THE CONSTITUTION
ARTICLE 1: BACKGROUND INFORMATION
a) Name of the group: RISE & WALK b) Address of the group: mutungo zone 10, at Life Changing Church c) Date of formation: 21st Dec 2017 d) Date of registration: not yet e) Minimum number of members: 17 members f) Maximum number of members: 30 members g) Cycle number: 02
ARTICLE 2: THE OBJECTIVES
a) To alleviate poverty b) For better livelihood c) To foster development in our community
ARTICLE 3: ACTIVITIES OF THE GROUP
a) Borrowing b) Poultry c) Goat rearing d) Liquid soap manufacturing
ARTICLE 4: CRITERIA FOR MEMBERSHIP / WHO MAY BE A MEMBER?
a) Gender: mixed both male and female b) Age limit: from 18 years to 45 years c) Reputation: persons of good character d) Residence: people of the same area of jurisdiction e) Health: people of sound mind and good health. f) Registration Fee: 5,000/= (includes a saving book)
ARTICLE 5: THE COMPOSITION OF MANAGEMENT COMMITTEES
The following elective post shall be the management committee of the association and shall perform their duties as prescribed.
a) Chairperson: MALE FRANCIS
b) Vice Chairperson: DAMULIRA HASSAN c) The treasurer: SANDE FRED d) The secretary: WAKIDA BRIAN e) The money counters: KIIKO FRANCIS / MUGISHA WILBERFORCE. f) Key keepers: NAHWERA MOREEN / ONENWROTH PATRICK
ARTICLE 6: ELECTION PROCEDURES
a) Term and limit – the maximum time one shall serve on the management committee shall be after two term. b) Method (system) of election – the election shall be by show hand. c) Quorum: the minimum number of members required to hold any group meetings for any amendments in the constitution shall be 17 members of the general assembly. d) Any member of the group (General Assembly) shall be qualified for any elective position with the group. ARTICLE 7: THE GROUP MEETING The group meeting shall be carried out every week. The aim of the meeting is to mobilize savings and loan out money to the members only.

ARTICLE 8: THE SAVINGS CRITERIA (METHODS)
a) Minimum amount to be saved per stamp is 3,000 (1 stamp) b) Maximum amount to be saved is shs. 15,000 (5 stamps) c) Operation cycle period shall be 12 months (1 year) d) Failure to make minimum savings after four (4) consecutive weeks then the member shall be fined 2,000/= e) Failure to make any savings within two (2) month it’s guaranteed for your expulsion.
ARTICLE 9: FOR LOAN DISBURSEMENT
a) Purpose of the loan (priorities); members shall be given loan according to the priority of demands of each member. b) People to borrow; all members of the group are eligible to borrow the money. c) Maximum amount to be borrowed; the members agreed that the member’s savings shall be multiplied 2 times to get the required amount of the loan and with two guarantors. d) Interest rates; the interest rate for any loan taken shall be 10% after three months. e) Loan period; the loan period shall be 3 months (12 weeks). f) Each member is required to have 2 guarantors for any loan to be taken. g) Failure to pay the loan: any member defaulting on the loan shall be summoned to appear before the general assembly to give them the account of his/her failure to pay. Still legal actions shall be taken to recover such a loan. Guarantors will be force to pay the loan (the loan will be fairly payed between them using their savings)
ARTICLE 10: THE REMOVAL OF THE MANAGEMENT COMMITTEE
a) Method to be used for removal: a vote of no confidence shall be used to remove any member of the management committee. Members will cast their votes by ballot paper. b) Reasons for removal: any of the following offences shall automatically disqualify any member of the management committee. Failure to execute the duty assigned Lack of integrity Rumor – mongering Theft of group money Bad health/ unsound mind Failure to save c) Quorum required – any member of the management committee shall be removed by not less than 3/4 of the general assembly.
ARTICLE 11: THE EXPULSION OF GROUP MEMBER
a) Method – any member can be removed from the group in case of any complains arising from the group members. b) Reasons for removal: any member shall be expelled from the association if he/she commits any of the following offences: i. Loan defaulters ii. Disrespect/quarreling iii. Abuse of language iv. Theft of group money c) Quorum: for any member to be expelled the required quorum must not be less than 15 members of the general assembly. d) In case of normal withdrawal: such members will get his/ her savings but without the interest since the cycle is not yet complete.
ARTICLE 12: THE DEATH SITUATION
a) A member who dies without a loan, his/her savings shall be given to next of kin of the family. He/she will be given a grant/ condolence of shs. 5,000/= from each member. b) A member who dies with a loan from the group, the group members shall redeem the member’s savings to off-set the outstanding loan balance. / still if there is a balance then the group shall call that a bad loan.
ARTICLE 13: THE CONSTITUTIONAL AMENDMENTS
a) What can cause amendments? Any member of the general assembly may cause amendment changes in the constitution in case of disagreement/ mistakes within the group. b) Quorum: amendment of any article shall be either supported or seconded by at least 15 members of the group.
ARTICLE 14: THE CRITERIA FOR SOCIAL FUNDS (WELFARE)
a) Every member shall be required to contribute towards this fund meant for emergencies. b) The amount to be contributed shall be shs.1000 only. c) This fund shall be borrowed only once in a (1) month. d) It shall be borrowed by only members who contribute this fund. e) The amount borrowed must be returned within 3 months. NB: the following are the types of emergencies upon which a member shall borrow a social/ welfare fund. Grants non refundable Categories Amount (shs) Death of a member 5,000/= each member Death of spouse 2,000/= Death of biological child 2,000/= Death of biological parents 2,000/= Sickness of a member 2,000/=
ARTICLE 15: THE FINES SITUATION
If a member breaks any of the by-laws, he/she shall pay the following fines S/N OFFENCES AMOUNT 1 Absenteeism (2 weeks) 1,000 2 Late coming/arrival 500 3 Rumor mongering outside the group 2,000 4 Rumor mongering within the group 2,000 5 Talking while the meeting is going on 500 6 Failure to perform by the management committee 1,000 7 Early departure 1,000 8 Showing disrespect to fellow member(S) of the management committee. 5,000 9 Phone-ringing during the meeting session 500 10 Sending money( in case mobile money of withdraws should be added) 500 11 failure to bring the key in time 10,000 ARTICLE 16: THE APPROVAL OF THE BY-LAWS We the undersigned members of the RISE & WALK do approve the by-laws with its terms and conditions as our supreme tool to be referred to all times as may be required in order to attain the group’s goals.
