The Great Singh Claimant

v.

Wrestlers Association of Hogwarts Respondent

1. The Wrestlers Association of Hogwarts (WAH) is a privately owned wrestling


entertainment company. It is the largest wrestling company in the world, with the largest
wrestling promotion of over 250-300 shows a year. The company’s headquarters is
located in New Delhi, India.
2. In professional wrestling, a fictional storyline is known as an ‘Angle,’ which takes place
between two opposing wrestlers. The matches are predetermined, i.e. the outcome of
the matches is already decided. Every wrestler has his/her own ‘Gimmick,’ which is
their in-ring persona, character, behaviour or attire that distinguishes them from the rest.
These in-ring personas are highly popular among fans, who buy merchandise associated
with their favourite wrestler’s gimmick.
3. WAH trademarks their wrestler’s gimmicks as their own. However, the wrestlers must
provide their own costumes, props and make-up. Hence, a wrestler is made to rehearse
for WAH’s shows in accordance with their storylines. A celebrated wrestler may have
discretion over how their Gimmick progresses. However, the final say remains to be
that of WAH. According to WAH, any wrestler wrestling for them is an ‘independent
contractor’.

4. Over the years, WAH’s top priority has been the wellness of its wrestlers, which has
been administered through its Talent Wellness Program consisting of world renowned
medical professionals. Although there have been allegations of negligence on the part
of WAH with respect to the health of its wrestlers, WAH has emerged innocent in the
same. Wrestlers are made to sign contracts which state that they shall take full
responsibility for the injuries sustained. However, the company does cover all of the in-
ring-related injuries.
5. A celebrated wrestler is usually never made to tap-out, unless the situation in that
particular Angle has been formulated in such a manner. Such a scenario usually gets a
lot of viewership from fans.
6. In recent years, these wrestlers have gained a remarkable reputation for their skills
which has helped generate great viewership for the company. Their popularity has
helped them gain various brand endorsements and movie contracts. One such wrestler
is Madanlal Singh, popularly known as ‘The Great Singh,’ who has been hired by WAH
from India.
7. Due to the persistent excitement amongst fans with respect to The Great Singh, he has
been featured in numerous shows, almost every week and is involved in a lot of ‘Feuds.’
One of the most-watched feud is the one between The Great Singh and Ben Calaway,
known as ‘The Taker.’ Both of them presently are the biggest wrestlers in WAH. The
Taker is just as popular as The Great Singh and has been a part of WAH for a longer
time.
8. WAH has an annual wrestling event, known as the ‘Mania Event,’ which is one of the
most-watched sporting event in the world. The WAH Championship Match was held in
June 2017 at the Mania Event between The Taker and The Great Singh. The Angle was
formulated in such a manner, wherein The Taker continuously beats up The Great
Singh, but eventually The Great Singh manages to win the Championship. However,
during the main event, while The Taker was hitting The Great Singh, The Great Singh
experienced excruciating pain due to which he had to tap-out. Naturally, everybody was
shocked with this outcome and WAH’s viewership spiralled like never before. Upon
examination, it was discovered that The Great Singh had 2 broken ribs, an injured knee
and multiple concussions. On further examination it was also discovered that he had
lost his appetite and was not able to sleep well. The medical team declared Singh to be
unfit for wrestling and asked him to retire from professional wrestling.

9. The Great Singh sued WAH for negligence and prayed for damages in addition to
covering his medical expenses and alleged that WAH has remained ignorant about his
health as the same clearly has been overlooked by the company for the purpose of
gaining higher ratings and viewership.
10. WAH has denied these allegations claiming them to be false and frivolous. The WAH
also claimed that this allegation will meet the same fate as the previous ones which
proved to be baseless against the company. Moreover, they stated that even though the
allegations are hurtful, WAH will comply with its contractual obligations and cover the
in-ring injuries sustained by The Great Singh but will not pay any additional amount as
damages.
11. The case is listed before the District Court; argue on behalf of The Great Singh/WAH.

This imaginary moot proposition has been drafted by Suganshi Ropia (IV BSL LLB) and
Harshita Garg (IV BSL LLB).
