate countries
to the European agricultural acquis plays a secondary role. Instead, the readiness to implement agricultural
policy based on the main principles of the EU is crucial. The requirements for membership in the context of
agricultural policy are mainly related to the following 26:
• A sustainable model of agricultural policy. This criterion means establishing a balance between
agricultural policy's economic, environmental, and social objectives. In addition, the policy should be
comprehensive, i.e., go beyond the narrow scope of sectoral policies.
• Strategic framework for agricultural policy. Member states must implement agricultural policies
with a strategy that is updated regularly. Agricultural policy must be evidence-based, and state
interventions must have a clear logic and purpose. Monitoring and analytics based on specific
indicators should be integral to the implementation process.
• The amount and distribution of financial resources. Member states should be able to co-finance
EU activities (at the level of 1/3-1/2 of the total costs) and have sufficient funds to implement national
agricultural support and development policies. Expenditures on direct support to producers
(subsidies, direct payments, etc.) and investments in agricultural development should be balanced.
• Direct support measures for producers. State payments to agricultural producers should be limited
to priority sectors and conditional on compliance with environmental and social standards, with
beneficiaries being equal in the eyes of the state. Monitoring and accounting systems (primarily IACS
and LPIS) should ensure the efficient and fair distribution of funds.
• Measures to support competitiveness. In line with national priorities, the state should apply a wide
range of measures aimed at preserving and improving the competitiveness of agricultural producers.
These include, among others, promoting collective investment and food chain development,
supporting producer organisations and extension services, etc.

• Environmental protection measures. This requirement refers to the agri-environmental and
environmental policy model and includes support for organic production, conservation of areas of
high natural value, and other similar policies.
• Quality of life and employment. The state should introduce a functional system of local support,
promote agricultural diversification and social inclusion, support relatively small farms, and improve
living conditions in rural areas.

4.2. EXPERIENCE OF THE BALKAN CANDIDATE COUNTRIES

Albania, Bosnia and Herzegovina, Montenegro, North Macedonia, and Serbia are candidates for EU
membership. Therefore, it is appropriate to review their progress in agricultural sectoral integration and
identify the main obstacles they have faced and which Ukraine may face.
• In the area of the strategic agricultural policy framework, the Balkan candidate countries are
mostly insufficiently prepared for the accession27. Although the abovementioned countries have
successfully developed and implemented national strategies, the lack of clear linkages between
policies and their expected results, insufficient administrative capacity in terms of monitoring and
evaluation (often linked to the slow pace of implementation of European agricultural tracking and
record-keeping systems), and the discrepancy between actual and manifested policies create barriers
to further progress in this area.
• Given their relatively low income, the Balkan countries have fewer resources to support agriculture
than the EU members. Most countries (except Serbia) spend disproportionately more on direct support
measures than on rural development.
• Producer support measures are limited to subsidies. As EU countries have abandoned this model in
favour of direct payments (i.e., payments that are not linked to production volumes but are
conditional on compliance with production standards), Balkan countries also need to reduce subsidies
(payments linked to agricultural output) while increasing direct payments to farmers (i.e., payments
that are partially related to the area of land cultivated and compliance with environmental and other
production standards).
• Competitiveness support measures in the Balkan countries are mainly aimed at facilitating farmers'
access to finance due to the dominance of small farms. Spending on food quality, safety, research,
and development is disproportionately low compared to the EU.
• In the context of environmental protection measures, none of the Balkan countries has sufficient
policy quality, and actual measures are significantly at odds with programme documents.
• Most Balkan countries face problems similar to the EU regarding quality of life and employment in
rural areas. The EU's top-down approach to policy in this area is virtually absent in most Balkan
countries and is accompanied by relatively modest budgetary expenditures.
In general, the agricultural policies of the Western Balkan countries are in line with the EU CAP in terms of
commitments and planning rather than in terms of actual policies implemented. Despite the implementation

of the vast majority of European legal acts regulating agricultural production and formal compliance with EC
requirements (e.g., adoption of an agricultural development strategy), most Balkan countries remain
constrained by the lack of administrative capacity and inability to increase public spending.

4.3. UKRAINE'S READINESS FOR ACCESSION IN THE CONTEXT OF


THE AGRICULTURAL ACQUIS

An overview of the main regulatory acts of the European agricultural acquis is provided in Annex 2. Most of
the legal acts regulating the quality of farm products have been implemented after signing the Association
Agreement. At the same time, legislation regulating the internal market has not yet been implemented. In
particular, this includes:
• protecting agricultural (primarily small) producers from unfair practices;
• regulatory documents confirming Ukraine's commitment to adhere to the vision for the future of the
EU CAP;
• rules for financial support for national plans developed under the EU CAP;
• rules governing direct payments to farmers;
• rules for financing, management and monitoring of critical agricultural support funds;
• assistance and compensation related to the joint organisation of agricultural markets;
• rules for monitoring and accounting in agricultural production;
• promotion of EU agricultural products (i.e., increasing the competitiveness and consumption of EU
agricultural products both within the EU and in third countries);
• rules governing the production and marketing of genetically modified products;
• rules governing the use of pesticides and fertilisers;
• regulation of competition in agricultural markets.

4.4. GOVERNMENT PLANS


Ukraine gained candidate status in June 2022, and the new status requires sectoral integration with the EU
at a deeper level than that provided for in the Association Agreement. Accordingly, the current governmental
screening of the compliance of Ukrainian legislation with the European acquis 28 contains an action plan aimed
at enabling Ukraine's future participation in the EU's Common Agricultural Policy. In particular, it concerns
the implementation of regulations on national aid, CAP mechanisms, and agricultural funds (see details in
Annex 2). The implementation of the Government's plans should partially close the gap between Ukrainian
and European agricultural legislation, but not completely.

4.5. EXPERT OPINION


As part of the study, the Centre for Economic Strategy conducted interviews with Ukrainian and European
experts and representatives of agribusiness, as well as with anonymous European experts29. Based on the

issues raised during interviews and the public discussion organised by CES 30 on 08.03.2024, we have
formulated several possible priority areas for further integration of the Ukrainian agricultural sector into the
European Internal Market.

• Implementation of legislation aimed at creating a general framework for the functioning of


the agricultural market. The institutional design of the Ukrainian agricultural market partly
contributes to its relatively high level of concentration, as it is easier for large players to survive given
the limited government intervention. Similar problems in the EU and lengthy discussions on this issue
culminated in the adoption of Directive 2019/633 31, which aims to prevent unfair practices and is
primarily aimed at protecting small producers and suppliers. Although the directive does not provide
an exhaustive list of unfair practices, it creates a general framework for national legislation. However,
according to the analysis of a set of regulations and reports32, the implementation of Directive
2019/633 can prevent unreasonable extensions of payment terms, claims for additional benefits that
are not related to the subject matter of the contract, the use of excessively detailed product
specifications to refuse delivery or reduce the price of the ordered goods; inadequately high
contractual penalties, etc.
Thus, implementing Directive 2019/633 can not only narrow the gap between Ukrainian and
European agricultural legislation but also significantly improve market conditions for small farmers.
• Expanding the system of state aid to farmers. Before the full-scale invasion, the level of state
support for agriculture in Ukraine was substantially lower compared to EU countries33. Moreover, the
legal framework governing state support for agricultural producers is much less detailed and provides
for a narrower range of instruments compared to EU legislation (see Annexes 1 and 2).
Regulation (EU) 1370/201334 is one of the key documents regulating the principles of interaction
between the state and agricultural producers. In addition, a set of accompanying regulations (see
Annex 2) will also require implementation.
The government plans shared by Mr Vysotskyi include updating the law "On State Support of
Agriculture of Ukraine"35. In addition, it is planned to establish a payment agency (similar to those in
the EU), which should operate outside the Ministry of Agrarian Policy and Food to administer and
monitor state payments to farmers.
• Monitoring and reporting. According to the updated EU CAP principles, state aid is not directly
linked to production volumes but is conditional on meeting several requirements. Under this model,

monitoring and reporting play a crucial role. The implementation of key regulations is one of the
government's priorities. Mr Vysotskyi - as a representative of the Ministry of Agrarian Policy and Food
of Ukraine - noted that the draft law "On the State Agrarian Register"36 should bring the SAR in full
compliance with the European monitoring standards (the law is expected to be adopted by the end of
2024). In addition, the public platform for monitoring land relations37 should be launched in 2025
(however, it should be kept in mind that public access to information may be limited until the end of
martial law). However, the launch of the FSDN equivalent will take longer (at least until the end of
2026) as Ukraine has not had any such system before; however, work on the pilot version has already
begun. As the implementation of the FSDN system will require significant resources, it is expected
that the programme will be at least partially financed by the Ukraine Facility.
• Adoption of European production standards. Most of Ukraine's European integration initiatives in
the field of agricultural production have so far been focused on introducing standards for the
marketing of agricultural products. However, increasing the volume of trade with the EU will also
require compliance with European production practices. Ukraine has implemented legislation on
livestock welfare and – to a great extent – on the certification of organic production, but legislation
on genetic engineering in agriculture and the use of pesticides and fertilisers is only partially in line
with European standards (see Annex 2).
• Raising awareness of the voluntary nature of CAP participation. Although payments to farmers
under the EU CAP are closely linked to a number of environmental requirements, it is important to
understand the difference between mandatory and optional agricultural practices. The first group
includes, among others, rules governing the use of nitrate fertilisers 38 and pesticides39, preventing
water pollution40, and rules aimed at preserving rare bird species41. At the same time, crop
diversification42, conservation focus areas43, and continuous pasture management44 are conditions for
receiving full CAP payments. What does this imply for Ukrainian farmers? Even the European model
of agriculture provides enough flexibility to keep economic efficiency a priority. Ukrainian agriculture
and food processing are represented by fewer large producers, unlike most European countries, where

the model of relatively small enterprises that fulfil most of the requirements of the EU CAP dominates.
Accordingly, the level of production efficiency in Ukraine is higher. Thus, even after Ukraine gains
EU membership, Ukrainian farmers can continue to focus on efficient mass production. At the same
time, small producers will be able to receive additional payments under the EU CAP.
• Defining a strategic export model. Before the full-scale invasion, the EU was not among the main
importers of Ukrainian agricultural products; however, the temporary liberalisation of tariff quotas45
has led to an increase in Ukrainian agricultural exports to the EU 46. Thus, a model of the EU
integration under which Ukraine continues to focus - at least temporarily - on non-EU countries could
speed up the accession. At the same time, the above-mentioned strategy would require revision of
trade agreements between the EU and third countries.

5. CONCLUSIONS AND RECOMMENDATIONS


Ukraine has made some progress in harmonising its agricultural regulatory framework with the EU legislation.
However, if distinguishes between "quantity" and "quality", one must admit that most of the laws and orders
adopted in the framework of the European integration process (in particular, in the course of the Association
Agreement implementation) did not address the fundamental principles of agricultural production regulation
and functioning of agricultural markets. Therefore, further steps will require revising the existing models and,
accordingly, significant resources.
Let's look at Ukraine's readiness to implement European agricultural legislation in key areas:
• Market organisation: regulation of relations between entrepreneurs. The Law on Agricultural
Cooperation47 is the central act regulating relations between agricultural producers in Ukraine.
However, this law is only marginally in line with the EU standards. In particular, Ukraine has not
implemented a law protecting farmers from unfair practices48.
• Market organisation: regulation of relations between producers and the state. European
legislation defines a wide range of measures and policies aimed at supporting agricultural producers
by the state. In particular, these include measures aimed at stabilising agricultural markets (such as
assistance with farm storage and other types of intervention) 49. However, the Ukrainian regulatory
framework is much less detailed and comprehensive. During the war, Ukraine did not have sufficient
budgetary resources to fundamentally change the support model for agricultural producers. However,
work on developing a regulatory framework can already be initiated.

• Regulation of specific agricultural markets. In the past, strict quotas on agricultural production
were designed to ensure a stable supply (and thus prices) of agricultural products. The current EU
CAP is more free-market oriented, and most of the quotas are no longer in place. However, the
markets for sugar, dairy, wine, and fish are still subject to regulation, albeit not as uncompromising
as before (and it cannot be guaranteed that in the future, the list of products under the EU CAP
regulation will not be extended). The volume of Ukrainian agricultural production is outstanding
compared to the current EU members. In addition, for the Ukrainian economy, which is being affected
by the war, a reduction in the number of agricultural enterprises as a result of quotas (as it happened,
for example, in Poland) is not feasible or acceptable. Thus, negotiations on the relevant regulations50,
which are formally part of the European agricultural acquis, will be fierce. It may be worth
considering the recommendation to allow Ukraine to target non-EU countries as agricultural export
destinations.
• Accounting, monitoring, and financing. Legislative changes that are due shortly should bring the
SAR in line with European standards. At the same time, introducing the new platform for information
on land relations and land plot mapping is not possible until the war is over - this requirement of the
European partners cannot be met in the near future for quite objective reasons. In addition, the farm-
ers’ accounting data platform will require at least three years (and significant external funding) to
become fully operational.
• Legal framework for participation in the EU CAP. Given the role of the EU CAP in the EU Internal
Market, Ukraine will not be able to become a full-fledged member without implementing the
necessary legal framework - even under the so-called "Polish scenario51". Most environmental practices
under the EU CAP are completely voluntary for farmers, as are payments to farmers from the national
budget. At the moment, the above-mentioned regulatory framework of the CAP has not been

practically implemented in Ukraine. At the same time, fulfilment of this condition does not involve
fundamental changes or significant investments.
• Specific requirements for production standards. Ukraine has made significant progress in
implementing European legislation on organic production. However, genetic engineering in
agriculture has only a general legal framework52, which requires further elaboration in order to be
fully complient with the EU regulations. In addition, the legislation on the use of fertilisers and
