CSC CIVILSERVICE COMMISSION Republic ofthe Philippines INCLUSION OF MILITARY AND UNIFORMED Number: 2500164 PERSONNEL (MUP) IN THE COVERAGE FOR THE GRANT OF CAREER SERVICE ELIGIBILITY - PREFERENCE RATING (CSE-PR) Promulgated: 30 January 2025 x RESOLUTION WHEREAS, Section 3, Article IX-B of the 1987 Constitution provides that the Civil Service Commission (CSC), as the central human resource agency of the government, shall adopt measures to promote morale, efficiency, integrity, responsiveness, progressiveness, and courtesy in the Civil Service. It shall strengthen the merit and rewards system, integrate all human resources development programs for all levels and ranks, and institutionalize a management climate conducive to public accountability; WHEREAS, Section 2, paragraph (2), Article IX-B of the 1987 Constitution also stipulates that appointments in the Civil Service shall be made only according to merit and fitness to be determined, as far as practicable, and, except to positions which are policy- determining, primarily confidential, or highly technical, by competitive examination; WHEREAS, Section 12, paragraphs (1) and (3), Chapter 3, Subiitle A, Title 1, Book V of Executive Order (EO) No. 292' vesis in the CSC the power and function to administer and enforce the constitutional and statutory provisions on the merit system for all levels and ranks in the Civil Service, lay down policies, standards, and guidelines for the Civil Service, and adopt plans and programs to promote economical, efficient, and effective human resource administration in the government, WHEREAS, Section 12, paragraph (7), Chapter 3, Subtitle A, Title I, Book V of EO No. 292, also provides that the CSC shall have the power to control, supervise, and coordinate civil service examinations, which carries with it the authority to prescribe and determine the passing standards for said examinations; WHEREAS, Section 12, paragraph (8), Chapter 3, Subtitle A, Title |, Book V of EO No. 292, also provides for the authority of the CSC to prescribe all forms for Civil Service examinations, inter alia, as may be required by laws, rules, and regulations; WHEREAS, the Supreme Court affirmed the authority of the CSC to prescribe, amend, and enforce rules to cover the Civil Service to promote economical, efficient, and effective personnel administration;? WHEREAS, the CSC conducts the Career Service Examinations (CSE), Professional and Subprafessional levels, amang ather examinations, which are open ta all Filipina citizens who are at least 18 years old, with good moral character, not convicted by final judgment of an offense or crime involving moral turpitude, or disgraceful or immoral conduct, dishonesty, + Adminitrative Code of 1987. 2 Leah M. WHEREAS, Sections 1 and 2, Rule Ill (Ratings and Eligibilities) of CSC Resolution No. 91-1631‘ dated 27 December 1991 established the passing grade in written examinations to be at least 80%, and that only those who obtained the general rating of 80% or higher shall be eligible for appointment to positions for which the examination was given; WHEREAS, the CSC, pursuant to its powers and mandates as the central human resource institution of the government and as administrator of civil service examinations, promulgated CSC Resolution No. 2301123 dated 07 December 2023,° granting Career Service Eligibility — Preference Rating (CSE-PR) to specific groups of workers which include Job Order (JO), Contract of Service (COS), Casual, Contractual, Coterminous, employees holding Category II and Category IV positions, as enumerated in CSC Memorandum Circular No. 10 dated 16 April 2013,° and Career service employees with first level eligibility (hereinafter collectively referred to as “JOCOSCE") based on length of service and work performance; WHEREAS, the policy on the CSE-PR became effective on 12 February 2024 and has been implemented nationwide benefiting qualified JOCOSC6 human resources (HRs); WHEREAS, during the Senate Budget Hearing on 09 October 2024, the CSC was asked to study on the request of some military and uniformed personnel (MUP) to provide a mechanism that would allow their regular appointment or pramatian outside of the military and uniformed service, subject to the requirements that the CSC may impose without sacrificing merit and fitness; WHEREAS, the CSC received a letter from the Philippine Coast Guard (PCG) dated 08 November 2024,” requesting for the grant of CSE-PR to both their uniformed and non- uniformed personnel reckoned from the issuance of CSC Resolution No. 2301123 dated 07 December 2023; WHEREAS, a review of CSC Resolution No. 2301123 dated 07 December 2023 would show that it already covers non-uniformed personnel from government agencies in the military and uniformed service; WHEREAS, consultations were conducted by the CSC with extemnal® and intemal? stakeholders in accordance with the CSC Policy Development Framework" to come up with a policy that will authorize tha acquisition of Civil Service eligibility to MUPs who are either in 2 Sections 3 and 6, Rule2 “Recruitment and Examination”, Omnibus Rules implementing Book V of Executive Order No, 292 and ‘other Pertinent Civil Service Laws. + Omnibus Rules implementing Book V of Executive Order No, 292 and Other Pertinent Chil Service Laws. 5 Entitled "Grant of Career Service Eligibility ~ Preference Rating (CSE-PR) to Specific Workers in Governmant Agencies Based on Length of Service and Work Performance. * Revised Policies on the Grant of Eligibility Under CSC MC No. 12,5. 1996, ag amended. » Signed by Commodore Glide Gene Mary G Sontllanosa, for the Commandant of the Philippine Coast Guard, addressed to commissioner Allagn Lourdes A. Inclusion of Military and Uniformed Personnel (MUP) jn the Coverage for tho Grant of Career Service Eligibility ~ Preference Rating (CSE-PR) [page 3 of 4] WHEREAS, Section 6, paragraphs (1) and (2), Chapter 2, Subtitle A, Title |, Book V of EO No. 292 provides that the Civil Service embraces all branches, subdivisions, instrumentalities, and agencies of the Government, including government-owned or controlled corporations with original charters, and that positions in the Civil Service shall be classified into career service and non-career service; WHEREAS, Section 7, paragraph (5), Chapter 2, Subtitle A, Title 1, Book V of EO No. 292 enumerates the positions in the Career Service which include commissioned officers and enlisted meniwomen of the Armed Forces of the Philippines (AFP) which maintains a separate merit system; WHEREAS, under Section 35, Chapter 6, Title VIII, EO No. 292, the AFP shall consist ‘of the Philippine Army (PA), Philippine Air Force (PAF), Philippine Navy (PN), while the Philippine Marine Corps (PMC) was established as an independent branch of the AFP under AFP General Order No. 319 effective on 02 November 1950; WHEREAS, other uniformed personnel in the Civil Service are from the Bureau of Fire Protection (BFP), Bureau of Jail Management and Penology (BJMP), Bureau of Corrections (BuCor), Philippine Coast Guard (PCG), and the Philippine National Police (PNP), which appointment and merit system are governed by Civil Service law, rules, and regulations; WHEREAS, the CSC regards the professionalism, discipline, and invaluable services of these MUPs, manifested in the performance of their duties and responsibilities, which inherently put their lives or limbs in danger in the name of service to the nation; and WHEREAS, the CSC recognizes the possibility of these MUPs to work in the career service outside of the military and uniformed service that requires meeting of certain qualification requirements, including civil service eligibility, for purposes of regular appointment or promotion; WHEREFORE, jn view of the foregoing legal and factual considerations, the CSC RESOLVES to include the services of the MUPs in the coverage for the GRANT of the Career Service Eligibility — Preference Rating (CSE-PR) under CSC Resolution No. 2301123 dated 07 December 2023, subject to compliance with the following requirements: 1. he/she must have rendered or is rendering services as an MUP honorably at the AFP, BFP, BJMP, BuCor, PCG or PNP, or a combination of any of the foregoing, for at least ten (10) aggregate years on the date of filing of the application for the grant of CSE- PR; 2. helshe must have applied and taken the scheduled CSE, beginning with the 10 ‘August 2025 CSE and thereafter, either CSE - Professional or CSE - Subprofessional level, whether through Pen-and-Paper Test (PPT) or other test modes," and obtained a failed rating of not lower than 70.00; 3. helshe must have at least a Very Satisfactory (VS) performance rating, or its equivalent, in the last two (2) rating periods prior to the date of filing for the grant of CSE-PR; and +3 65¢ computerized Exam (COMEX) or Other Examination Modes thatthe CSC may adapt thereafter. : ( Inclusion of Military and Uniformed Personnel (MUP) jin the Coverage for the Grant of Career Service Eiigiblty — Preference Rating (CSE-PR) page 4 of 4] ed 3. he/she must have at least a Very Satisfactory (VS) performance rating, or its equivalent, in the last two (2) rating periods prior to the date of filing for the grant of CSE-PR; and 4, he/she must file the application for the grant of CSE-PR using the appropriate Application Form (CS Form 101-CSP-RE-MUP) with complete documentary requirements prescribed herein as Annex A, within six (6) months from the date of release of the results of the CSE taken, unless extended by the CSC on meritorious grounds. The CSC FURTHER RESOLVES to grant the same level of eligibility as that of the examination taken, e.g., Career Service Professional Eligibility for those CSE-PR qualified applicants who took and failed the CSE — Professional Level. The CSC FURTHERMORE RESOLVES to adopt the other relevant provisions of CSC Resolution No. 2301123 dated 07 December 2023 in the grant of CSE-PR ta MUPs, specifically the provisions on stages of application, modes of filing, venues for filing, process flow, maximum number of allowable preference rating to be granted, frequency for the grant, schedule of fees and charges, legal remedies, penal clause, and review procedure. The CSC FINALLY RESOLVES that this Resolution shall supplement CSC Resolution No. 2301123 dated 07 December 2023, and that it shall form part of the succeeding policy review procedure of CSC Resolution No. 2301123 dated 07 December 2023, a year affer its effectivity.
