Being duly instructed, authenticated, and authorized by


Farooq Ahmad S/o Mohd Ashraf R/o Bhatyas Jakyas Doda
(hereinafter referred to as 'my client'), I hereby serve you this
legal notice, the contents whereof read as under:

1. That my client is a bonofied registered owner of a


commercial vehicle tipper bearing registration no. JK14A9773,
Engine no. 697TC56FRZ130223 and chasis no.
373103FRZ122957 Which was subjected to hypothecation in
favour of SHRI RAM TPT, FIN.CO Ltd.

2. That my aforesaid client took a loan from your company


with respect to the aforesaid commercial vehicle. But due to
unavoidable reasons my client was not able to pay the loan
installments to you due to which you filled a case against my
client, before the court of District Judicial Mobile Magistrate
(T) Doda under section 138 NI Act. The case titled Shri Ram
Finanace Ltd Vs Farooq Ahmed was filled on 10-05-2023, and
was disposed on 10-07-2024 on the term that my client will
pay the loan amount to you as full and final payment of the

loan and you will keep the vehicle with you and get it
transfered to its new owner by following due process.

3. That you have sold the vehicle registered in the name of


my client to some third person without transferring the
requisite documents in the name of that third person. The new
owner of the aforesaid vehicle is still an un registered owner
and driving that vehicle being registered in the name of my
client which will make my client liable for any miss happening
or any legal consequences.

4. That Immediately after the acknowledgement of the


fraud/breach of trust, my client tried contacting you by every
possible means but you avoided my client completely &
showed no response in any manner. My client also approached
to your goodself by means of written application, but my client
has received no positive response till date.

4. That it is apprised to you that your acts and omissions have


given rise to an offence under various provisions of law.
Hence, you are liable to be prosecuted under legal provisions.

5. That This legal notice may kindly be treated as the last and
final opportunity for you.

I, therefore, call upon you to transfer the aforesaid vehicle


and its documents within Fifteen (15) days from the date of
receipt of this notice failing which my client shall launch
criminal proceedings against you. Moreover, you are also liable
to pay my legal expenses. For your information, I have charged
Rs. 10,000 for serving this legal notice upon you.

A Copy of this notice has been retained in my office record for


necessary action.
