THIS AGREEMENT is made this ……...…. day of.................................... 2024;
BETWEEN:

Mr. Emeka Ejim of Number 27 Idodo Street Achara Layout Enugu (hereinafter
referred to as “the LANDLORD” which expression shall where the context so
admits, include his heirs, personal representatives, successors-in-title,
executors and assigns) of the first part;
AND

Mr. Chizoba Johnpaul Agbo of Flat 1, 27 Idodo Street Achara Lay-out Enugu,
Enugu State (hereinafter referred to as “the TENANT” which expression shall
where the context so admits, include his heirs, personal representatives,
successors-in- title, executors and assigns) of the second Part;

WHEREAS:

1. The Landlord is the owner of all that property situated at Number 27


Idodo Street Achara Layout Enugu.

2. The Landlord and the Tenant have agreed to enter into a tenancy
agreement on the terms and conditions hereinafter contained.

3. The Landlord and the Tenant agree that the terms and conditions contained
in this agreement shall remain enforced each new year rent is renewed
(August every year) and throughout the period the tenant is an occupant in
the demised property.

NOW, THIS AGREEMENT WITNESSES AS FOLLOWS:

That in consideration of the Rent reserved and the covenants on the part of
the Tenant to be performed and observed:

The Landlord demises unto the Tenant ALL THAT three (3) bedroom flat with
its appurtenances situated at Flat 1, number 27 Idodo Street Achara
Layout Enugu State, (hereinafter called “the premises”) TO HOLD the same
unto and to the use of the Tenant for a term of one (1) year from A u g u s t
2024 to July 2025 the Tenant paying, therefore, a yearly rent of Six
Hundred and Fifty Thousand Naira only (₦650,000.00) the receipt whereof
the Landlord hereby acknowledges. Any further rent or increase in rent at
the expiration of the one year shall be duly given notice by the Landlord and
shall be paid yearly and in advance.
ARTICLE I

TENANT’S OBLIGATIONS

The Tenant hereby agrees with the following:

1.1 Paying the rent hereby reserved at the end of each tenancy year.
1.2 To pay all rates, charges, electricity and security bills, tenement rates,
environmental and water bills, assessments, impositions, duties, and
outgoings which are now or may hereafter be imposed on the demised
premises during the tenancy.
1.3 To indemnify the Landlord against any bills which the Tenant may have
left unpaid at the expiration of the tenancy.
1.4 Not bring in any additional water tanks into the premises.
1.5 To keep the interior of the demised premises, all fixtures and fittings
therein in good and tenantable condition throughout the tenancy term.
1.6 To replace any fixtures and fittings which might prove to be destroyed,
damaged or missing at the determination of the term hereby created.
1.7 To permit the Landlord, his Agents, workmen, and servants to enter the
demised premises at reasonable times of the day with prior notice having
been given to examine the state and condition of the demised premises
and to execute and carry out any structural repairs or works.
1.8 Not to make or permit to be made any structural alterations or additions
to the demised premises or any part thereof without the previous written
consent of the Landlord or his Agents. Where any alteration is made to
the demised premises, to restore the premises to their original state
before the expiration of the tenancy.
1.9 Not to assign, charge, sublet, or otherwise part with the possession of the
demised premises or any part thereof to any person or persons or
company whatsoever without first obtaining the written consent of the
Landlord.
1.10 Not to do or cause to be done anything which may cause the insurance
policy on the demised premises against loss or damage by fire, tornado,
and other insurable risks to be void or voidable or otherwise cause an
increase in the premium.
1.11 Not to use the demised premises for any illegal activities which may be or
become a nuisance or cause inconvenience to the Landlord or occupiers
of neighboring or adjoining properties and or premises.
1.12 To pay all monthly contributions on time.
1.13 Not to create air conditioner holes in the premises without first obtaining
first the written consent of the Landlord.
1.14 Not to hang clothes on the railings or on the balconies or use the spaces
below the staircase as a storage area for a property of any kind.
1.15 Not to deface the property or any part thereof by painting any external
part of the building like balconies with any color of paint, other than the
one originally used or erect mosquito nets or doors or cages on the
balconies of the demised premises.
1.16 Not to store highly inflammable materials on the demised premises or any
part thereof.
1.17 At the expiration or sooner determination, of the tenancy hereby created,
to surrender and yield to the Landlord the demised premises in good and
tenantable repair and condition.
1.18 To give a three (3) months’ notice before the expiration of this tenancy or
intention to renew or determine the tenancy.
1.19 Not to fail or neglect to perform and observe all the obligations and
covenants herein contained in this Agreement on the part of the Tenant
to be performed and observed.
1.20 To vacate the premises, deliver the keys thereof, and deliver the premises
to the landlord in good and tenantable repair and condition at the
expiration or determination of the tenancy.
1.21 Not to play or permit or suffer to be played upon the premises, music or
musical instrument at a such high pitch as to cause annoyance,
disturbance, or nuisance to the landlord or the other tenants or the
occupiers of the adjoining premises and not to pray or engage in prayers
within the premises in such a manner as to disturb the other tenants, the
landlord or neighbors or in any other manner pray without limiting the
prayer to the apartment occupied by the tenant.
1.22 Not to cook or engage in cooking within the premises with firewood or
such like materials, under any guise whatsoever.

ARTICLE

LANDLORD’S OBLIGATIONS

2.1 The Landlord shall permit the Tenant, upon paying the rent herein reserved
and performing and observing the entire Tenant’s obligations and covenants
herein contained, to hold and enjoy the demised premises during the
reserved term without any disturbance by the Landlord or any of his agents
or authorized representatives or staff.
2.2 The Landlord may at the expiration of the term hereby created, grant the
Tenant a further term of years, if the Tenant is desirous of continuing in
occupation of the premises provided a prior three (3) months’ notice of such
desire is given to the Landlord. This further term shall be subject to a rent
agreed to by the parties and for the same terms and conditions.

IT IS HEREBY FURTHER AGREED AS FOLLOWS:

a) That in the event of the Tenant not performing all or any of the obligations or
covenants herein contained and after notifying the Tenant in writing of the
failure/or breach of any of the said obligations or covenants and the Tenant
fails to rectify same within a period of two (2) weeks, the Landlord shall give
to the Tenant a six (6) week written notice, duly served on the Tenant, of his
intention to lawfully re-enter upon the demised premises or any part thereof
in the name of the whole, whereupon the Tenancy shall be absolutely
determined and the unexpired rent if any refunded to the Tenant but
without prejudice to the right of action of the Landlord in respect of breach
of any obligations on the part of the Tenant;

b) The period reserved under this tenancy may be determined by either party
hereto giving to the other three (3) months’ notice in writing before the
expiration of the term hereby granted;

c) Any notice shall be in writing both to the Landlord, and the Tenant.

d) If any provision of this Agreement is rendered void, illegal, or unenforceable


in any respect, the validity, legality, and enforceability of the remaining
provisions shall not in any way be affected or impaired thereby.

e) All subsequent rent payments shall be done in a timely manner (before the
expiration of the 1-year tenancy) failure of which the Landlord shall deem
the tenancy fulfilled and shall have the right to lawfully recover the demised
premises.
